Trial of Fahmi's defamation suits against Papagomo, 2 others to begin Oct 2

Communications minister Fahmi Fadzil said the statements were baseless, and that the Selangor Islamic Religious Council confirmed that he had not made any political speech as alleged by the defendants.
KUALA LUMPUR : The trial of communications minister Fahmi Fadzil's defamation suits against three individuals, including blogger Papagomo whose real name is Wan Azri Wan Deris, will begin on Oct 2 at the High Court here.
Fahmi filed the suits separately against Wan Azri, freelance preacher Ahmad Dusuki Abd Rani, and Facebook account holder Fauzan Madzlan on Sept 5, 2023 over allegations that Fahmi, the Lembah Pantai MP, misused a place of worship by giving a political speech at a mosque in Rawang, Selangor.
Lawyer Asheeq Ali Sethi Alivi, representing Fahmi, told reporters after proceedings today that Justice Roz Mawar Rozain had allowed his client's application for his lawsuits against the three defendants to be heard together.
'The court then set the dates for the trial on Oct 2 and 3,' he said.
Today's proceeding was also attended by lawyer Zamri Ibrahim, representing Fauzan.
According to his statement of claim, Fahmi alleged that the three defendants, Wan Azri, Dusuki and Fauzan, published defamatory statements accusing him of misusing the mosque for election campaigning purposes and acting contrary to the decrees and orders of the Sultan of Selangor.
Fahmi claimed that the statements were published on Fauzan's Facebook account, 'N13 Kuang', as well as Dusuki's Facebook and Instagram accounts on July 31, 2023, and on Wan Azri's TikTok and Facebook accounts on Aug 1, the same year.
He said the statements were baseless, and that the Selangor Islamic Religious Council confirmed that he had not made any political speech as alleged by the defendants.
Fahmi is seeking general, aggravated, or exemplary damages and an injunction to prevent the defendants from repeating or causing the republication of the statements in question.

Comprehensive, people-centric facilities at heart of Kota MADANI

KUALA LUMPUR: The Kota MADANI concept emphasises comprehensive and centralised basic facilities for the well-being of the people, said Prime Minister Datuk Seri Anwar Ibrahim. Anwar said that during the presentation of the concept today, he was informed that among the planned facilities are high-rise schools, Technical and Vocational Education and Training (TVET) institutions, and financial institutions. 'In addition, a health clinic, fire station, police station and mosque will all be developed near residential areas. 'The first phase, which involves the construction of around 3,000 housing units and a high-rise school, is expected to be completed and fully operational by the end of 2027,' he said in a Facebook post today. The Prime Minister added that the design of the mosque and school would incorporate elements of local culture, in line with efforts to preserve architectural heritage. 'May all these plans proceed smoothly and be implemented in the best possible manner for the benefit of all,' he said.

Social media regulation: Fahmi ready to hold further discussions

KUALA LUMPUR: Communications Minister Datuk Fahmi Fadzil has expressed his readiness to hold further discussions with Minister in the Prime Minister's Department (Law and Institutional Reform), Datuk Seri Azalina Othman Said, to strengthen the regulation of social media platforms in Malaysia. Fahmi said the meeting is vital following Azalina's recent proposal to amend existing laws, including requiring parents and guardians to monitor their children's online behaviour and participate in digital safety awareness and education programmes. He said that these measures will take into account the experience and approaches of the Malaysian Communications and Multimedia Commission (MCMC) and the Ministry of Communications in handling various issues related to digital platforms and social media in the country. 'I will be meeting Datuk Seri Azalina to explore possible ways, based on MCMC's and the Ministry's experience dealing with social media platforms, on what we can do,' Fahmi told reporters after the HAWANA 2025-Bernama Strategic Partners' Appreciation Ceremony and Official Launch of BERNAMA Motorhome at Wisma Bernama here today. Present were Communications Ministry secretary-general Datuk Mohamad Fauzi Md Isa, as well as Malaysian National News Agency (Bernama) chief executive officer Datin Paduka Nur-ul Afida Kamaludin and editor-in-chief Arul Rajoo Durar Raj, who is also HAWANA 2025 project director. Elaborating, Fahmi said that the Online Safety Act (OnSA) 2024, which is set to be enforced soon, will grant MCMC the authority to take action against social media platforms that fail to fulfil their obligations. 'So, we will look at the best ways to assist the Law Minister in the implementation and drafting of the legislation she mentioned,' he added.

PM immunity: High Court to rule on legal questions referral tomorrow

KUALA LUMPUR: The High Court here has set Wednesday (June 4) for its decision on an application by Datuk Seri Anwar Ibrahim to refer eight legal questions to the Federal Court, including whether a Prime Minister enjoys immunity from lawsuits. The legal questions relate to a lawsuit filed by Anwar's former research assistant, Muhammed Yusoff Rawther, concerning an alleged sexual assault seven years ago. Judge Roz Mawar Rozain fixed the date on Tuesday (June 3) after hearing submissions from lawyer Alan Wong Teck Wei, representing Anwar, and lawyer Muhammad Rafique Rashid Ali, acting for Yusoff, during in-chamber proceedings. Anwar filed the application on May 23, seeking to have the High Court, which is hearing the suit, refer the eight legal questions to the Federal Court. The eight legal questions include whether, under Articles 39, 40 and 43 of the Federal Constitution, a sitting Prime Minister enjoys limited immunity from lawsuits concerning allegations of personal conduct that occurred before his appointment. According to a supporting affidavit for the application, lawyer Datuk Megat Abdul Munir Megat Abdullah Rafaie, who is authorised to represent the defendant (Anwar), said that if the suit were to proceed, it would affect Anwar's ability to effectively perform his executive functions and undermine the doctrine of separation of powers enshrined in the Constitution. "The plaintiff's (Yusoff's) claim is politically motivated and, if not examined constitutionally at an early stage, could erode public confidence, diminish the dignity of the constitutional office, and disrupt the executive's ability to perform its constitutional duties," Megat Abdul Munir said in the affidavit. Megat Abdul Munir further stated that if the court intends to refer these constitutional questions to the Federal Court as a special case, it would be appropriate for the suit's proceedings to be stayed pending the Federal Court's determination of these questions. Yusoff filed the suit on July 14, 2021, and Anwar, in his statement of defence, contended that Yusoff had lied under oath to the authorities regarding the alleged sexual assault incident. The PKR president, who filed a counterclaim on Sept 28, 2021, alleged that Yusoff had fabricated the story about the sexual assault to tarnish his political career and prevent him from becoming prime minister. The High Court last year set June 16 to 19 and June 23 to 25, 2025, for the hearing of the lawsuit.- Bernama
