Losing candidates in Cities of Cebu, Mandaue file election protest

The former mayors of Cebu City and Mandaue City filed respectively an election protest against their opponents in #Eleksyon2025.
Former Mandaue City mayor Jonas Cortes questioned an alleged suspicious glitch during the vote counting that affected purportedly the result.
At the COMELEC office in Manila, Cortes' legal team filed formally the election protest on Friday, May 23, 2025.
His camp underscored that there were questionable situations during the tallying of election results that need clarification.
"Duha na ato gi-allege, intrinsic fraud, meaning naa sa program o software mismo nga maoy naka-cause sa irregularity sa results ug ang extrinsic fraud, ang process sa voting itself no, daghan pod to og nagkalain-laing instances nga na-cite na," said Atty. Jamaal Calipayan, Mandaue City administrator.
Cortes' camp has stood by their claims based on affidavits from watchers and lawyers, they said, that would support the allegations.
'Ang ato gi-kwestyon lang pod, sama sa statement ni mayor of course we need an explanation from kung kinsa ang responsible parties ini, aron ma-avoid siya in the future,' Calipayan added.
In a statement on his official social media account, Cortes said that the protest has nothing to do with bitterness but about protecting people's votes.
'This is not about bitterness, this is not against our opponents who were declared winners. This is about protecting your vote, our vote. Daghang panghitabo niining piniliay, gikinahanglang hatagan og atensyon,' his statement reads.
Cebu 6th District Provincial Board Member Jonkie Ouano has been declared winner in the mayoral race in Mandaue City.
When GMA Regional TV Balitang Bisdak sought a comment from Ouano about Cortes' election protest, he said that the action is Cortes' prerogative.
Ouano further said he has delegated to his legal team the task of responding to accusations, as he is focused tightly on the local governance transition and priorities leading to his assumption of office.
Moreover, former Cebu City mayor Michael Rama also filed an election protest in Manila.
He used as basis the alleged glitches in the automated counting machines (ACMs) that he said could have possibly influenced the vote count.
According to Cebu City Mayor-elect Nestor Archival, it is Rama's right to raise a complaint, or a protest.
As for outgoing Mayor Raymond Alvin Garcia, he said it is best to accept defeat and focus on working with the new administration to be more of service to the community.

The Commission on Elections (Comelec) is set to proclaim Bagong Henerasyon (BH) party-list next week following the junking of the petition for disqualification filed against the group and its nominees. This developed after the poll body en banc issued a certificate of finality and entry of judgment on the disqualification case Thursday, saying it did not receive a restraining order on its decision that upheld the dismissal of the petition. ''Yun ay order certifying na final na ang decision ng en banc at ang tinatawag na entry of judgment. Ibig sabihin, wala kaming nakuha na restraining order mula sa Kataastaasang Hukuman,' poll chief George Erwin Garcia told reporters. (We issued that order certifying the en banc decision and entry of judgment is now final. This is because we did not receive any restraining order from the Supreme Court.) 'Hindi kami informed kung may finile na kaso and at this point, ang decision ng en banc ay executory. Asahan po ng lahat na we will be proclaiming BH any moment from now at kinakailangan na maibigay namin sa kanila ang tinatawag na of certificate of proclamation,' he said. (We were not informed if any case was filed and at this point, the decision is now executory. The public may expect BH partylist to be proclaimed at any moment as we need to issue a certificate of proclamation to them.) According to Comelec Resolution No. 9523 in relation to Section 13(b), Rule 18 and Section 3, Rule 37 of the 1993 Comelec Rules of Procedures, a decision or a resolution of the Comelec en Banc on special actions will be final and executory after five days upon the receipt of the said decision and resolution except if the Supreme Court (SC) issues a temporary restraining order or preliminary injunction. The Comelec en banc last week rejected a motion for reconsideration filed by petitioner Russel Stanley Geronimo and affirmed a May 22 decision of the Comelec First Division that rejected the disqualification case due to a procedural defect. Garcia said the partylist may be proclaimed at the Comelec office in Intramuros, Manila next week. The Commission on Elections (Comelec) on Wednesday reminded Eleksyon 2025 candidates of the deadline for the filing of the Statements of Contributions and Expenditures (SOCEs). In an advisory, the poll body said the local and national candidates only have seven days, or until June 11, 2025, to file their SOCEs. 'Seven days left before the last day to file SOCE…The submission must be made during weekdays, including Saturdays and holidays, from 8 a.m. to 5 p.m.,' it said. National candidates and party-list groups may lodge their SOCEs before the Comelec Political Finance and Affairs Department (PFAD) in Intramuros, Manila while local bets may submit their SOCEs at the local Comelec office where they filed their Certificate of Candidacy (COC). Local parties may lodge their SOCEs at the local poll body office where the party has constituency based on its registration and accreditation. Under Section 14 of Republic Act 7166 or the Synchronized Elections Act, every candidate or treasurer of a political party shall file in duplicate with the offices of the Comelec the 'full, true and itemized statement of all contributions and expenditures in connection with the election' within 30 days after the elections. Candidates who will not file SOCEs will be charged with an administrative offense and will be liable to pay a fine ranging from P1,000 to P30,000.00 at the discretion of the poll body, with the exemption of aspirants in the barangay level. For winning bets or political parties, failure to comply may also withhold their assumption of office. Section 13 of RA 7166 provides the limitation of authorized expenses of candidates and political parties. It states that candidates vying for presidency and vice-presidency shall spend P10 for every voter currently registered in the constituency where he filed his certificate of candidacy. Aspirants with political parties will be allowed to spend P3 for every voter while independent candidates will be allowed up to P5. CA panel suspends appointment hearing of 2 Comelec commissioners

A panel of the Commission on Appointments (CA) suspended Wednesday the consideration of the ad-interim appointments of Commission on Elections Commissioners Ma. Norina Tangaro-Casingal and Noli Pipo due to lack of material time. Camarines Sur Representative LRay Villafuerte raised the motion to suspend the appointment hearing. It was seconded by Senator Risa Hontiveros. 'On motion of the minority floor leader, duly seconded, there being no objection, the Committee on Constitutional Commission and Offices hereby suspend the consideration of the ad-interim appointment of Ms. Ma. Norina Tangaro-Casingal,' said Senator Cynthia Villar, CA committee chairperson, said. 'It will be resumed on June 10, 2025 at 11 a.m. The same goes to Mr. Noli Rafol Pipo,' she said. Tangaro-Casingal faced the CA amid several oppositions on the confirmation of her and Pipo's appointment as Comelec commissioners, including a complaint letter filed by Ronald Cardema, chairperson of Duterte Youth, to the Office of Senate President Francis Escudero. During the hearing, Cardema reiterated the party-list's 'strongest opposition' to the confirmation of the two commissioners as he accused them of impartiality when they agreed to suspend the proclamation of Duterte Youth over their pending cases. He cited other Eleksyon 2025 candidates who were marred with similar issues. 'We would like to convey our strongest opposition to these two temporary government officials in the Comelec,' he said. 'The character of these two has been tested three weeks ago and clearly, they have failed in this test. They have twisted the results of the democracy and the sovereign will of more than 2.3 million Filipinos,' Cardema added. The CA panel also noted the sworn opposition filed by Rogelio Rabanal, and Dr. Felipe Montealco Jr. Senator Aquilino Pimentel III also wrote to Escudero's office, seeking the postponement of the CA hearing for the ad-interim appointment of the two commissioners. In February, President Ferdinand Marcos Jr. named Tangaro-Casingal as the new Comelec commissioner, replacing ex-commissioner Socorro Inting, who retired after completing her seven-year term. Tangaro-Casingal was director of the Comelec Law Department since 2016. She was an election lawyer who served in the Comelec for 27 years. Marcos Jr. also appointed Pipo to succeed ex-Commissioner Marlon Casquejo. Pipo has been serving at the Comelec for 32 years. He started as an election officer in Bangued, Abra, in 1993 before climbing the ranks and acting as regional election director since 2006. Meanwhile, the CA committee approved in the plenary the appointment of Civil Service Commission (CSC) Commissioner Luis Pangulayan, and Commission on Audit (COA) Commissioner Douglas Michael Mallillin. — RSJ, GMA Integrated News
