
"XXX vs Union Of India": Top Court To Hear Justice Varma's Challenge Today
Justice Yashwant Varma, who has approached the Supreme Court after its three-member panel recommended his removal, has kept his identity a secret while filing the petition. The Allahabad High Court judge, who made headlines after a massive cash recovery at his Delhi home after a fire, is referred to as "XXX" in the court documents.
The bench of Justice Dipankar Datta and Justice Augustine George Masih will today hear Justice Varma's petition, which challenges the findings of the three-member panel.
Following the huge cash recovery from his Delhi home, Justice Varma was transferred to the Allahabad High Court from his earlier posting in the Delhi High Court. The then Chief Justice Sanjiv Khanna formed a three-judge panel to investigate the matter. Following the panel's report, the then Chief Justice recommended Justice Varma's removal.
In his challenge to the action against him, the judge has said he was not at his Delhi home when the cash was discovered. He said the top court panel probing the matter did not hear him. The judge has said that the Supreme Court's recommendation for his removal based on the panel's report "usurps parliamentary authority to the extent that it empowers the judiciary to recommend or opine on the removal of Judges from constitutionally held office".
"This violates the doctrine of separation of powers, which is part of the basic structure of the Constitution, as the judiciary cannot assume the role reserved for the legislature in the removal of judges," it says.
Justice Varma has said the top court's in-house procedure to probe the matter was "improper and invalid" because there was no formal complaint against him. The judge has also flagged the top court's "unprecedented public disclosure of these unverified allegations via press release" and said it had subjected him to "media trial, resulting in irreparable damage to his personal reputation and career as a judicial officer". The proceedings, he said, had "violated natural justice, reasonableness and fairness under Article 14".
"The Committee failed to notify the Petitioner of its devised procedure, denied him any opportunity to provide inputs on the evidence to be collected, examined witnesses in his absence and provided him with paraphrased statements instead of video recordings (despite availability), selectively disclosed only 'incriminating' material, ignored and failed to collect relevant and exculpatory evidence like CCTV footage (despite Petitioner's requests), denied opportunities of personal hearing, did not put any specific/tentative case to the Petitioner, impermissibly reversed the burden of proof without notice to the Petitioner, and effectively hindered any effective defence by the Petitioner," the judge has said in his petition.
Justice Varma has said he had been asked to resign or seek voluntary retirement within an "unduly restricted timeline", failing which he was informed that action to initiate his "removal" would be initiated.
The judge's counsel filed an application seeking permission to file the petition without disclosing his identity, Supreme Court records show.

SC seeks Centre, BCI response on PIL for four-year LLB course like B.Tech
The Supreme Court on Tuesday sought the response of the Centre, University Grants Commission and Bar Council of India on a PIL seeking a direction for setting up a legal education commission to review the syllabus, curriculum and duration of the LLB and LLM courses . A bench of Justices Surya Kant and Joymalya Bagchi sought the response of the Centre, UGC, BCI and Law Commission of India on the petition by September 9. The top court directed the registry to list all the pending matters on the issue together on September 9. The PIL filed by Ashwini Kumar Upadhyay urged the top court to direct to the Centre to set up a legal education commission or expert committee to review the syllabus, curriculum and duration of the LLB and LLM Courses and take appropriate steps to attract the best talent in the legal profession. The plea further said, " New Education Policy 2020 promotes four-year graduation courses in all professional and academic courses, but BCI has not taken appropriate steps to review the existing syllabus, curriculum and the duration of the LLB and LLM courses". Live Events It said the injury caused to the students is extremely large because the five-year duration of BA-LLB and BBA-LLB courses is disproportionate to the course material. "The long period puts excessive financial burden on the middle and lower-class families and they are unable to bear such a heavy financial burden. It takes two more years for a student to become the bread-earner in his family," the plea said. "B. Tech through IITs takes four years of non-superfluous education and that too in a specified field of engineering, whereas BA-LLB or BBА-LLB through the NLU's and various other affiliated colleges consumes five years of a student's precious life while providing knowledge of Arts /Commerce, an unrelated and superfluous stream. Hence, the existing five-year course needs to be reviewed by the experts," it said.

Man gets twin life sentence in double murder case
Kollam (Ker), Jul 29 (PTI) A court here on Tuesday sentenced a 38-year-old man to double life imprisonment for murdering a man and a woman at their residence in Punalur in this district in 2023. Kollam First Additional Sessions Judge P N Vinod, in his order, also imposed a fine of Rs one lakh each for the two murders on Sankar, the convict. Though separate life sentences were awarded for the two murders, they will run concurrently as per the Supreme Court judgement in this regard, the order said. Sankar had allegedly murdered another woman at Pooyappally in the district in 2021 and was out on bail when he committed the double murder. The trial for the crime is pending at the SC/ST special court in Kottarakkara. The statements of two prime witnesses, including an eyewitness who was injured during the fatal attack on the two victims were considered by the court as credible evidence during the trial. The case was investigated by a team led by Punalur station house officer T Rajesh Kumar. Kollam district public prosecutor Sicin G Mundakkal appeared for the prosecution.
