Kota Kinabalu: A 33-year-old Vietnamese woman was jailed three months by the Magistrate's Court here Thursday for soliciting for the purpose of prostitution. Thi Hong Dang, 33, pleaded guilty before Magistrate Wan Farrah Fariza Wan Ghazali after the charge was read to her by a Vietnamese interpreter. Thi was found committing the offence at 10pm on June 19, this year, at a reflexology centre in the city. This was charged under Section 372B of the Penal Code, which carries a punishment of up to one year's imprisonment, a fine, or both, on conviction. Deputy Public Prosecutor (DPP) Akaash Singh informed the court that on the night of the incident, a police team raided the premises and found a woman, later identified as Thi, naked with a male customer inside a room. The customer told police that he had paid RM350 at the front counter in exchange for sexual services from Thi, the court heard. Thi, who was not represented, requested a lower fine, telling the court that she is married with three children. She also applied to contact her family, as she had not been in touch with them since her arrest and wished to inform them so she could ask for money to pay the fine. Akaash informed the court that Thi had no previous convictions but urged for a deterrent sentence. He also applied for her to be referred to the Immigration Department, noting that while her passport is still valid, her visa had already expired. The court ordered Thi to serve the sentence from the date of her arrest and be referred to the Immigration Department thereafter. Meanwhile, a 35-year-old man was tentatively charged with trafficking 55gm of 3,4 Methylenedioxymethamphetamine (MDMA). No plea was recorded from Hiew Vui Shung after the charge was read out to him. Hiew, a trader, was accused of committing the offence at 10.45pm on June 27, this year, in front of the Ski Hotel's lobby here. The charge is framed under Section 39B(1)(a) of the Dangerous Drugs Act 1952, which carries a punishment of either the death penalty or life in prison and whipping with a minimum of 15 strokes. The court fixed Aug 19 for mention pending the chemist's report. Hiew, who appeared before Magistrate Marilyn Kelvin, was ordered remanded further pending the date as the charge against him has no provision for bail. In another case, a woman was fined RM1,600, or jailed one month for operating an illegal public lottery gambling activity known as Wah Hui. Silma Abdul admitted to committing the offence on May 15, this year, at 12 noon, in a premises at Sinsuran here. The facts of the case presented by the prosecution stated that the police, who raided the area, found Silma committing the offence and seized gambling paraphernalia, including RM210 in cash from her. Silma was charged under Section 9(1) of the Common Gaming Houses Act 1953, which provides for a fine of up to RM5,000, or up to six months' jail', or both, on conviction. The court ordered the seized money to be forfeited as government revenue. JOHOR BARU: The Malaysian Immigration Department detained 27 foreign workers without valid permits in Op Selera at a food premises in Bandar Baru Permas Jaya here on Monday. Johor Immigration director Datuk Mohd Rusdi Mohd Darus said the integrated operation, involving 25 officers from the department's enforcement division, was conducted as a result of intelligence and public information regarding their activities at the premises. He said the arrests involved eight Indonesian men and eight women, five Myanmar men and six women aged between 18 and 50. "All of them are suspected of committing offences under Section 6(1)(c) and Section 15(1)(c) of the Immigration Act 1959/63 and the Immigration Regulations 1963 as well as Regulation 11(7)(a) of the Immigration Regulations 1963. "Meanwhile, a local man who is the owner of the premises was also detained under Section 56(1)(d) of the Immigration Act 1959/63 for harbouring foreigners," he said in a statement tonight. Mohd Rusdi said all the detainees were placed at the Setia Tropika Immigration Depot for investigation and further action, in addition to being issued three notices to appear at the Immigration Department to assist in the ongoing investigation. "At the same time, we would like to remind the public and employers not to harbour or employ illegal immigrants to work as legal action would be taken against them. "Therefore, employers are advised to contact the nearest immigration office directly to obtain accurate (and authentic) information if there is a party claiming to be able to manage foreign workers," he added. – Bernama

KUALA LUMPUR, Aug 6 (Bernama) -- The Royal Malaysia Police (PDRM) is urging all parties to stop any action of uploading or sharing unverified information related to the death of Form One student Zara Qairina Mahathir. Inspector-General of Police Datuk Seri Mohd Khalid Ismail said police have detected the spread of information and a child's pictures linked to the Zara Qairina case by irresponsible parties on social media. He stated that the shared information is inaccurate and has the potential to confuse the public, besides potentially affecting the ongoing investigation and hindering the process of justice for all involved. "The entire investigation process for the case, including the post-mortem issue, is being conducted according to existing procedures and legal provisions, and all parties are advised to stop any action of uploading or sharing unverified information, including disclosing information related to the case investigation," he said in a statement tonight. Mohd Khalid said the act of disclosing information related to the case can be investigated under Section 15 of the Child Act 2001, which involves a prohibition on revealing the identity, address, school name, and pictures of the child involved, as well as Section 203A of the Penal Code for offenses related to the disclosure of information. "The individuals involved can also be investigated under Section 233 of the Communications and Multimedia Act 1998 for improper use of a network facility or network service. Adherence to the law is the basis of national peace and well-being. Any violation will be met with firm action in accordance with existing provisions," he said. Zara Qairina, 13, was confirmed to have died at Queen Elizabeth I Hospital in Kota Kinabalu, Sabah on July 17. The student was taken to the hospital after being found unconscious in a drain near the dormitory of a religious school in Papar at 4 am on July 16. The investigation into the case is currently being finalised by the police after being returned by the Attorney-General's Chambers yesterday.

KUALA LUMPUR: A 34-year-old foreigner will be charged with murder tomorrow over the stabbing death of his housemate at a shoplot residence in Bandar Sentosa, Klang, last month. Klang Selatan deputy police chief Superintendent Kamalariffin Aman Shah said the man will be charged under Section 302 of the Penal Code which carries the death penalty or a jail term of up to 30 years upon conviction. He said the victim, a 28-year-old foreigner, was stabbed in the body and neck during a quarrel with the suspect while drinking alcohol at the premises on July 20. "At the time of the incident, there were seven men and two women, all foreigners, at the residence. "A misunderstanding between the suspect and the victim escalated into a verbal argument before the suspect stabbed the victim, causing his death. "Six men who were present later buried the victim's body in a landfill site about 1km from the house," he said in a statement. Police later arrested five men and two women, aged between 20 and 34, to assist investigations. "The body of the victim and the knife used in the killing were later recovered," he said. Kamalariffin added that five of the male suspects will also be charged under Section 201 of the Penal Code for concealing a body, which carries a maximum prison sentence of seven years. He added that all the suspects will face an additional charge under Section 6(1)(c) of the Immigration Act 1959/63 for not possessing valid travel documents. "All charges will be heard at the Klang Court tomorrow," he said.
