Supreme Court Relief For Mamata Banerjee On High Court's "Suprising" OBC Order

The Calcutta High Court interim stay on notifications issued by the West Bengal government - with regard to reservations for Other Backward Classes, or OBCs - was "surprising" and "prima facie erroneous", the Supreme Court said Monday morning.
The Supreme Court stayed the High Court order and issued a notice on Chief Minister Mamata Banerjee's government's plea, and said it would hear the matter after two weeks.
"This is surprising. We will issue notice in this. How can the High Court order a stay? Reservation is a part of the functions of the Executive. Since Indira Sawhney (referring to the landmark 1992 case that focused on reservations for OBCs) the Supreme Court has said this."
At first the bench led by Chief Justice BR Gavai considered placing this hearing before a different bench of the Calcutta High Court, but ultimately listed matter after two weeks.
Senior advocate Kapil Sibal, appearing for the Bengal government, mentioned this matter before Chief Justice Gavai. "A writ petition was filed... challenging the new list, saying we have to legislate it, which is contrary to all judgements," he said.
To this the Chief Justice stressed that "right from (the Indira Sawhney judgement) the position is that the Executive can do (this)".
Mr Sibal also asked for a contempt petition that had been filed in the High Court be stayed. "Let the matter get listed," the Chief Justice said.
Mamata Banerjee's government had moved the top court against the High Court's order last month staying the new list of OBCs.
A division bench of Justice Tapabrata Chakraborty and Justice Rajasekhar Mantha, in an interim stay till July 31, directed that executive notifications between May 8 and June 13 with regard to OBC categories made by the state government will not be given effect to till that date.
All the parties in the matter were directed by the court to file their affidavits in the meantime on their contentions with regard to the challenge over new benchmark surveys for the purpose of inclusion under OBC categories in a PIL and the notifications.
The state government has included 49 subsections under the OBC-A and 91 under the OBC-B categories vide the executive notifications.
It has been stated that while more backward sections of people have been included under OBC-A, the less backward people come under OBC-B.
The Calcutta High Court had in May 2024 struck down the OBC status of several classes in West Bengal granted since 2010, finding such reservations to vacancies in services and posts in the state are illegal.
The court struck down 77 classes of reservation given between April 2010 and September 2010, and 37 classes were created based on the state's Reservation Act of 2012.
This order was challenged before the Supreme Court by the West Bengal government and the matter is pending there.

When asked by reporters if he would consider issuing a pardon for Maxwell, Trump replied: 'Nobody's approached me with it. Nobody's asked me about it. It's in the news about that aspect of it, but right now, it would be inappropriate to talk about it.' Trump has previously said he has the authority to issue such a pardon, without committing either way. Maxwell recently held closed-door meetings with Deputy Attorney General Todd Blanche on July 24 and 25. The nature of those discussions has not been disclosed in the Supreme Court filing, but the meetings have triggered sharp criticism from Democrats. Senators Dick Durbin and Sheldon Whitehouse have demanded the Department of Justice release transcripts and recordings of the meetings, warning that Maxwell might manipulate the situation in exchange for leniency. In a letter to Blanche, the senators said: 'Given her documented record of lying and her desire to secure early release, there are serious concerns that Ms. Maxwell may provide false information or selectively withhold information, in return for a pardon or sentence commutation.' Hisar: Devendra Budhia, 58, former president of the All-India Bishnoi Mahasabha and a controversial figure in Haryana politics, was taken into two-day police custody on Monday in connection with a rape case involving a 20-year-old woman from the Bishnoi community. The Hisar court granted the remand on a production warrant based on a petition from Bhiwani's crime branch. Budhia is accused of repeated sexual assault in Chandigarh and Jaipur. Police allege he used his influence under the pretext of helping the woman with IELTS coaching for a planned move to Australia. The state crime bureau arrested him in Jodhpur on June 29, after which he moved into judicial custody initially. The police remand will allow cops to recover the mobile phone that was used allegedly in the crime and to conduct crime scene identification. The district court, Punjab and Haryana high court, as well as the Supreme Court had rejected Budhia's earlier pleas for anticipatory bail. The FIR (first-information report), which Hisar police had filed on Jan 25, suggests that Budhia lured the woman with false promises of academic support, took her to different cities, and raped her repeatedly. She also alleged that he issued death threats to silence her. Legal twist: Remand under new law An earlier attempt by police to seek Budhia's remand on July 14 was rejected by the judicial magistrate, citing procedural limits under the Indian Penal Code (IPC) and Code of Criminal Procedure (CrPC), which do not allow police remand after 15 days of judicial custody. However, the police challenged that decision successfully, arguing that since the FIR was registered after July 1, 2024, the case falls under the Bharatiya Nagarik Suraksha Sanhita (BNSS), which replaced key sections of the CrPC. The district court accepted the argument and approved the two-day custody. Bhopal: In Madhya Pradesh, the weight of unemployment is heaviest among Other Backward Classes (OBCs), who form the largest group of job-seekers in the state. Of the over 25 lakh youth registered on the state's employment portal, more than 10.46 lakh belong to the OBC category, by far the highest among all social groups. This includes 5.73 lakh men and 4.72 lakh women. The startling data, revealed in response to Assembly questions raised by Congress MLAs Atif Aqeel and Sanjay Uikey, paints a bleak picture of youth employment in Madhya Pradesh. Despite the government's claim of a marginal 0.56% drop in the number of unemployed, equivalent to 48,624 fewer registrations compared to seven months ago. The government now refers to the unemployed as "Aspiring Youth," a cosmetic change in nomenclature that offers little solace to those struggling to find work. The total number of such 'aspiring' individuals is a staggering 25,68,321. Even more telling is the category-wise breakdown: 4.69 lakh Scheduled Castes (SC), 4.18 lakh Scheduled Tribes (ST), and 6.34 lakh from the General category, with OBC youth topping the list. Gender-wise, the burden is equally shared - 13.91 lakh men and 11.76 lakh women make up this massive queue of unfulfilled aspirations. While Sagar district tops the list of unemployed youth, Pandhurna finds itself at the bottom. In 21 districts, more than 50,000 unemployed youth are registered, while in 34 districts, the number is below that mark.
