
MGEU tests new Manitoba labour legislation in strike by child and family services agencies
Labour legislation passed last fall in Manitoba is about to be tested by one of province's largest unions.
The Manitoba Government and General Employees' Union has applied to the provincial labour board under new provisions of the Labour Relations Act to (LRA) have the current contract dispute with two child and family services (CFS) agencies resolved by an independent arbitrator.
More than 300 members at Michif Child and Family Services and Métis Child, Family and Community Services are now in their second week of a strike, fighting for wage parity with other provincial workers who do similar jobs, MGEU president Kyle Ross says.
"It's alarming to note that neither of these employers has approached the MGEU to get back to the bargaining table with a fair and reasonable offer for these workers," Ross said Thursday at the Union Centre on Broadway in Winnipeg.
That foot dragging is putting families and kids at risk, even moreso as layoffs to 20 per cent of the unionized staff at the agencies take effect Thursday, he says.
MGEU's filing argues those layoffs infringe on the workers' ability to strike in a meaningful way because, in order to maintain a certain level of essential service more workers will now have to leave the picket line to go back to work.
The recent amendments to the LRA mean a union can ask the Manitoba Labour Board to order a dispute be resolved through arbitration if the requirement to perform essential services has compromised the right to strike and the right to collective bargaining.
Most of the striking workers are employed at shelters operated by the CFS agencies, created to prevent Métis children and youth in care from being placed in hotels and to help young adults aging out of care.
As a result, not all of the unionized workers have been on the picket line. About half have been working to maintain an essential level of care required for vulnerable youth, whose quality of life could otherwise be at risk, the MGEU says.
The layoffs have added another concern for workers who are trying put pressure on the employer by striking while also balancing a level of care.
They have now been without a contract since the previous agreements expired on Jan. 31, 2023. Any wage increases bargained into a new contract should be retroactive to that date, but Ross is concerned the employers will argue those payments only apply to members still working when the new deal is ratified.
"Those workers who were laid off today stand to lose two years of retroactive pay," he said.
The Manitoba Métis Federation has said budget constraints led to the layoffs but "the employer hasn't laid bare what their financial situation is," Ross said.
"They have a duty to let us know what their financial situation is so we can understand when they're issuing layoffs and when we're bargaining. But we have yet to hear that from them," he said.
In the meantime, funding from the province to CFS agencies has increased by more than 14 per cent over the past three years, including more than $2 million in new funding in last month's budget, Ross says, "so the money for wage parity is there."
"We believe those layoffs are part of a bargaining strategy. We've been arguing with them for over two years and there was no mention … at any time that there would be layoffs coming. Then, once our members chose to push back and take a strike mandate, they brought down these layoffs."
On March 24, Southeast CFS was able to avert a strike and reach a new collective agreement by offering wage parity, Ross says, adding both the Métis CFCS and the Michif CFS received proportionally similar funding increases.

Opinion The grassroots organization Giganawenimaanaanig released an interim report this week on the progress of the proposed Red Dress Alert, an initiative that would notify the public and help co-ordinate responses when an Indigenous woman, girl, or two-spirit person goes missing. Similar to an Amber Alert, which is issued when a child goes missing, the program responds to the calls for justice in the national inquiry on murdered and missing Indigenous women and girls and the parliamentary motion put forward by Winnipeg Centre MP Leah Gazan in 2023 to create the initiative. After receiving unanimous support in Parliament, a $1.3-million fund was established to research and make recommendations on how the program could be implemented nationally. In the wake of four murders of Indigenous women by a serial killer in Winnipeg, and countless other MMIWG in Manitoba, the value of a Red Dress Alert is obvious. When considered alongside the amount of young women and two-spirit people in the child welfare system, the rise in domestic violence, and a city of Winnipeg police force that called the search for Indigenous female remains at a landfill 'unfeasible,' the initiative is need more than ever. It's needed now, in fact. More than 17,000 evacuees, mostly from northern First Nations, have been displaced owing to wildfires. In excess of 10,000 of them are in hotels or other lodgings in Winnipeg. That means this city has had an influx of thousands of Indigenous women, girls and two-spirit peoples — individuals preyed upon by many forces here. It's well-known that when Indigenous peoples are evacuated due to fires, floods, or some other traumatizing disaster, certain considerations in the health, justice, and emergency management systems must take place. For instance, many First Nations are alcohol-free due to a long history of complicated relationships with substance use. This community law is impossible to maintain off-reserve but community leaders combat the issue in other ways: such as by providing extra mental health services, family-building events, and even patrols to support people during their time as refugees. The same could be said about health, justice, and even governance. Simply put, due to a long history of political mistreatment, Indigenous communities require specific considerations when displaced by disasters. The issue of MMIWG2S+ is a disaster, too. Combined with recent fire evacuations, the situation has become critical. All this week, Indigenous social media has been full of individuals working overtime to protect Indigenous women, girls, and two-spirit peoples from nefarious forces. 'I'm gathering a crew of helpers this evening,' posted activist Rylee Nepinak of the downtown patrol group Anishiative. 'After speaking to multiple sources (mainly our women), it's clear we need as many boots on the ground watching for any predatory/exploitative signs (and) talk to the kids about safety.' Indigenous leaders are reporting that predators have approached displaced vulnerable individuals online and in person to offer drugs, alcohol, and invite them to 'party' in a private home — where a sexual or physical assault can easily take place. Advocates have created a list of 'safety tips when heading out in Winnipeg' that include: travelling in pairs, informing family and support staff of travel and return plans, and keeping location apps activated on their cellphones. Isabel Daniels, a vulnerable person advocate, warned in a post: 'Nothing is for free: if people are offering FREE substances SAY NO… Please be cautious of the things people are offering, Fentanyl is in a lot of street drugs.' Daniels also posted a dire message: 'People offering you FREE clothing, cellphones and liquor can be human traffickers, ALWAYS SAY NO.' Winnipeg police are joining the fight to educate and keep Indigenous people safe by providing extra officers and visits to evacuee shelters and printing 3,000 pamphlets with emergency contacts and tips to remain safe. Similar situations have been reported in other cities where evacuees are being sheltered, such as Thompson and Brandon. Community groups have recommended Indigenous families take photos of their female and two-spirit members in case a missing person report needs to be filed. If one didn't know better, one might see the release of the Red Dress Alert interim report, alongside a real-life emergency related to the safety of Indigenous women, girls, and two-spirit individuals, as a well-planned political move. It isn't. It's evidence the issue is urgent, laid bare right before our very eyes, now more than ever. Fredericton non-profit aims to help children caught in intimate partner violence situations
EDITOR'S NOTE: As part of our series looking at the issue of intimate partner violence in the province, we spoke with a New Brunswick advocate and survivor who shared her story. We also spoke with Lyne Chantal Boudreau, the provincial minister responsible for women's equality, about how the province is addressing the issue. Here is a look at what support workers in the province are noticing in terms of trends, and how they cope with the field. Children are some of the invisible victims of intimate partner violence in Canada, and a Fredericton non-profit is aiming to help them feel safe while working through difficult feelings. In the last few years, it has also implemented a program for the children of survivors. Story continues below advertisement 'When we're looking at the whole family, we're seeing the influence of domestic violence isn't just on the protective parent, on the mom, the children also are experiencing some negative effects as well,' said Meaghan Ross, the child and youth guidance co-ordinator at Liberty Lane. Sometimes, abusers use children to continue their abuse by passing messages through them to the survivors. Other times, they threaten or attempt to withhold access to children, which causes harm for both the survivors and the young ones caught in the middle. 'It impacts their emotional safety, right, and they don't know who to trust. There's a sense of shame, there's a sense of self-responsibility,' Ross said. Liberty Lane works to help children process their feelings and understand how to regulate their emotions. However, the work has its challenges, especially when it comes to family law and child protection systems. 'When you feel like you've done a lot with the client and maybe things didn't go the way that you want to and the children are put into care, that's probably one of the hardest situations,' Ross said. ICC appeals judges greenlight first in absentia hearing over Ugandan rebel leader Kony
THE HAGUE, Netherlands (AP) — Appeals judges at the International Criminal Court gave a final greenlight Tuesday for the tribunal's first in absentia hearing by allowing the next step in proceedings against notorious fugitive Ugandan rebel leader Joseph Kony. The Hague-based court has scheduled a so-called confirmation of charges hearing at which prosecutors will present evidence in September to back up charges of war crimes and crimes against humanity against Kony, despite his whereabouts being unknown. Kony, the leader of the brutal Lord's Resistance Army, faces dozens of counts of crimes against humanity and war crimes, including murder, sexual enslavement and rape. The ICC's rules do not allow trials entirely in absentia but can in some circumstances move forward with a confirmation of charges even if the suspect is not in custody. Kony's court appointed lawyers had argued his fair trial rights would be violated if the proceedings continued without their client. Judge Erdenebalsuren Damdin said the court has 'adequately robust safeguards' for suspects to allow the confirmation of charges hearing to be held in absentia. The case had been seen as a trial balloon for the court moving forward with other cases where the suspect is not in custody, such as Israeli Prime Minister Benjamin Netanyahu or Russian President Vladimir Putin. However, the Kony decision was limited to situations where the wanted person has fled ICC custody or cannot be found, says Luigi Prosperi, an international criminal law expert at the University of Utrecht. Kony 'is a very peculiar situation,' he told The Associated Press. Kony was thrust into the global spotlight in 2012 when a video about his alleged crimes went viral. Despite the attention and international efforts to capture him, he is still at large. The LRA began its attacks in Uganda in the 1980s, when Kony sought to overthrow the government. After being pushed out of Uganda, the militia terrorized villages in Congo, Central African Republic and South Sudan. It was notorious for using child soldiers, mutilating civilians and enslaving women. In 2021, the court convicted Dominic Ongwen, a one-time child soldier who morphed into a brutal LRA commander of dozens of war crimes and crimes against humanity, ranging from multiple murders to forced marriages.
