Will not publish or circulate D'Cunha Commission report on Bengaluru stampede, Karnataka govt assures HC

The Karnataka High Court Wednesday directed the state government to ensure that the Justice (Retd) Michael D'Cunha Commission report on the June 4 stampede outside Chinnaswamy Stadium in Bengaluru is not published or circulated until the next date of hearing and the government assured the court of the same.
The division bench of Justice Jayant Banerji and Justice Umesh M Adiga recorded the submission by Advocate General K Shashikiran Shetty and adjourned the hearing of the petition filed by DNA Entertainment Networks Private Limited to September 4, allowing the Karnataka government time to file its objections.
Eleven people were killed in the stampede, which occurred during a celebration to mark the Indian Premier League (IPL) victory of Royal Challengers Bengaluru (RCB) cricket team. The Commission's findings held the event organisers and senior police officers responsible for the tragedy. As a result, the government decided to file criminal charges against officials from RCB, DNA Entertainment, and the Karnataka State Cricket Association.
DNA, the event management partner of Royal Challengers Sports Private Limited, which owns RCB, filed the plea arguing the Commission violated the provisions of the Commissions of Inquiry Act, 1952, in the procedure adopted in conducting the inquiry.
Senior advocate B K Sampath Kumar argued that DNA had not been granted the opportunity to cross-examine those witnesses who had deposed against them. Kumar alleged that DNA had not been given a copy of the report, when extracts from it had been circulated in the media, adding that the reputation of DNA was being tarnished 'every second'.
The AG Wednesday stated that the Commission is a fact-finding body, and there is no question of damage to anyone's reputation.
Kumar had previously stated before the court that the time provided for the inquiry was one month and the report was ready only by July 11, which was beyond the period.
'Nowhere is the power for the one-man Commission to say such-and-such action should be taken against any individuals. It is only to point out who is responsible, what were the lapses, etc,' he had said.
At the time, AG Shetty had expressed doubts regarding the legal maintainability of the petition by DNA. The high court had then directed the judicial report to be placed before it in a sealed cover.

Former India pacer Venkatesh Prasad is set to contest in the upcoming Karnataka State Cricket Association (KSCA) elections, which is tentatively to be held between October and November. Prasad, a well-experienced coach, selector and administrator, had served as a vice-president from 2013 to 2016 when Anil Kumble was the KSCA president. But since then Prasad stayed away from administration to focus on a coaching career along with dabbling in the media world as a pundit and commentator. The 56-year-old, a former India bowling coach during the 2006-2007 season, was also in the coaching staff of Punjab Kings nee Kings XI Punjab. Prasad will have veteran administrator Vinay Mruthyunjaya on his side. Mruthyunjaya is a former KSCA treasurer and a member of the BCCI Finance Committee. It has been learned that Prasad and Mruthyunjaya will announce the full set of their panel in the coming days. The term of incumbent KSCA regime headed by Raghuram Bhatt will end on September 30. The present set of officials are standing on the firing line after 11 fans died during the stampede near the M Chinnaswamy Stadium on June 4 while gathering to take part in the Royal Challengers Bengaluru's IPL victory celebrations. The KSCA secretary Shankar A and treasurer ES Jairam had to step down, taking moral responsibility for the incident, after the state cabinet green lighted criminal procedures against association officials along with top names of RCB and event management firm DNA. The legal proceedings are in full swing after the cabinet-appointed one-man Justice D'Cunha Commission submitted its findings to the government and the state High Court. Currently, the KSCA secretary and treasurer posts are vacant, and if everything goes as per plan Mruthyunjaya could return to the role. It may be recalled that former India skipper and BCCI president Sourav Ganguly, who captained Prasad, is also set to re-enter administration as he will in all likelihood file nomination for the president's post in the upcoming Cricket Association of Bengal (CAB) elections.

The Staff Selection Commission (SSC) has released the final answer key of the Sub-Inspector in the Delhi Police and CAPFs Examination, 2024 (Paper-II). New Delhi: A 50-year-old man died and his daughter was critically injured after a neem tree fell on their motorcycle in southeast Delhi's Kalkaji during Thursday morning's torrential downpour. The deceased, Sudhir Kumar, was on his way to drop his daughter, Priya, at her NGO office in Amar Colony when the falling tree hit them at B Block near Paras Chowk. A native of Aligarh in UP, Kumar worked as a shelter home caretaker and lived in Tughlaqabad with his wife, two daughters and a son. Hemant Kumar Tiwari, DCP (southeast) said, "A JCB was arranged and the two individuals were extricated and shifted to hospital." Kumar succumbed to his injuries and Priya is being treated for a fracture in the right pelvic region.
