De Lima files bill to disclose confi, intel fund outlays flagged by COA

A bill lifting the secrecy on the disbursement details of confidential and intelligence funds (CIF) and limiting the CIF allocation to 10% of the agency's budget, among others, has been proposed in the House of Representatives.
Former Justice secretary and current ML party-list Representative Leila de Lima on Monday made the proposal under her House Bill 1845, or the CIF Utilization and Accountability Act.
IN the bill, all CIF information and documents will remain confidential, but will automatically lose confidentiality and will thereafter be disclosed to the public once the Commission on Audit (COA) issues a Notice of Disallowance (ND) on a CIF disbursement.
State auditors issue NDs if when the expenditure is found to be 'either irregular, unnecessary, excessive, extravagant, or unconscionable.'
The ND, however, can be appealed by the concerned agency.
'The CIF, including all the information and documents related thereto, will then be subject to inquiries and investigations, with documents and related information to be made public, without need of compulsory processes,' the bill read.
In addition, de Lima's proposal states that CIF allocations for any single agency, considering the population serviced, should not exceed 10% of the total annual budget of the agency, unless otherwise explicitly authorized by law.
Further, the bill limits the allocation of CIF to agencies as indicated under the General Appropriations Act and to all other agencies, departments, and units 'with mandates related to national security, peace and order, and intelligence gathering.'
'While the initial guidelines in 2015 may have been appropriate and sufficient at that time, recent developments have exposed the vulnerability of the existing design, implementation, and auditing process of confidential and intelligence funds. Particularly significant among these recent developments is the reported misuse and malversation of confidential funds amounting to P612.5 million appropriated to the Office of the Vice President (OVP) Sara Duterte and the Department of Education (DepEd) of which Duterte served as Secretary,' de Lima said in her explanatory note on the measure, referring to the subject of the impeachment complaint against Vice President Duterte.
She then cited the findings of the House Committee on Good Government and Public Accountability panel on its inquiry on such funds which include:
confidential funds were appropriated to civilian government agencies whose mandates do not include surveillance, nor involve national security and peace and order
confidential expenses were unrelated to national security and peace and order, or confidential funds appropriated for non-confidential activities and expenses
liquidation reports submitted had either unreadable, incomplete, unstated, repeating,or made-up or fictitious names of payees; or liquidation reports had forgeries or no signatures at all
Special Disbursement Offices (SDOs) hired were clueless on how the confidential funds were spent after turning the funds over to another unauthorized individual upon instruction from
Vice President Duterte and
absence of reports on accomplishments of the use of confidential funds.
'The obvious misuse and malversation of millions in taxpayer money as a result of exploiting the weak and insufficient guidelines on confidential and intelligence funds, poses a serious threat to the preservation of public trust in the government and the legitimacy of its institutions,' de Lima said.
'As such, legislative intervention is deemed necessary to ensure that CIF are strictly appropriated to justifiable activities and agencies with mandates to maintain national security and peace and order, and are properly audited with as much transparency as permitted without compromising confidential and intelligence operations,' she added. — BM, GMA Integrated News

Vice President Sara Duterte has criticized the government's supposed lack of disaster preparedness, which she said contributed to the flooding in several areas in the country amid the persistent rains. Duterte said that while on a personal trip at The Hague, Netherlands, she told her detained father, former president Rodrigo Duterte, about the current flooding situation in the Philippines. The Vice President was asked about the earlier suggestion of President Ferdinand 'Bongbong' Marcos Jr. to store floodwater and reuse it for agricultural purposes. 'Ipunin po natin lahat tapos i-deliver po natin sa Malacañang para po may mainom siya,' she said. (Let's collect it and deliver it to Malacañang so that he can drink it.) 'Ganoon na po ang gagawin natin—ipunin natin lahat tapos i-deliver po natin sa Malacañang para meron silang mainom doon,' she added. Dolomite beach VP Sara also slammed the congressional inquiry into the Manila Bay Dolomite Beach Project that was proposed before the House of Representatives. She was referring to House Resolution 56 filed by Bicol Saro party-list Representatve Terry Ridon, who said that the Metropolitan Manila Development Authority (MMDA), through its Chairman Don Artes, identified the Manila Bay Dolomite Beach Project as a direct contributor to the persistent flooding in the City of Manila. SONA 2025 Further, Duterte maintained that she has no obligation to listen to the fourth State of the Nation Address of Marcos on July 28. This, as House spokesperson Princess Abante said that the lower chamber remains open to all government officials for the SONA, including the Vice President. The House official had emphasized the importance of Duterte's role in witnessing the President's annual report before the Congress and the Filipinos. 'Wala tayong batas na nagsasabi na tungkulin ng mga Pilipino ang makinig sa Presidente. Ang nasa batas natin nakalagay, tungkulin ng Presidente ang magbigay sa ating mga Pilipino kung ano 'yung estado ng ating bansa. Siya 'yung may tungkulin, tayo walang tungkulin makinig,' Duterte said. (We have no law that says that Filipinos are mandated to listen to the President. The law states that it is the duty of the President to deliver to Filipinos what the state of our country is. He is the one who has the duty, we have no duty to listen to him.) 'We have the right to listen or to not listen. There is no law mandating us to listen to the President give his State of the Nation Address,' she added. The Vice President previously said that she has no intention of attending Marcos' fourth SONA. Last year, she also skipped the presidential speech. 2028 plans Sara Duterte also disclosed that her father Rodrigo has signified his support for her should she decide to run for presidency in the 2028 elections. 'Sabi niya, kung gusto mong tumakbo, tumakbo ka…Sabi niya, ako ang pinakaunang mag-contribute at tumulong sa iyo. Sabi niya, sana lang ay nasa labas na ako sa kampanya kasi gusto kong mangampanya. Pero sabi niya, 'pag sinabi mo sa akin na tatakbo ka…ako 'yung unang tutulong,' she said, recalling her conversation with her father during her visit. The Duterte patriarch was arrested in the Philippines by local authorities on March 11, based on a warrant of arrest issued by the International Criminal Court. 'We are at 90% to 95% done with the preparations for the SONA, and it is still ongoing even amid the inclement weather. The SONA will push through, as we have prepared for, on July 28,' Abante said in a press conference. Asked if a possible weather-related postponement is on the table, she replied, 'We are yet to talk about any postponement of the physical gathering for the SONA.' Likewise, Abante said that the House is expecting to welcome around 1,500 guests this year, or similar to last year's number of attendees. 'Last year was one of the most attended SONAs, if not the most attended, with around 1,500 guests. We expect this year to have more or less the same as last year's figures,' Abante said. Further, Abante said that while the police and the security forces are already all systems go for the SONA next Monday, there is no specific threat that would warrant a heightened alert. In a separate announcement, House Secretary General Reginald Velasco said the House has prepared three viewing rooms in Batasang Pambansa complex for more guests, apart from the plenary hall where the President will deliver his SONA: the Daniel Romualdez Hall for 290 guests; the Ramon Mitra Room for 70; and the Jose de Venecia Hall for 80. — BM, GMA Integrated News

Senate President Francis 'Chiz' Escudero on Monday said that he will propose to his fellow senators that the impeachment court for the trial of Vice President Sara Duterte begin on August 4, 2025. Escudero, who sits as presiding officer of the impeachment court, explained that notices have to be given both to the House prosecution and the camp of Duterte regarding the trial. He also said that the House of Representatives still has to comply with the court's order when it voted to return the articles of impeachment on June 10. ''Yun 'yung imumungkahi ko. Bakit 'yung petsang 'yun? Dahil kailangang bigyan ng notice 'yung mga partido. Hindi naman pwedeng naisipan lang ng majority ng Senado pag-open ng Senado eh bukas na bukas din. Kailangang may sapat na panahon para mabigyan ng notice 'yung mga partido,' Escudero said in an ambush interview. (That's what I'm going to propose. Why that date? Because the parties have to be given notice. The Senate majority can't simply decide that the trial begins the next day. There needs to be enough time to give notice to the parties involved.) 'Pangalawa, wala pa namang order 'yung Senado dun na hindi pa kino-comply ng Kamara. Hopefully, that one week period, 'yung Kamara will be given time to comply with the orders of the Senate impeachment court dahil 'yung pangalawang order hindi ba, dapat ang gumawa nun 20th House of Representatives, hindi 'yung nagdaang House of Representatives. Kung hindi man nila ma-comply yun pagdating ng August 4, edi dun na lang namin pag-uusapan,' he added. (Second, the House has not yet complied with the order issued by the Senate. Hopefully with that one-week period, they will be able to do so because the second order states that it is the 20th House of Representatives that should comply. If they won't be able to comply by August 4, then we have yet to talk about that.) The Senate impeachment court first convened on June 10, with the senator-judges under the 19th Congress voting to return the articles of impeachment without dismissing or terminating the case until such time that: The House of Representatives certify to the non violation of Article XI, Section 3, paragraph 5 of the Constitution, which provides that 'No impeachment proceedings shall be initiated against the same official more than once within one year; include the circumstances on the filing of the first three impeachment complaints"; and The House of Representatives of the 20th Congress communicates to the Senate that it is willing and ready to pursue the impeachment complaint against the Vice President. It was Senator Joel Villanueva who first revealed that the day one of Duterte's impeachment trial may be on August 4—a week after the Senate and the House of Representatives open their first regular session for the 20th Congress. Escudero, meanwhile, shrugged off claims that the Senate is delaying the trial, stressing that it is not their job to rush it. 'Hindi porket nagmamadali sila ay kailangan na rin namin magmadali. Gagawin namin ito sang ayon sa proseso. Ulitin ko, madaliin, delay na naman—edi bukas na bukas rin mag-hearing tayo kahit na walang notice sa mga partido—paano naman 'yun?' He asked. (Just because they're in a hurry, we have to hurry as well. We'll do it according to the process. We can't conduct the hearing without giving notice to the parties involved.) Escudero said that the final date regarding the impeachment proceedings will be announced in the plenary. Inhibit? On Monday, youth group Samahan ng Progresibong Kabataan (SPARK) trooped to the Senate, urging Escudero to inhibit as senator-judge and presiding officer in Duterte's impeachment trial. In their open letter, the student leaders asserted that there is an 'immediate need not only to get on with the impeachment proceedings forthwith, but to demonstrate to the public that the proceedings will be insulated as much as possible from political maneuvering and will be focused only on weighing the merits of evidence.' 'As Senate President, recusing from the proceedings of the impeachment court assures the public that the leading figure of the Senate will stand above the partisan politics that define the legislative process,' the youth group said. 'We believe that the delays in the start of the impeachment proceedings—whatever their reason—have damaged the legitimacy of the Senate enough to merit drastic measures on your part as Senate President to reassure the public that the impeachment court can carry out its constitutional duty without fear or favor,' it added. Escudero, in response, said that he does not consider the call of the students a necessity nor fair. Escudero also reiterated that the impeachment court will not listen to anyone who is in favor of or against the impeachment trial and will only do what is right in accordance with the law. The House of Representatives impeached Duterte on February 5, with over 200 lawmakers endorsing the complaint. The Vice President was accused of betrayal of public trust, culpable violation of the constitution, graft and corruption, and other high crimes. Duterte had entered a 'not guilty' plea in the verified impeachment complaint filed against her, which she called merely a 'scrap of paper.' —VAL, GMA Integrated News
