Businessman claims trial to hiring, harbouring illegal migrant workers

GEORGE TOWN: A businessman was charged in the magistrate's court here today with two counts of employing six undocumented migrant workers and allowing one of them to remain on business premises last month.
Tan Kah Harn, 38, claimed trial to both charges when they were read out before magistrate Nadratun Naim Mohd Saidi.
On the first charge, he is accused of employing six Myanmar nationals, aged between 22 and 43, who did not possess valid work permits, at a business premises in West Jelutong at 1.30pm on May 29.
The offence, under Section 55B(1) of the Immigration Act 1959/1963 (Act 155), carries a jail term of between six months and five years, and a maximum of six strokes of the rotan upon conviction.
On the second charge, he is alleged to have permitted one of the Myanmar nationals without a valid pass to enter or remain on the premises at the same time and location.
This offence, under Section 55E(1) of the same Act, is punishable by a fine of between RM5,000 and RM30,000, or imprisonment of up to one year, or both, for each undocumented individual, upon conviction.
Deputy public prosecutor Ahmad Danial Amir Saad appeared for the prosecution, while the accused was represented by lawyer K. Mahendran.
Ahmad Danial requested bail to be set at RM15,000 for the first charge and RM5,000 for the second.
However, Mahendran urged the court to consider a lower amount, saying that his client, a Penang resident, was married with two children and also caring for his ailing parents.
"My client was released on police bail on June 3 and has been fully cooperative. He has complied with all conditions imposed, and we therefore request minimal bail," he said.
The court set bail at RM8,000 for the first charge and RM5,000 for the second, and fixed July 15 for mention pending submission of documents.

KOTA BARU: Thousands of express and tour buses are operating illegally nationwide using leased permits, a practice that contravenes the Land Public Transport Act 2010, the Bumiputera Express Bus Operators Association of Malaysia (PPBBM) said. PPBBM chairman Zainal Abidin Mehat said the issue of leasing public transport bus permits has been ongoing for some time. However, it only came to light following the recent fatal crash involving a tour bus carrying students from Sultan Idris Education University (UPSI) along the East–West Highway near Gerik, which claimed 15 lives. Zainal said some bus operators conduct business without any valid permit by purchasing second-hand buses and operating them under permits obtained from various other companies. This, he said, is because many bus operators, most of whom are former bus drivers, are unwilling to apply for permits due to the high upfront cost and the numerous procedures required by the Ministry of Tourism, Arts and Culture (MOTAC) or the Land Public Transport Agency (APAD). "There are even companies that own dozens or hundreds of permits and take advantage by leasing them out, whether for express or tour buses, at a rate of RM500 per month per permit, raking in tens of thousands of ringgit monthly," he said. Zainal said that the practice of leasing express and tour bus permits has been going on for years. "I often receive complaints about this issue, but it remains unresolved because there is both supply and demand in the permit leasing market. "The modus operandi involves bus operators purchasing second-hand buses over 10 years old for between RM70,000 and RM100,000, repainting them to appear new and attractive, and using them as tour or express buses. "To avoid dealing directly with APAD or MOTAC, they simply lease permits from companies offering such services, paying RM500 a month," he told Berita Harian. Zainal said that due to high demand, some bus companies that have more than 100 express or tour bus permits lease out nearly all of them. These companies retain only a few permits for their own use to avoid detection. "Imagine a company with 100 permits earning RM500 per permit every month, they can easily make tens of thousands of ringgit monthly," he said. "They lack the proper knowledge to become legitimate operators and are only chasing fast money, with little concern for the safety of future passengers. "They're also crafty, during APAD enforcement operations, these buses are kept off the road temporarily to avoid detection for operating under permits belonging to other companies. "That's why sometimes you'll see one company name on the bus body and another on the permit," he said. He urged the government to take firmer and more drastic action against bus operators using leased permits. "We welcome the move by the Transport Ministry to revoke the licences of bus companies found to have leased out their permits," he said. Free at last: Muhammed Yusoff leaving the High Court in Kuala Lumpur after the verdict was announced. — Bernama KUALA LUMPUR: Former research assistant Muhammed Yusoff Rawther walked out a free man after the High Court here acquitted him of two charges of drug trafficking and possession of imitation firearms. Justice Muhammad Jamil Hussin ruled that the prosecution has failed to prove a prima facie case against the 32-year-old. In his judgment, the judge said the prosecution had failed to prove that the accused had control, custody and possession of two imitation pistols and 305g of cannabis. He noted that a car, in which the items were found, belonged to Muhammed Yusoff, and the car keys and remote control were in his possession. 'It is undeniable that he was near the car and opened the door when the police conducted their operation. But that does not mean we can conclude that the accused has exclusive control of the car, nor does he have custody and control over the pistols and the drugs,' he said in his decision at the end of the prosecution's case yesterday. Justice Muhammad Jamil also said the accused's behaviour du­ring the operation was consistent with that of a person with no knowledge of the items found in the car. After he was arrested, Muhammed Yusoff told the police that he was 'a victim who was framed by Datuk Seri Anwar Ibrahim', the judge said. 'However, the police did not carry out any investigation to verify this claim. The failure to investigate has denied the accused the right to a fair trial. 'Therefore, it is not safe for the court to call the accused to enter his defence. 'I hereby make the order to discharge and acquit the accused without calling for his defence,' the judge added. On Sept 12, 2024, Muhammed Yusoff was charged with trafficking in 305g of cannabis. The drug was found in his vehicle near the surau at the Kuala Lumpur police headquarters at 10.15am on Sept 6, 2024. He was charged under Section 39B(1)(a) of the Dangerous Drugs Act 1952, which carries a sentence of life imprisonment and at least 12 strokes of the cane, upon conviction. He was also charged with possessing two imitation firearms by the roadside near a condominium in Jalan Bukit Kiara at 9.25am the same day. The charge was framed under Section 36(1) of the Arms Act 1960, which provides for a maximum penalty of one year in prison, a fine of up to RM5,000, or both, upon conviction. Muhammed Yusoff, who wore a striped long-sleeve shirt, was greeted by a large group of people outside of the court complex after his release. He told reporters that he was grateful for the court's decision and thanked his family, lawyers and others who supported him. Throughout the trial, Muham­med Yusoff was detained at the Sungai Buloh prison as the offence he was accused of did not allow for bail.
