IndiGo Fined Rs 1.5 Lakh For Providing "Unhygienic, Dirty" Seat To Passenger

A Delhi consumer forum has held Indigo Airlines guilty of deficiency of service for providing an unhygienic and stained seat to a woman and directed it to pay a compensation of Rs 1.5 lakh for the discomfort, pain, and mental agony she suffered.
The New Delhi District Consumer Disputes Redressal Commission, comprising its president Poonam Chaudhry and members Bariq Ahmed and Shekhar Chandra, was hearing a complaint filed by Pinki, alleging that she was provided an "unhygienic, dirty and stained" seat while she was travelling from Baku to New Delhi on January 2 this year.
Pinki alleged that her complaint regarding the issue was treated in a "dismissive and insensitive manner".
Countering the claim, the airlines said that they took cognisance of the issue faced by Pinki and assigned her a different seat, on which she willingly travelled and completed her journey to New Delhi.
Noting the evidence before it, the forum, in an order dated July 9, made available recently, said, "We hold that the opposite party (Indigo) was guilty of deficiency in service." "As regards the discomfort and pain, mental agony suffered by her, we are of the view that she must be compensated. We accordingly direct the opposite party to pay Rs 1.5 lakh as compensation for mental agony, physical pain and harassment to her," the forum added.
It also directed payment of Rs 25,000 as litigation expenses.
In its order, the forum said that the airlines had failed to produce the Situation Data Display (SDD) report, which formed a part of its internal operational records as per standard aviation protocols.
It said, "There is no reference to this report in the written statement or in the evidence filed by the opposite party. The SDD is a crucial document used for flight operation monitoring and to record passenger-related incidents. The absence of this document significantly weakens the opposite party's defence."

It held that entitlement to compensation does not hinge solely on financial dependency. 'It would be anomalous to state that a person may lose a dear one and merely because the legal representative is not dependent, he or she would be confined to the no-fault liability amount… This would be a travesty of justice," Justice Singh observed. In upholding the compensation awards, the court directed the state to release the money within 60 days, including any outstanding sums and interest. The tragedy occurred on April 24, 2009, when Aftab Husain and his son Tanveer Husain were travelling on a motorcycle near Bahad Gram Khushalganj in Kakori, Lucknow. Their motorcycle was hit by a truck allegedly driven in a rash and negligent manner. Both father and son suffered grievous injuries and were rushed to the Trauma Centre at the Medical College in Lucknow. Aftab died on the day of the accident, while Tanveer succumbed to injuries a week later. Tabassum, the only surviving legal heir, filed two separate claims for compensation. The Motor Accident Claims Tribunal awarded her Rs 2,13,200 for her father's death and Rs 1,60,400 for her brother's, each with 6 percent annual interest. The state government, however, contested these awards arguing that as a married daughter, Tabassum was not financially dependent on her father or brother. It maintained that she was entitled only to the Rs 50,000 no-fault compensation under Section 140 of the Motor Vehicles Act, 1988. Further, the court noted that the claim of financial independence should not preclude full compensation. It pointed out that some earlier rulings, including Deep Shikha v National Insurance Co Ltd, had overlooked binding precedents that affirm the rights of legal heirs to claim compensation regardless of their dependency status. The court clarified that while dependency can affect the amount awarded, it cannot limit the right to claim compensation. The judgment also took into account the claimant's specific circumstances. Tabassum had submitted evidence that her husband worked abroad in Dubai and she was receiving support from her father and brother. Mohali: After nearly nine years of legal proceedings, the court of the additional district and sessions judge acquitted additional SHO sub-inspector (SI) Shivdev Singh, posted at Nabha police station, in a bribery case registered by the Vigilance Bureau in 2017. The Vigilance Flying Squad One team from Mohali had arrested Shivdev in April 2017 on charges of accepting a bribe of Rs 5,000 from Sandeep Kumar, a resident of Jujhar Nagar, Mohali. Kumar alleged that the amount was demanded in exchange for filing a favourable report to facilitate the release of his seized car. According to case records, Kumar and a friend were booked under the Arms Act by Nabha police in April 2017, and their car was impounded. About a month later, both secured bail and moved the court for the vehicle's release. The court directed the police station concerned to submit a report. Kumar alleged that when he approached Shivdev for the report, the officer demanded a bribe. Kumar claimed he refused to pay and lodged a complaint with the Vigilance Bureau, which then laid a trap and reported catching the cop red-handed with the marked currency. However, during the trial, the prosecution failed to prove that the bribe was actually taken. The court also noted in its observations that there was a prior rift between the complainant and a vigilance inspector, raising questions over the case's credibility.
