The court was hearing the bail petition filed by Sridhar, the first accused in the case.
The special public prosecutor for CBI objected to the grant of bail to the petitioner. The counsel for Jeyaraj's wife, Selvarani, also opposed the grant of bail since there is an apprehension that he might tamper with the witnesses.
Taking into account the submissions, justice P Vadamalai reserved orders.
It maybe recalled that following the custodial deaths of the father-son duo at Sathankulam police station in Tuticorin district in 2020, 10 policemen (presently suspended), including Sridhar, SIs Balakrishnan, Raghu Ganesh, head constables Murugan, A Samadurai, constables M Muthuraja, S Chelladurai, X Thomas Francis, S Veilmuthu, and SSI Paldurai, were arrested.
Since Paldurai died of Covid-19, the CBI, after completing the investigation, filed the final report against nine policemen, and the trial in the case is underway before the I additional district court in Madurai. All the accused persons are lodged at the Madurai Central Prison.

SC stays trial against former Haryana IAS officer in Manesar land case

The Supreme Court has stayed trial proceedings against former Haryana IAS officer Rajeev Arora in the Manesar land deal, investigated by the Central Bureau of Investigation (CBI). The former IAS officer had petitioned the apex court after his revision petition challenging his summoning by a special CBI court was dismissed by the Punjab and Haryana high court on May 15. A special CBI court had on December 1, 2020 ordered that the former IAS officer be summoned to face trial for committing offence under section 120-B read with 420 of the Indian Penal Code (IPC) in the Manesar land matter. However, on a revision petition filed by Arora, the Punjab and Haryana high court on December 14, 2020 had stayed the operation and implementation of the order of the special CBI court. Rejecting the challenge to the special CBI court's December 1, 2020 order, the HC on May15 said it found no illegality or infirmity in the order passed by learned special CBI court in summoning the petitioners. An apex court bench headed by chief justice BR Gavai, however, on May 29 ordered that notice be issued to the respondents and 'proceedings qua the petitioner (Rajeev Arora) shall stand stayed till the next date of hearing.' During the trial court proceedings on Friday, Special CBI judge, Rajeev Goyal while referring to the apex court's order of May 29 ordered that proceedings against all the accused persons except Rajeev Arora shall commence. The special court in its June 6 order noted that it is, therefore, seen that all the accused except accused Dhare Singh, Kulwant Singh Lamba, DR Dhingra and Rajeev Arora, have been ordered to be charge-sheeted qua the offences as detailed in the order December 1, 2020. The court said that now arguments need to be advanced on charges in respect of accused Dhare Singh, Kulwant Singh Lamba and DR Dhingra. Learned defence counsels seek time to prepare the arguments. Learned senior public prosecutor Harsh Mohan Singh submits that charge-sheet may kindly be framed against the accused persons who have already been ordered to be charge-sheeted vide order dated December 1,2020. 'I am not able to accept the submission made by the senior public prosecutor as it will not be appropriate to frame charge-sheet before considering the case concerning framing of charges in respect of accused Dhare Singh, Kulwant Singh Lamba and DR Dhingra. In case, the court after hearing contentions of the said accused persons and senior public prosecutor for CBI, concludes that charges are required to be framed against said accused persons as well, then a consolidated charge-sheet qua all the accused persons shall be framed and in my opinion, it will be more appropriate if such a course is adopted, for framing charge-sheet in a piecemeal manner is not desirable. As such, to come up on July 10, 2025 for arguments on charge qua accused Dhare Singh, Kulwant Singh Lamba and DR Dhingra,'' ordered the special court.

Delhi Court Acquits Former Secretary HC Gupta In Coal Scam Case

New Delhi: A Delhi court on Friday acquitted former coal secretary HC Gupta, ex-joint secretary (coal) KS Kropha and then director KC Samaria in a coal scam case related to irregularities in the allocation of Mahugarhi Coal Block in Jharkhand. Today marks Gupta's second acquittal in coal block related cases whereas he has been convicted in five other cases and his appeals are currently pending in Delhi High Court. The CBI has also challenged his acquittal in the first case. There were total 19 cases filed by the CBI against Gupta, of which 12 are pending before trial courts. Special Judge Sanjay Bansal while pronouncing the verdict on Friday convicted JAS Infrastructure Capital Ltd and its then director Manoj Kumar Jayaswal for cheating and criminal conspiracy in securing coal block's allocation. The judge would hear arguments on sentencing on July 8. A total of 29 corruption cases filed by the CBI are currently pending before two special courts set up to try cases arising out of coal scam whereas 27 cases have been disposed of so far. On January 16, the Enforcement Directorate informed the top court that 45 complaints (ED's equivalent to a chargesheet), including supplementary ones, were pending under the PMLA. The top court in 2014 quashed 214 coal blocks allocated by the Centre between 1993 and 2010 after taking note of two PILs and had ordered a trial by a special CBI Judge. It later increased the number of the courts to two to try the scam-related cases. The CBI was represented by special public prosecutor R S Cheema, additional legal advisor Sanjay Kumar and public prosecutors A P Singh and N P Srivastava in the case. The CBI lodged the case on the reference of Central Vigilance Commission against officials of Ministry of Coal for alleged corruption in the matter of allocation of coal blocks to the private companies during period 2006-09. It was alleged in the FIR that JAS Infrastructure Capital Pvt Ltd and its Director Jayaswal had misrepresented/concealed facts in the application form in order to qualify and obtain wrongful gains/undue benefits in allocation of Mahuagarhi coal block. The CBI spokesperson in a statement on Friday said, "This is the 19th conviction in coal block allocation cases investigated by CBI. Initially, the CBI had filed final report (closure) in the case on November 20, 2014." The special court had previously taken cognisance and framed charges against JAS Infrastructure Capital Pvt Ltd, Manoj Kumar Jayaswal, H C Gupta, K S Kropha and K C Samaria. "The allegations in the case were that the accused private persons, namely the promoters of JAS Infrastructure Capital Pvt. Ltd, had made false and misleading claims regarding the financial net worth of the company," the CBI said. They further misrepresented the appraisal and syndication of debt by financial institutions, with a view to securing the wrongful allocation of a coal block, the CBI spokesperson said. The company, it was alleged, "deliberately concealed" material facts concerning the previous allocation of coal blocks to other group or associate companies in the application and feedback forms. "The company had also dishonestly projected the net worth of unrelated third-party companies- Inertia Iron & Steel Industries Pvt. Ltd. and IL&FS- as its own, both in its application and during the presentation made before the Screening Committee for the allocation of Mahugarhi Coal Block," the statement said. The CBI examined 18 prosecution witnesses in support of its case.

Ex-secy HC Gupta acquitted in coal block allocation case

NEW DELHI: A Delhi court on Friday acquitted former coal secretary H C Gupta, ex-joint secretary K S Kropha, and former director K C Samaria in a case linked to alleged irregularities in the allocation of the Mahugarhi coal block in Jharkhand. The case dates back to the coal allocation scam that shook the country a decade ago. For Gupta, this marks a second acquittal in coal block-related cases, though he has been convicted in five others. His appeals in those matters are pending before the Delhi High Court. The CBI, which has filed 19 cases against him, is also contesting his first acquittal. Twelve of those cases remain pending before trial courts. While the three former officials were cleared on Friday, Special Judge Sanjay Bansal convicted JAS Infrastructure Capital Ltd and its then director, Manoj Kumar Jayaswal, on charges of cheating and criminal conspiracy in relation to the same coal block. At present, 29 coal scam-related cases filed by the CBI remain pending before two special courts, while 27 have already been disposed of. Parallelly, the ED earlier this year had informed the Supreme Court that 45 complaints, equivalent to chargesheets under the PMLA, remain pending in connected proceedings.
