Protection from revealing identity must be extended to all victims of sexual offences; not just rape and POCSO Act cases, T.N. govt. tells Madras HC
Appearing before Justice N. Anand Venkatesh, the SPP said, the judicial magistrates in the State could also henceforth direct the police to submit the First Information Reports (FIRs), related to all kinds of sexual offences, only in sealed covers in order to prevent disclosure of identity.
The SPP pointed out Section 72 (a corresponding provision to Section 228A of the Indian Penal Code) of the Bharatiya Nyaya Sanhita (BNS) prescribes a two year prison term for those who print or publish any matter which had revealed the identity of victims of select offences.
Section 72 states the identity of the victims of rape, gang rape, sexual intercourse by husband upon his wife during separation, sexual intercourse by a public servant by misusing official authority and sexual intercourse by employing deceitful means should not be printed or published.
Further, the Supreme Court in the famous Nipun Saxena versus Union of India case, decided in December 2018, had ordered that the identity of victims of rape and Protection of Children from Sexual Offences (POCSO) Act offences should not disclosed in print, electronic as well as social media.
The top court further ordered that FIRs related to such offences should not be made available in the public domain and that the police must keep all documents, containing the identity of the victim, in a sealed cover. The orders were issued to all States and Union Territories in the country.
Mr. Jinnah suggested this protection need not be confined only to victims of rape and POCSO offences and that it could be extended to victims of all kinds of sexual offences. He made the submission during the hearing of a writ petition filed by a woman advocate against circulation of her private videos in the internet.
Representing her, senior counsel Abudu Kumar Rajaratnam told the court the Union Ministries of Housing and Urban Affairs, Home Affairs and Electronics and Information Technology had convened a national conference on 'Making Cities Cyber Secure' in New Delhi on July 18, 2025.
The conference had brought together key stakeholders to address growing cybersecurity challenges and discussed the appointment of Chief Information Security Officers (CISOs). Mr. Rajaratnam said, the CISOs could serve as nodal officers to help women whose private images and videos reach the internet.
After recording the submissions made by the SPP and the senior counsel, Justice N. Anand Venkatesh granted time till August 5 for the Ministry of Home Affairs to come up with a Standard Operating Procedure (SOP) to be followed for assisting women facing agony due to cyber threats.
During the course of hearing of the case, the judge said: 'Though sexually explicit private videos of men also get circulated on the internet, no man ever bothers about that. It is the only the women who suffer because of the way in which the society treats them and makes them feel ashamed.'

Hyderabad: A case of illegal surrogacy and sperm trafficking racket has been busted in Secunderabad, leading to the arrest of ten people, including a doctor - Dr Namrata - who was the manager of Universal Srushti Fertility Centre in Regimental Bazaar. The crackdown comes after a complaint from a distraught couple who discovered, through independent DNA testing, that the child born to a surrogate arranged by the clinic was not genetically related to them. Hyderabad North Zone DCP Rashmi Perumal said the operation allegedly involved luring poor people into surrogacy and the illicit inter-state transfer of reproductive materials. The elaborate cheating racket came to light when a couple from Rajasthan, now residing in Secunderabad, lodged a formal complaint with the police. It was discovered that the clinic was allegedly involved in the illegal collection and transportation of sperm and eggs to other states, including Gujarat and Madhya Pradesh. The fertility centre was found to be collaborating with an unlicensed firm named Indian Sperm Tech. As the probe widened, police arrested Pankaj Soni, the regional manager of Indian Sperm Tech, along with six other individuals identified as Sampath, Srinu, Jitender, Shiva, Manikantha, and Boro. These individuals are believed to have been actively involved in sourcing and shipping reproductive material across states. DCP Rashmi Perumal said Dr Namrata had collected over Rs 35 lakh from the aggrieved couple for surrogacy services. It was also revealed that a woman was brought from Hyderabad to Visakhapatnam by flight for the delivery, with Dr Namrata allegedly convincing the couple that the baby born to this woman was theirs through surrogacy. Investigations indicate that Dr Namrata lured poor people to act as surrogates. The authorities are now working to uncover the full extent of this illicit operation, including potential violations of the Assisted Reproductive Technology (Regulation) Act, surrogacy laws, and other medical ethics regulations. Officials suspect that more fertility centres and agents may be involved in this widespread network.

Two nuns among three held in Chhattisgarh over ‘forced religious conversion', ‘human trafficking'

Rave party busted in Hyderabad's Kondapur; 9 people arrested, 2 absconding
Nine people were arrested on Saturday night for allegedly planning to organise a rave party at an apartment in Kondapur area of Hyderabad. Based on intelligence inputs, the Prohibition and Excise Department's State Task Force conducted a route watch and busted the drugs party in Kondapur area. The key accused, who organises drug parties, along with other accused — peddlers, from Andhra Pradesh had booked a service apartment for the proposed party, reported news agency PTI citing an official. The STF team has seized 2.080 kg of dry ganja, 50 grams of OG Kush (hybrid ganja), among other narcotic substances and LSD blot papers from the possession of the accused, which were meant for the rave party, besides six vehicles, the official said. According to the report, a case has been registered against 11 people. Nine accused have been arrested, while two others are absconding. Further probe into the matter is underway. Meanwhile, Pune Police arrested seven persons after busting a "drug party" following a raid at an apartment on Sunday and seized narcotics, hookah set ups and liquor. The raid was conducted around 3.30 AM on Sunday and a "drug party" was busted at the studio apartment, Deputy Commissioner of Police (Crime) Nikhil Pingle said at a press conference. During the raid and subsequent search, the police seized 2.7 grams of a cocaine-like substance, 70 gm of a ganja-like substance, a hookah pot, various hookah flavours, and liquor and beer bottles, Pingle said. Pranjal Khewalkar, the husband of former Maharashtra minister Eknath Khadse's daughter Rohini Khadse, was among those arrested. "We have arrested seven individuals, identified as Pranjal Khewalkar, Nikhil Poptani, Sameer Sayyad, Shripad Yadav, Sachin Bhombe, Isha Singh and Prachi Sharma, under relevant sections of the Narcotic Drugs and Psychotropic Substances (NDPS) Act," the DCP said.
