
Court allows Taguig LGU to continue services in EMBO barangays
A regional trial court (RTC) granted Taguig City a writ of preliminary injunction allowing it to continue providing basic services, including healthcare, wellness, and recreation, in the disputed Enlisted Men's Barrios (EMBO) barangays.
According to the seven-page ruling by the Taguig RTC-Branch 153 on May 22, Makati City will no longer have control over government facilities in the EMBO barangays such as health centers, covered courts, daycare centers, among others.
"After careful evaluation of the evidence on record, this Court finds the prayer for issuance of Writ of Preliminary Prohibitory and Mandatory Injunction to be impressed with merit," the ruling read.
The court noted that the plaintiff, Taguig City, anchored its prayer on the Supreme Court ruling in 2021 that Barangays Cembo, South Cembo, Comembo, East Rembo, West Rembo, Pembo (including Rizal), Pitogo, Post Proper Northside, and Post Proper Southside are within the territory of Taguig.
This decision became final and executory in September 2022.
"Given the foregoing, this court finds that the plaintiff had shown sufficient evidence of its clear and unmistakable right to the possession of the subject public facilities/structures," the latest ruling further read.
The preliminary injunction came after the Taguig City RTC issued a temporary restraining order (TRO) on May 6, prohibiting Makati and any of its personnel from preventing Taguig to take full and exclusive possession of public properties in the EMBO barangays.
For her part, Taguig City Mayor Lani Cayetano welcomed the court's decision.
"Lubos po naming ikinagagalak ang desisyong ito ng korte. Sa pamamagitan ng preliminary injunction, tuloy-tuloy na ang pagbabalik ng serbisyo sa mga taga-EMBO. Mula sa check-up ng mga buntis, bakuna ng mga bata, gamot ng mga senior, hanggang sa sports at wellness activities sa mga courts at parke—bawat isa ay may karapatang makinabang," she said in a statement.

ICC public counsel dismisses Duterte camp's challenge on jurisdiction

Duterte's lawyers earlier argued that preconditions for the exercise of jurisdiction in the Situation of the Philippines were not met at the time the Pre-Trial Chamber authorized the opening of an investigation on September 15, 2021. They noted that the Philippines' withdrawal from the Rome Statute took effect on March 17, 2019 and the Pre-trial Chamber issued its decision, more than two years later. ICC Principal Counsel Paolina Massida pointed out that the Philippines' withdrawal has no legal effect as the Prosecutor's preliminary examination started even before the withdrawal took effect. 'The preliminary examination conducted by the Office of the Prosecutor in the Situation in the Republic of the Philippines must be considered as 'a matter' that was 'already under the consideration of the Court' prior to the date on which the State's withdrawal became effective and thus the Court may exercise its jurisdiction over the case against Mr Duterte,' according to the 27-page document dated June 9. Duterte pulled the Philippines out of the Hague-based ICC's Rome Statute in 2018, with the withdrawal taking effect in 2019, after the tribunal began a preliminary probe into his administration's drug war. In 2021, Supreme Court ruling said the Philippines has the obligation to cooperate with the ICC despite its withdrawal from the Rome Statute, noting that the exit does not affect criminal proceedings pertaining to acts that occurred when a country was still a state party. Duterte was arrested and is detained at the Hague Penitentiary Institution or the Scheveningen Prison while awaiting trial in March this year. With Duterte's arrest, the ICC principal counsel noted that the government's surrender of the former president shows that 'the Government of the Philippines still considered itself to be bound by the Statute when complying with the Arrest Warrant and surrendering the suspect into the custody of the Court.' 'This further provides an irrefutable proof to the effect that the Republic of the Philippines does consider that the Court still can exercise its jurisdiction over the crimes committed in its territory as described in the Warrant of Arrest against Mr Duterte, pursuant to articles 12 and 127 of the Statute,' the document further read. 'For the foregoing reasons, the Principal Counsel respectfully requests the Chamber to dismiss the Defence Challenge,' it concluded. Manila court enters ‘not guilty' plea for Teves in Degamo murder case
A Manila court on Tuesday entered a not guilty plea for former Negros Oriental Representative Arnolfo 'Arnie' Teves Jr. in the multiple murder case filed against him over the alleged killing of Negros Oriental Governor Roel Degamo, his camp said. Atty. Ferdinand Topacio, Teves' legal counsel, said the former lawmaker again invoked his right to remain silent before the Manila regional trial court (RTC) Branch 51. Teves attended the arraignment through teleconference. 'Because he has serious reservations about the manner by which he was repatriated by the Philippine government in coordination with the government of Timor-Leste,' Topacio said in an ambush interview. The former lawmaker was deported from Timor-Leste in late May. Teves' camp previously lamented his deportation amid the habeas corpus petition they filed asking the Timor-Leste Court of Appeal for his body to be produced before the court following his arrest. The former congressman is facing murder, attempted murder, and frustrated murder charges over the killing of Degamo and nine others on March 4, 2023 at the Degamo residence in Pamplona, Negros Oriental. Topacio said the next hearing will take place on August 20. Meanwhile, Atty. Andrei Bon Tagum represented congresswoman-elect and former Pamplona Mayor Janice Degamo, the late governor's widow. 'All I can say is that today marks a difficult step towards justice. And the private complainant, congresswoman-elect Janice Degamo has waited so long for this,' Tagum said in a separate interview. Last week, Teves was arraigned for his case over illegal possession of firearms and explosives. The Manila RTC Branch 12 also entered a not guilty plea for him. Teves and several others have also been charged with the alleged killings of three individuals in Negros Oriental in 2019. He and 12 others have also been designated as terrorists by the Anti-Terrorism Council, citing several alleged killings and harassment in Negros Oriental. He was expelled by the House of Representatives in August last year for disorderly conduct and continued absence. Marcos lauds Singapore's role in ensuring survival of Philippine Eagle
