New Delhi, Apr 29 (PTI) The Supreme Court on Tuesday said the welfare of children was 'paramount' in the legal battles over their custody between estranged parents.
The high court granted the interim custody of two minor children for 15 days every month to the father, but the apex court called arrangement 'unfeasible' and 'detrimental' to the children's well-being.
The verdict came on an appeal by the mother, a software professional, who challenged the high court's interim custody order in favour of the estranged husband, a general manager at a construction company in Singapore.
The couple married in 2014 and has two children — a daughter born in 2016 and a son born in 2022.
They have been living separately since 2017 following marital discord though a brief reconciliation in 2021 led to the birth of their second child.
The father approached a family court in Thiruvananthapuram in June 2024 seeking permanent custody of the children under the Guardians and Wards Act.
The family court granted the father limited visitation rights — including monthly in-person visits and weekly video calls.
The high court modified the custody arrangement, allowing the father 15 days of physical custody each month, provided he fulfilled certain conditions like renting a flat in Thiruvananthapuram, hiring a nanny, and arranging transportation for the children.
The high court also granted video call access to the parents when the child was in the other's custody.
Setting aside the order, Justice Mehta, writing the judgement for the bench, said, 'The interim arrangement is neither feasible nor conducive to the well-being, mental and physical, of the children.' The arrangement, the court said, failed to consider the developmental needs of the children, particularly the need for stability, nutrition, and emotional security.
'However, at the same time, we cannot lose sight of the fact that the respondent is a doting father who has shown his keen desire to have an equal and effective parenting role in the upbringing of his children. Thus, depriving him of the custody of the children in entirety is neither acceptable nor justifiable and may destroy all chances of family bonding,' it said.
The bench said the father will have custody of the daughter on alternate Saturdays and Sundays each month and on these days, he may also meet the son for up to four hours under supervision of a child counsellor.
Permitted the father to make video calls to children on every Tuesday and Thursday for 15 minutes, the bench directed the family court to expedite the ongoing custody battle under the guardianship laws. PTI SJK SJK AMK AMK

ST bus services launched for 15 remote villages in Gadchiroli for first time
Gadchiroli, Aug 19 (PTI) In a bid to boost connectivity to remote areas, the police, in collaboration with the Maharashtra State Road Transport Corporation (MSRTC), have launched bus services to 15 villages in Maoist-affected Gadchiroli district. For the first time since Independence, bus service has been started to Mouza Ambezari, around 100 km from the district headquarters and 21 km from the previously connected village of Katezhari, a release from the office of the Gadchiroli Superintendent of Police stated. As part of a campaign to improve public infrastructure and accessibility, bus services to 15 remote villages were launched on Monday. The new bus route connects Gadchiroli district headquarters to Chatgaon, Dhanora, Yerkad, Murumgaon, Khedegaon, Ambezari, Mangewada, Jaisinghtola and Malewada, and will benefit 15 villages, the release said. The service is expected to ease challenges faced by residents, particularly in accessing healthcare, education, and government services throughout the year, it said. Villagers welcomed the first bus by playing traditional musical instruments and celebratory dances, while school children greeted it by waving the national flag. Palghar police on alert after containers from cargo drift into Arabian Sea
Maharashtra's Palghar police were put on alert on Monday following a message from the higher authorities about the probable drifting of some containers from a cargo ship in the Arabian Sea, news agency PTI reported, citing officials. Online monitoring mandatory for waste-to-energy plants and landfills: CPCB
Agency: Last Updated: New Delhi, Aug 19 (PTI) The Central Pollution Control Board has directed all state pollution control boards and pollution control committees to install Online Continuous Emission and Effluent Monitoring System (OCEMS) at waste-to-energy plants and sanitary landfill sites to strengthen surveillance and ensure compliance with environmental standards. The order dated August 12 asked states to submit 'action taken reports' on the status of waste-to-energy units by August 18. It said that all operational and upcoming municipal solid waste incineration-based waste-to-energy plants must install and operate OCEMS for real-time tracking of pollutants such as particulate matter, sulphur dioxide, nitrogen oxides, hydrogen fluoride, hydrogen chloride and carbon monoxide. Similarly, all waste-to-energy plants and landfill sites are required to put in place OCEMS for treated leachate, tracking parameters such as pH, total suspended solids, biochemical oxygen demand, chemical oxygen demand, ammoniacal nitrogen and fluoride. The Central Pollution Control Board (CPCB) has also made it mandatory for sanitary landfill sites to be equipped with surveillance cameras at entry and exit points and inside active working areas to prevent illegal dumping and improve transparency. The CPCB said that waste-to-energy plants and landfill sites are significant sources of leachate and air emissions which, if not managed as per norms, can have serious environmental impacts. A large amount of fly ash and bottom ash is also generated at waste-to-energy units, which has to be managed under prescribed conditions. The board said several matters related to waste-to-energy plants and solid waste disposal are under consideration in the National Green Tribunal, high courts and the Supreme Court, making strict monitoring necessary. 'Considering the growing need for remote and continuous environmental surveillance, it is necessary to bring waste-to-energy plants and sanitary landfill sites under online continuous monitoring regimes," CPCB chairman Vir Vikram Yadav said in the order. The state pollution control boards and pollution control committees have been asked to acknowledge the directions and submit compliance reports on installation and connectivity of monitoring systems within 30 days.
