Three cops claim trial to accepting RM20,000 in bribes

IPOH: Three police officers were charged in the Sessions Court here today with two counts of accepting RM20,000 in bribes.
The accused, Lance Corporal Ahmad Rabani Rusnizal, 29; Lance Corporal Mohamad Shukre Mohamed Rowi, 37; and former Corporal Wan Mohd Nor Imran Wan Seman, 35, pleaded not guilty before Judge Meor Sulaiman Ahmad Tarmizi to both charges read jointly in court.
According to the first charge, the three, who were serving at the Merbok Police Station in Kedah at the time of the offence, were accused of jointly and corruptly receiving a RM10,000 bribe.
The payment was transferred from an AM Bank Islamic account belonging to Azizi Norhafizi Abu Bakar into a BSN bank account owned by Ahmad Rabani.
The bribe was allegedly given as an inducement for the accused not to take action against Azizi for possessing methamphetamine, an offence under the Dangerous Drugs Act 1952.
The act was said to have occurred at BSN-CPI Kamunting, in the Larut, Matang & Selama district, around 3am on July 24, 2023.
For the second charge, all three accused were again alleged to have jointly and corruptly received another RM10,000 bribe — also transferred from Azizi's AM Bank Islamic account to Ahmad Rabani's BSN account.
The inducement was for the same reason as the first charge, for not taking action against Azizi for methamphetamine possession, which is an offence under the Dangerous Drugs Act 1952.
This second offence allegedly took place at the same location (BSN-CPI Kamunting) at around 3am on the following day, July 25, 2023.
If convicted, the offence under both charges carries a maximum prison sentence of 20 years and a fine of not less than five times the amount of the bribe or RM10,000, whichever is higher, for each charge.
The prosecution was led by Malaysian Anti-Corruption Commission (MACC) prosecuting officer, Mohd Zulfadli Azharudin, while all three accused were represented by lawyer Siti Salwa Ja'afar.
Zulfadli proposed bail of RM10,000 with one surety for each accused, along with an additional condition that they report to the MACC office in Sungai Petani, Kedah, on the first Sunday of every month until the case concludes.
However, Siti Salwa requested a lower bail amount, citing the accused's monthly income of around RM1,700 and family obligations, including the fact that Wan Mohd Nor Imran is now working as a lorry driver after leaving the police force.
The judge granted bail at RM5,000 each and allowed the additional condition requested by the prosecution.
He also set June 26 as the next mention date for document submission.
All the accused posted bail.

In a statement, Rajesh Nagarajan and Sachpreetraj Singh Sohanpal, who are acting on behalf of Naimah Khalid, said the Malaysian Anti-Corruption Commission's (MACC) repeated seizure of the Kuala Lumpur city centre landmark was 'pure harassment'. 'This is vindictive, unlawful and a blatant abuse of power by MACC. This is contrary to the rule of law; it is the law of the jungle,' they said. This is the anti-graft agency's second time seizing the tower on Jalan Binjai after making a similar move on Dec 21, 2023. In a strongly worded statement, the lawyers pointed out that MACC had already seized Ilham Tower previously, raising doubts over the justification for taking the same action again. Questioning whether MACC was 'playing musical chairs with the law', they stressed that no corruption charges have been brought against Daim despite repeated allegations and insinuations by both Prime Minister Anwar Ibrahim and MACC chief commissioner Azam Baki. 'Having failed to produce any charges, they are now targeting our client with yet another seizure,' they said. 'They want to keep seizing our client's property even though there's no evidence of corruption. 'We will, on behalf of our client, challenge the seizure of Ilham Tower in court immediately.' Azam previously said the commission was considering seizing over RM2 billion in undeclared assets linked to Daim, his family and proxies. Eight new investigation papers were opened after receiving fresh information from foreign agencies. On Tuesday, MACC said it had obtained a court order to freeze £132 million (RM758.2 million) worth of assets in London belonging to Naimah and her family. The assets include two commercial buildings, five luxury residences and one bank account, Utusan Malaysia reported. According to MACC, investigations revealed that the assets were linked to suspected offences under Section 4(1) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001. In January last year, Daim claimed trial to a charge of failing to comply with the terms of an asset declaration notice issued by MACC. He was accused of not disclosing his ownership of 38 companies, 19 land plots in five states, six properties, two unit trust accounts and seven luxury cars. MACC said he had asked for five deadline extensions but still failed to comply. Naimah also faces an asset declaration charge. She is accused of failing to declare her ownership in various companies, several plots of land here and in Penang, and two vehicles. After Daim's death on Nov 13 last year, the prosecution withdrew the charges and the court granted an order discharging and acquitting him.

KUALA LUMPUR: Toh Puan Na'imah Abdul Khalid will challenge in court the Malaysian Anti-Corruption Commission's (MACC) second seizure of Ilham Tower. In a statement, her lawyers Rajesh Nagarajan and Sachpreetraj Singh Sohanpal described the repeated action as "pure harassment" and accused the MACC of acting beyond the bounds of the law. "This is the most ridiculous action yet taken by the MACC. The same building has already been seized, and yet it is now being seized again. Is the MACC playing musical chairs with the law?" the statement read. The lawyers also criticised the authorities for allegedly targeting Na'imah's late husband, former finance minister Tun Daim Zainuddin, despite no corruption charges having been brought against him. "It bears repeating that, despite the prime minister and the MACC chief's repeated allegations and insinuations against Daim, no offence of corruption has been brought against him. "Now, having failed to bring any charges, they are harassing our client with a second seizure," they said. They added that the move, without any evidence of wrongdoing, violated the rule of law and amounted to persecution. Earlier, the MACC said it had been authorised to seize Ilham Tower once again, a building owned by Daim's family. The commission said it had obtained authorisation from the deputy public prosecutor. According to the MACC, the seizure was based on a Notice of Seizure of Immovable Property under Section 51(1) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLATFPUAA), dated June 4. It added that authorisation for the seizure was granted pursuant to powers conferred on the public prosecutor under Section 376(3) of the Criminal Procedure Code. Ilham Tower, located in downtown Kuala Lumpur near the Petronas Twin Towers, houses a four-star hotel, office spaces, a gallery, and other facilities. Judge Azrul Darus sentenced Marchell Jeff Lee Sin Ket, 39, to one year in prison for assisting in concealing RM314,790 belonging to Ong Boon Ian, 59, an investment company owner, in his bank account at a condominium unit in Bandar Menjalara, Sentul, between Nov 18 and Dec 12 last year.
