Mumbai: The Maharashtra State Legal Services Authority (MSLSA) has told Bombay high court that family courts have not referred a single case to it for providing legal services to any child.
"Till date, not a single case concerning custody, guardianship, or maintenance has been referred to the legal services units for children (LSCUs) by the family courts for providing legal services to a child under the scheme," stated its reply to a PIL that seeks appointment of independent lawyers for children in custody battles between their parents.
Petitioner advocate Shraddha Dalvi urged framing of guidelines for a child legal assistance programme in Maharashtra in custody and related litigation and in Protection of Children from Sexual Offences (Pocso) Act cases.
She sought appointment of lawyers under the Legal Services Authorities Act, which entitles a child to free legal aid.
MSLSA's Mar 23 reply stated that National Legal Services Authority's legal services for children scheme came into operation in Sept 2024. In Nov legal services units for children were constituted in every district, and their members were trained. The district legal services authorities conducted awareness and outreach programmes in schools, colleges, villages, and other places.

It then informed that family courts have not referred cases for providing children with legal services.
"If a child in need of legal services concerning custody, guardianship, or maintenance is referred to the LSCUs by the family court, the child will be provided with necessary legal services," MSLSA assured.
The Women and Child Development Department's Apr 23 reply stated that as per the Pocso Act, a May 2015 govt resolution issued guidelines for a child to take assistance from experts in the pre-trial and trial stages.
It referred to a section that entitles the family or guardian of a child to take assistance from a legal counsel of their choice and provides that if they are unable to afford one, "Legal Services Authority shall provide a lawyer to them".
Dalvi's petition, filed through advocate Ashley Cusher, said children are "silent sufferers" and the "most unheard and unrepresented parties in matrimonial proceedings". Every year, over 2 lakh matrimonial dispute cases are filed in family courts in India. In the Mumbai FC, over 10,000 cases are filed annually. In custody cases where allegations like Pocso against male relatives arise, "children become ultimate victims, enduring severe mental anguish, especially when subjected to sexual assault or manipulated into making false accusations".
Independent lawyers "will help the child to express his wish or concern without bias or prejudice and guide them to take a balanced decision".

Speaking at the District Task Force Committee meeting held on this occasion, the Collector said that as part of the Anti-Child Labour Month, officials from the Labour, Police, voluntary organisations, and the Revenue department should conduct special drive inspections to identify child labourers until June 30. He emphasised that employing children less than 14 years of age and adolescents between 14 and 18 years in hazardous work is a crime, according to the Child and Adolescent Labour (Prohibition and Regulation) Act. He urged for public awareness campaigns about child laws. Collector Lakshmisha stated that if anyone identifies children or adolescents working as child labourers, they should inform the toll-free numbers: 100, 1098, and 1800 102 7222. The wall poster unveiling event was attended by Deputy Labour Commissioner Ch Asharani, ICDS PD D Srilakshmi, District Child Protection Officer M Rajeshwara Rao, Dr B Keerthi, secretary of Vasavya Mahila Mandali, CRAF representative Prabhakar, Forum for Child Rights member A Ramesh, and Assistant Labour Officers.

COIMBATORE: A special court for cases under the Tamil Nadu Protection of Interests of Depositors (TNPID) Act in Coimbatore on Friday sentenced the managing director of an emu farming company to 10 years of rigorous imprisonment for defrauding 385 investors to the tune of Rs 7.61 crore. The convict, MS Guru alias Gurusamy (46), was the managing director of Susi Emu Farms India Private Limited, headquartered at Perundurai in Erode district. He resided at Sakthi Nagar in Kunnathur, Perundurai. Special Judge M N Senthil Kumar handed down the sentence to Guru following a decade-long trial. In addition to the prison term, the court imposed a fine of Rs 7, 89,25,000 on the company and its director, of which Rs 7.89 crore is to be proportionately distributed among the duped investors, according to Special Public Prosecutor K Muthu Vijayan. The case dates back to 2012 when the Economic Offences Wing (EOW) in Salem district registered an FIR against the company and its MD. Investigations revealed that Gurusamy had launched the firm in 2010, operating out of Raja Street in Perundurai, and promoted fraudulent investment schemes under the guise of emu farming.

ICICI employee swindles over 4.5cr from Kota city branch, arrested KOTA: In a major bank fraud, a relationship manager of ICICI Bank, Sakshi Gupta, has allegedly siphoned off Rs 4.58 crore from customer accounts in Kota city. The accused worked at Shriram Nagar branch of DCM area in Kota and committed the fraud during the 2020-23 period. She was arrested by the Udhyog Nagar police on May 31 following investigation. The crime first came to light on Feb 18, following which the branch manager lodged a complaint with the police. According to police, for around two-and-a-half years, Sakshi withdrew funds fraudulently from over 100 accounts of 41 customers. She purportedly invested the money in the stock market, but suffered heavy losses. To prevent customers from noticing, she changed the mobile numbers linked to several accounts to numbers belonging to her relatives, ensuring that transaction alerts and OTPs were not received by the real account holders. Bank manager Tarun Dadhich subsequently filed a complaint against her. According to Udhyog Nagar police station SI Ibrahim, the fraud was first reported on Feb 18. From 2020 to 2023, Sakshi had systematically transferred funds from various customer accounts, in some cases using an elderly woman's account, who was unaware of the activity, as a 'pool account'. She had transferred over Rs 3 crore into this account. In addition, a fraudulent personal loan for Rs 3.4 lakh was disbursed. Many transactions were conducted through insta kiosks and various digital banking platforms, with the accused using debit cards of four customers for ATM and internet banking activity. Funds from these frauds were also sent to Demat accounts as part of an attempted cover-up, police said. A statement issued by the ICICI Bank said, "The interest of our customers are of paramount importance to us. Immediately upon discovering the fraudulent activity, we filed an FIR with the police. We have a zero-tolerance policy against any fraudulent activity and thus suspended the employee involved. We would like to reassure that genuine claims of impacted customers have been settled."
