Chandigarh: The Punjab government on Thursday told the Punjab and Haryana high court that controversy surrounding release of additional water to Haryana was a case of 'institutional bullying' of Punjab, where Centre and other parties joined hands against one state.
Appearing for the Punjab government, senior advocate Gurminder Singh claimed before the high court bench of chief justice Sheel Nagu and justice Sumeet Goel that 'material facts' were concealed by the Centre and Haryana during proceedings in the court, following which the high court on May 6 directed the BBMB to release additional water to Haryana.
The submissions were made during the hearing of a plea filed by Punjab seeking recall of the May 6 order.
According to Singh, the high court was never informed of a statutory reference made by the BBMB chairman to the Centre on April 29 regarding the dispute over release of additional water. It was made at Haryana's behest on April 29 following a difference of opinion in the board meeting of April 28, where Punjab had opposed the move. It was then for the Centre to decide the issue in accordance with the provisions of Rule 7 of the BBMB Rules, 1974, he said, adding that the BBMB chairman, despite making the reference to the Centre, presided over a meeting the next day on April 30 and 'chose to conceal and remain silent'.
The high court was also kept in the dark about the meeting presided over by the Union home secretary on May 2, which became basis for the May 6 order, he said further claiming that 'nothing' about the meeting was circulated to the parties concerned and even the purpose of the meeting was 'misrepresented'.
It was not about release of additional water but related to law and order, he said. The concealment of facts was not accidental but deliberate, Singh claimed adding that these things had a bearing on the court proceedings, which led to passing of the May 6 order.
The BBMB had approached court 'in garb' of an aggrieved seeking redressal of grievances regarding security. But the real intent was to seek 'stamp of approval of an illegal act', he further submitted.
The Centre and Haryana are to make their submissions on Friday. However, before the hearing could end on Thursday, additional solicitor general Satya Pal Jain responded by saying that there was no concealment and misrepresentation of facts by Centre. 'Punjab is making attempts to get rid of the high court orders (of May 6),' Jain added.
On May 6, the high court directed Punjab government to not interfere with the functioning of the BBMB and abide by the Union home secretary's May 2 decision which asked the BBMB to release additional 4,500 cusecs of water to Haryana. The HC order had come on a plea from the BBMB seeking withdrawal of Punjab cops from Nangal dam alleging that they were interfering with the working of board.
The Punjab government on May 14 moved high court seeking recall of the order arguing that the Union power secretary is the competent authority to deal with disputes around water sharing under the BBMB Act, and not the Union home secretary.
The controversy erupted on April 28 when the Haryana government's demand for additional water from the Bhakra dam was approved by the BBMB despite opposition from Punjab. The Punjab government refused to accept the decision and deployed police at Nangal dam, 13km downstream from Bhakra, to stop the additional water release.
The Union home ministry stepped in on May 2 and directed that additional water be released to Haryana. However, the BBMB said that the order could not be complied with as the Punjab Police prevented board officials from discharging their duties.
The BBMB was established by the Union power ministry in 1966 under Section 79 of the Punjab Reorganisation Act, which regulates water distribution from Bhakra, Nangal, Pong, and Ranjit Sagar dams between Punjab, Haryana, Himachal Pradesh, Delhi and Rajasthan.

The statement of the Union minister shows that the government is giving priority to strategically important projects. That is, the government wants to complete these projects as soon as possible. This will bring many benefits to the country. Electricity will be available, irrigation will take place and the water problem will also be solved. However, this news is no less than a nightmare for Pakistan . Because, as India establishes its control over the water of the Indus river basin, the flow of water going towards it will decrease.

Centre defends OCI cancellation in HC

New Delhi: The Centre has defended in the Delhi High Court its decision to cancel the OCI card of US-based journalist Raphael Satter saying he maligned Indian institutions in the international arena through journalistic activities. The Centre said it was satisfied that Satter conducted journalistic activities without waiting for necessary permission and violated the government's notification and that a 'discreet' lookout circular (LOC) was opened against him. 'It has been reported by security agencies that Raphael has been noted for acts of maliciously creating adverse and biased opinions against Indian institutions in the international arena through his journalistic activities and a discreet LOC was opened against him,' the Ministry of Home Affairs said in an affidavit. The Centre said that his revision petition was as a result disposed of and a speaking order dated May 24, 2024 held that there were no grounds to revise the overseas citizen of India (OCI) cancellation order. The Union ministry's affidavit came in response to Satter's plea against the cancellation of his OCI card. Justice Sachin Datta, who is hearing the matter, granted liberty to Satter to file a rejoinder to the government's reply and posted the hearing on August 25. Satter obtained the OCI status through his marriage and claimed he visited India for family purposes. The Ministry said it was brought to its notice through security agencies that Satter had attended Nullcon conference in Goa in September 2022 and the focus of the conference was to showcase the next generation of offensive and defensive security technology. Without necessary permission, he attended the conference and conducted journalistic activities, therefore, violating the provision of the ministry's notification, it said. OCI card holders or other foreigners visiting India, it said, were supposed to adhere to the laws of the country, meaning, the activities they are prohibited from under the category of visa or OCI guidelines. 'An OCI cardholder is a foreigner and OCI card is a life-long visa issued to such a foreigner. Every country has a sovereign right to refuse entry into its territory to any individual whom it may consider undesirable and informing about the same inasmuch as entry into any country's territory is not a matter of right, even if the person holds a valid visa,' the affidavit said. Citizens of India, the government said, were guaranteed fundamental right of speech and free movement, but foreigners or citizens of other countries were not entitled to such rights. Since OCI card holders are foreigners and citizens of another country, they cannot claim the right to free speech, movement and protest under the Article 19 of the Indian Constitution, the ministry added. It came on record that before initiating cancellation of the OCI proceedings, the ministry consulted security agencies and also the Ministry of External Affairs. After examining the petitioner's activities, his OCI card was found liable to be cancelled. 'Therefore, on June 12, 2023, this ministry (MHA) served a 'notice' to the petitioner through the High Commission of India in Washington DC to showcause as to why his OCI card may not be reports received from security agencies are 'secret' in nature, therefore, it cannot be disclosed to the petitioner,' the affidavit said. Though Satter submitted his reply to the ministry notice, the government claimed, he did not submit documents to establish he did not carry out any journalistic activity aside from showing his whereabouts and activities during his India visit. The MHA, however, said the reports received from the security agencies and the MEA provided 'enough inputs' indicating he had 'willfully violated' the provision of the 2021 notification. Satter, in his revision petition filed in January, 2024 before the MHA under the Citizenship Act, challenged his OCI cancellation order of December 4, 2023. On April 23, 2024 he claimed of not having carried out any journalistic activity, but the ministry claimed otherwise.
