
Sarawak High Court rejects Petronas bid to delay Petros suit

By: FMT Reporters Text Size: PETALING JAYA: The Sarawak High Court has dismissed two applications filed by national oil company Petronas to postpone or stay the hearing of a suit brought by Petroleum Sarawak Bhd, the state's sole gas aggregator. Judicial commissioner Faridz Gohim Abdullah rejected the applications and confirmed that the case will be heard on June 11, the Dayak Daily reported.
Advertisement Faridz ruled that no special circumstances had been presented to justify a stay or adjournment. 'The hearing of the case should not be further delayed,' he was quoted as saying. Petros is suing to restrain Petronas from utilising funds of RM7.95 million received under a bank guarantee previously given by Petros in respect of the supply of gas. Petros contends that Petronas's demand for payment under the bank guarantee was 'unconscionable' or 'unlawful'. In April, Faridz dismissed an application by Petronas to suspend all legal proceedings on grounds that Petronas had failed to show the existence of any sufficiently exceptional or compelling grounds to stay the proceedings. In October last year, Petronas had called on the bank guarantee after demanding payment of RM28,136,403.08 from Petros for gas supplied. Petros filed its suit against Petronas on Oct 15, 2024. The Sarawak state-owned oil company simultaneously sought an ex-parte interim injunction to restrain Petronas from pursuing the payment and receiving monies under the bank guarantee. Govt has no plans for single REE entity to regulate industry
KUALA LUMPUR: The government has no plans to establish a single entity akin to Petronas to regulate the rare earth elements (REE) industry for now, says Datuk Seri Johari Ghani. The acting natural resources and environmental sustainability minister said that during past discussions and stakeholder engagements, several states expressed objections to such a move. "They viewed the proposal as an attempt at the nationalisation of mineral resources that belong to the states. "As is well known, the management of petroleum resources beyond state waters is different from the management of land matters, which falls under state jurisdiction. "This is clearly stated in the Federal Constitution, Ninth Schedule, List II (State List), which provides that the states have jurisdiction over permits and licences for prospecting, mining leases, mining, and mining certificates," he said in his winding-up speech for the 13th Malaysia Plan. This comes after proposals by several members of parliament for the government to establish a regulatory agency, similar to Petronas, through the enactment of an REE Act to drive the development of the REE industry. Johari assured that the Federal Government fully respects state jurisdiction over land and mineral matters, as enshrined in the Federal Constitution. Accordingly, he said the government has formulated a clear long-term plan to develop the rare earth elements industry holistically, in line with the direction endorsed by the National Economic Action Council. "Any policies or mechanisms on REE revenue distribution will be formulated and decided inclusively through the National Mineral Council, which serves as the main platform for engagement and coordination between the federal and producing state governments. "This planning is based on the principle of close cooperation between the federal and state governments, to ensure that every initiative for the development of the REE industry takes into account state rights and jurisdiction as provided under the Constitution," he said. Malaysia, he said, is also still in discussions with China on technology transfer of REE to Malaysia. "We want to first see what they are doing. We will also conduct our own research, and only then sit down to decide what technologies we want to adopt. "We cannot depend solely on China, as Russia also has expertise, although they have not approached us. China, on the other hand, has offered, and they want to prove themselves to us. We will assess the outcomes and then discuss further," he said. When asked why the proof-of-concept phase in Kenering, Perak is taking up to five years, Johari clarified that big-scale mining usually takes more time to assess, especially on its impact towards the environment. He said he would visit the site soon to get updates from the scientists. He also clarified that Malaysia has never offered the export of raw REE as a concession or condition for tariff reduction in trade tariff negotiations with the United States. This also comes after several queries from MPs to the government about negotiations with the United States involving REE, given that the raw export ban is still in force. Trident Acquires 30 Pct Stake In Tongxin's Web 3.0 E-commerce Platform On Telegram
BUSINESS KUALA LUMPUR, Aug 19 (Bernama) -- Trident Digital Tech Holdings Ltd (Trident), a Singapore-based digital transformation company, has signed a sales and purchase agreement to acquire a 30 per cent equity stake in Tongxin Innovation Ltd (Tongxin). The transaction, valued at about US$3 million, will be executed through the issuance of Trident's American Depositary Shares (ADSs) in the form of Class B ordinary shares to Tongxin's shareholders. (US$1=RM4.21) The deal values Tongxin, which operates the ToMe Web 3.0 e-commerce platform on Telegram, at approximately US$10 million. In a statement, Trident said the strategic investment expands its Web 3.0 ecosystem and underscores its commitment to blockchain-enabled e-commerce solutions. Trident Founder, Chairman and Chief Executive Officer, Soon Huat Lim said the acquisition aligns with the company's mission to become a global leader in Web 3.0 enablement. He said the integration of ToMe's Web 3.0 commerce capabilities with Tridentity will enhance user experience and accelerate blockchain adoption in mainstream commerce. Tongxin's ToMe platform is built on Telegram, which has more than one billion users, and is designed to address e-commerce challenges through its '4F' value proposition, which is Fair, Fast, Friendly and Free. RM366 million project sets Kinabatangan on urban transformation path

KINABATANGAN: Pekan Kota Kinabatangan is poised for urban transformation under the Sabah Maju Jaya (SMJ) development plan, with the ground-breaking of a major RM366 million mixed-development project. The Seri Milian new township project was officially launched recently by Chief Minister Datuk Seri Hajiji Noor at the Pekan Kota Kinabatangan Dataran Terminal Terbuka, marking a new chapter in economic growth and sustainable development for Sabah's East Coast. Advertisement Sabah Housing and Urban Development Board (LPPB) Chairman Datuk Masiung Banah said the 154.48-acre development, implemented through a strategic partnership between Sunmow Construction Sdn Bhd and Kinabatangan District Council, will serve as an economic catalyst for residents, particularly in the Lamag area. The project will be executed in three phases over 15 years and will feature a 13-storey, four-star hotel with 200 rooms to capitalise on Kinabatangan's tourism potential. The new township will also include a tourism information centre, commercial hub, sports complex, public housing, district council building, mosque, petrol station and food court.
