
Ban on overaged vehicles: No coercive steps to be taken while SC hears review plea
Issuing notice on the plea, a three-judge bench presided by Chief Justice of India B R Gavai said, 'In the meantime, no coercive steps to be taken against the owners of the car on the ground that they are 10 years old in respect to diesel vehicles and 15 years old with respect to petrol vehicles.' The bench also comprised Justices K Vinod Chandran and N V Anjaria.
As part of efforts to combat air pollution, the National Green Tribunal had in 2015 directed that diesel vehicles older than 10 years and petrol vehicles older than 15 years should not be allowed to operate in Delhi NCR. This was upheld by the Supreme Court in 2018.
Recently, the Delhi government had approached the Supreme Court seeking a review of the order saying the blanket ban on old vehicles 'was observed to have caused numerous practical hardships to the citizens of Delhi'.
In its application dated July 25, the Rekha Gupta government had argued that 'the road-worthiness of a vehicle is a technical and scientific issue that must be linked to actual emissions as tested and recorded by mechanisms as set out under the Motor Vehicles Act, the Central Motor Vehicles Rules, etc., as opposed to blanket ban on the basis of age which is unlinked to actual emissions'.
It added that the ban on the plying of the said vehicles in the last seven years, 'though undoubtedly salutary in aim, was observed to have caused numerous practical hardships to the citizens of Delhi, which today, in light of the advancements in technology and enforcement now prima facie appear to outweigh the prudence and feasibility of continuance of the said ban'.
The plea further urged the court to direct the Centre or the Commission on Air Quality Management (CAQM) 'to carry out a suitable broad based, scientific study on the need for continuance' of the complete ban imposed by the Supreme Court's October 29, 2018, order.
The government said the complete ban order 'was originally passed as an emergency measure during a period when Bharat Stage IV (BS-IV) emission standards were in force and the migration to Bharat Stage VI (BS-VI), which has much stricter and advanced norms, had not yet commenced'.
It added, 'However, it is submitted that to tackle the issue of pollution in the NCR region, a comprehensive policy is required which gives vehicle fitness based on the actual emission levels of an individual vehicle as per scientific methods rather than implementing a blanket ban based on solely the age of the vehicle.'
The government said that significant technological, legal, and environmental developments have taken place since 2018, which warrant a 're-examination of this decision' by an expert body to form a structured and graded plan to tackle pollution.
The state said that since the issue of Delhi's air quality is not confined solely to the National Capital Territory but rather to the broader NCR, it is submitted that 'it would be appropriate if suitable scientific studies on the feasibility, desirability and efficacy of continuing the said ban are carried out' at the level of the Union government or the CAQM.
The Delhi government's attempt to stop fuel supply to end-of-life vehicles had met with hurdles soon after it came into effect in the Capital on July 1. Citing 'critical operational and infrastructural challenges', it had asked CAQM to put the fuel ban 'on hold with immediate effect.'

SC cannot intervene until ‘Bill' becomes law after Governor's assent: Puducherry
Union Territory of Puducherry has seconded the Presidential Reference, saying a Bill does not become law until the Governor or the President assents. Puducherry's affidavit, signed by Chief Secretary Sharat Chauhan, said judiciary should not get entangled at the stage of Bill and intervene in inchoate legislative policymaking. The Union Territory agreed with the Centre that the President and Governors have discretionary powers under Article 201 and 200 while dealing with the question of approval of State Bills. These discretions were not justiciable. The 63-page affidavit disagreed with the April 8 judgment of the apex court in the Tamil Nadu Governor case fixing timelines for the President and the Governors, noting the Constitution did not fix any specific time limits for them. 'The silence of the Constitution was conscious and purposeful, intended to uphold the institutional discretion, dignity and gravitas of the offices of President and Governor… It is worth noting that the judiciary cannot usurp the role of the legislature and decide as to which Bill is to be passed or within what timeframe the Bill would come into effect. It is wholly, completely and unambiguously, a legislative function under the purview and ambit of the legislature and such functions cannot be exercised by the courts,' Puducherry pointed out. The Union Territory argued that judicial review could take place only after a Bill became law. The Supreme Court cannot assume the powers of the President and Governors and grant 'deemed assent' to State Bills. This would only lead to the court becoming a judge in its own case later on when the constitutionality of the law came to be challenged in court. 'In case of such deemed assents through use of Article 142, not only would the legislative domain be breached but the courts would become a judge in their own cause, if those laws were to be challenged judicially or taken up for judicial review,' the Union Territory reasoned. eom

Farmers to lay siege to Vidhana Soudha in Bengaluru on August 20
Members of Karnataka Rajya Raitha Sangha and Karnataka State Sugarcane Growers' Association will lay siege to the Vidhana Soudha on August 20, seeking the implementation of their long-pending demands. At a press conference here on Saturday, H. Bhagyaraj, president of the sugarcane growers' association, said that farmers will also hold a 'satyagraha' at Freedom Park in Bengaluru. Though the country celebrated Independence Day on August 15,there was little for farmers to celebrate as the government had failed to ensure scientific pricing for agricultural produce, he said. Mr. Bhagyaraj said that the Fair and Remunerative Price (FRP) for 2025-26 should be fixed at ₹4,500 per ton, and harvesting and transportation costs must be borne by the sugar factories. The farmers also expressed concern that the weighing scales are not scientifically calibrated, as a result of which they suffer losses. This should be avoided by installing the weighing scales in front of the factories so that the farmers can monitor the process as well, they said. Mr. Bhagyaraj pointed out that the factories owed dues to the tune of ₹950 crores to sugarcane farmers, and added that this should be cleared immediately. Drawing attention to the shortage of fertilizers, the association said that the issue has been politicised by both the State and the Centre, and that it was the responsibility of the governments to ensure the availability of fertilizers and its smooth distribution. The authorities were urged to crack down on traders creating artificial scarcity by hoarding fertilizer stocks or selling them at a price higher than the rates fixed by the government. Mr. Bhagyaraj urged the government to implement the Mekedatu project without further delay, and blamed the Centre and the State for failing to expedite the works. The farmers stated that banks tend to insist on CIBIL scores before releasing agricultural loans, and hence urged the government to change the policy and delink CIBIL scores from farm loans. Any delay in repayment of loan due to crop failure or vagaries of nature has a negative bearing on the CIBIL score and affects the farmers, the association said. Drawing attention to the low penetration of crop insurance among farmers, the association said that the policy and insurance schemes should be tweaked to make a particular land of the farmer concerned as the unit area of insurance. When the unit area for crop insurance is too large, individual farmers suffer because damage to their crops may be overlooked and their claims rejected, if conditions in other parts of the area are considered normal, it added. Other demands included immediate release of ₹1,000 crore by way of incentives which is pending for dairy farmers, establishment of crop and milk procurement centres at the gram panchayat level, rescinding the Land Reforms Act and APMC (Amendment) Act, implementation of the recommendations of M.S. Swaminathan Committee, a law ensuring statutory guarantee of Minimum Support Price for farmers' produce, etc.
