Limitation clause sparks concern even as second Waqf survey details are yet to be notified in Telangana

Even as protests against the Waqf Amendment Act, 2025 continue, and more are scheduled to be held in Hyderabad, including the Telangana March seeking a withdrawal of the legislation on April 26, the Telangana government is yet to publish the details of the second Waqf survey.
According to those familiar with the matter, the second Waqf survey, which was completed earlier this year, enumerated approximately 13,400 properties. However, unlike those listed in the first survey, these comprise much smaller land parcels.
'These smaller properties are like chillas, which are hardly of any size. However, the survey details are yet be finally published. At this point, there is no question of encroachment in the second Waqf survey because these properties are small. The issue of encroachment arises in relation to the first survey, after which it was found that over 75% of Waqf lands were encroached upon,' a senior official of the Telangana State Waqf Board (TGSWB) said.
According to official data, the first Waqf survey listed 33,939 institutions spread over a total of 77,538 acres. Of this, 57,423 acres were found to be encroached upon. However, sources within the Board speculate that the extent of encroachments may have increased since then to about 80% being encroached.
Now, with the new waqf legislation applying the Limitation Act, a move the Union government maintains will reduce prolonged litigation, members of the All India Muslim Personal Law Board (AIMPLB) have expressed concerns that this would enable encroachers to remain in possession of waqf land.
Speaking at a public meeting organised in New Delhi on Tuesday (April 22) to oppose the new legislation, Hyderabad parliamentarian Asaduddin Owaisi, who is also a member of the AIMPLB, quoted a document on waqf properties which he said was released by the Bharatiya Janata Party (BJP), and stated that a majority of properties were encroached upon.
'We want to ask the Prime Minister that when you have admitted that 70% of waqf properties have been encroached upon, you making encroachers owners by applying the Limitation Act. I am certain that in several States, they have already been made owners through land mutation,' he said.
A TGSWB official noted that with the Limitation Act now being applied, encroachers could seek ownership through adverse possession. If this happens, cases could be filed in civil courts rather than the Waqf Tribunal. However, this also raises other challenges, he said, even as he claimed that the case would not be as simple. These include establishing limitation, paying court fees, and filing appeals in case the Waqf institution or Board receives an adverse order.

Criticising the govt for bypassing public consultation and not bringing the bill before the legislative assembly, he said, "The draft was not made public, was not uploaded online, and no citizen feedback was sought." These committees include five school members—three teachers, one principal, and one management member—and parents chosen by lottery. The High Court of Karnataka on Wednesday reserved its order on the petitions filed by four representatives of Royal Challengers Sports Pvt. Ltd. (RCSPL) and DNA Networks Pvt. Ltd., who have questioned the legality of their arrest in connection with the June 4 stampede outside the M. Chinnaswamy Stadium in the city during the celebration of RCB's victory in IPL-2025 tournment. Justice S.R. Krishna Kumar, who heard the arguments on the petition, said he would pronounce the verdict on Thursday afternoon. The petitions were filed by Nikhil Sosale, head (Marketing and Revenue), RCSPL; Sunil Mathew, director, and Kiran Kumar, event manager of DNA; and Shamant N.P. Mavinakere, a freelancer with DNA. Earlier, State Advocate-General Shashi Kiran Shetty and Additional State Public Prosecutor B.N. Jagadeesha defended their arrest, claiming that the police adhered to all the procedures laid down in law and by the apex court while arresting them. 'No permission' Mr. Shetty said these four persons were among others connected with the RCSPL and DNA, who were responsible for making social media posts inviting cricket fans to come to the stadium for the victory celebrations, even though there was no permission to organise the event at the stadium. Also, the A-G said that neither the Karnataka State Cricket Association nor the RCSPL had sought permission under the provisions of the Licensing and Controlling of Assemblies and Processions (Bangalore city) Order, 2008, notified in 2009, for the event. The communications sent by the KSCA or others were only a mere intimation of the possible victory celebrations and no formal application, the A-G said while contending that in any case, the police had not granted permission to the victory celebrations held in the stadium, and hence it was illegal and punishable in law. Holding of illegal event led to the death of 11 persons in the stampede as the RSCPL had failed to manage the crowd, Mr. Shetty contended. On CM and Dy. CM While the A-G did not say anything on the court's query whether Chief Minister Siddaramaiah had stated at a media conference that he had ordered the arrest of officials of the RCB and others, the written statement filed by the police stated that contention of the petitioners, that their arrest was solely made on the Chief Minister's order, was not relevant for deciding the legality of their arrest. On the petitioners' claim that Deputy Chief Minister D.K. Shivakumar had participated in the celebrations in the stadium, the A-G said he was only an invitee and it was was the RCSPL which held the event without permission.
