Setback for Patanjali as HC orders to pull 'disparaging' ads against Dabur
Justice Mini Pushkarna issued the order after finding that the contested advertisements were problematic under the law governing commercial speech and product representation.
Ramdev-led ad campaign at the centre of controversy
The case stems from an advertisement featuring Patanjali Ayurved's co-founder Ramdev, who is shown casting doubt on the authenticity of competing Chyawanprash brands. According to the lawsuit, the ad shows that only Patanjali's Chyawanprash is "original", while others are shown as lacking the requisite Ayurvedic and Vedic knowledge to manufacture authentic formulations.
The ad states: " Jinko Ayurved aur Vedo ka gyaan nahi, Charak, Sushrut, Dhanwantari aur Chyawanrishi ke parampara mei 'original' Chyawanprash kaise bana payenge?' (Those who don't have knowledge of Ayurved and Ved, how will they make 'original' Chyawanprash in the tradition of Charak, Sushrut, Dhanwantari and Chyawanrishi).
Representing Dabur, senior advocate Akhil Sibal had argued that Patanjali's claims mislead consumers and harm Dabur's market reputation. He cited the Drugs and Cosmetics Act, under which Ayurvedic formulations such as Chyawanprash must conform to legally mandated compositions based on classical texts, Bar and Bench reported.
Sibal pointed out that Dabur holds a commanding 61.6 per cent share of the Chyawanprash market, and unsubstantiated claims about the product's authenticity directly impact its consumer trust and brand credibility.
Targeting Dabur's '40+ herbs' tagline
A particular point of contention was Patanjali's reference to a '40-herb Chyawanprash' as 'ordinary'. Dabur contended that this was a veiled reference to its own product, which is marketed with the '40+ herbs' tag. The company argued that the remark amounted to triple disparagement — misleadingly presenting Patanjali's formulation as superior, casting doubt on Dabur's Ayurvedic adherence, and positioning its product as inferior.
Dabur added that all Chyawanprash products are governed by strict regulatory standards, and such advertising tactics erode public trust in the entire category.
Not the first time
This is not the first legal battle between the two rivals. In September 2017, Dabur had approached the court against Patanjali for allegedly running disparaging ads and using a product design similar to Dabur's Chyawanprash packaging, which it claimed could mislead consumers.

HC dismisses plea challenging Bescom's smart meter mandate
Bengaluru: The Karnataka High Court has dismissed a writ petition questioning the compulsory installation of smart meters by the Bangalore Electricity Supply Company (Bescom). After several rounds of hearings, Justice M. Nagaprasanna's single-judge bench delivered its final order, rejecting the petition filed by Jayalakshmi and P.M. Harish. The court noted that the Advocate General had already given an assurance that old meters would not be forcibly replaced. Furthermore, a Public Interest Litigation (PIL) raising the same issues is currently pending before a divisional bench. Since the PIL contains the same grounds as the writ petition, the single-judge bench held it inappropriate to decide the matter separately. The case originated when Jayalakshmi, a resident of TB Narayanappa Layout in Doddaballapur, applied to upgrade the power connection in her newly constructed house from single-phase to three-phase. Bescom officials insisted she install a smart meter, issuing her a written notice. Challenging this, she moved the High Court, alleging the mandate was arbitrary. During earlier hearings, the court had temporarily stayed the installation and sharply questioned the state's rationale for the policy. Justice Nagaprasanna had asked government counsel whether free power schemes were being used as a justification and, if so, how poor consumers would be protected. The bench had also issued notice to Bescom's counsel to respond to the objections. With today's order, the writ petition stands dismissed, and the matter will now be addressed through the ongoing PIL. The decision effectively means that, while smart meters remain part of Bescom's plan, their compulsory imposition on existing consumers is not legally sanctioned at this stage — pending the outcome of the larger PIL proceedings.

HC rejects petitions against Karnatakas smart meter mandate
Agency: PTI Bengaluru, Aug 13 (PTI) The Karnataka High Court on Wednesday dismissed two petitions challenging the state government's decision to mandate the installation of smart pre-paid electricity meters for new consumers, despite concerns over their high cost compared to neighbouring states. Justice M Nagaprasanna, who reserved orders on July 22, noted that a Public Interest Litigation (PIL) raising similar issues is already pending before a division bench. 'Judicial discipline demands hierarchy, and propriety requires this court to show judicial hands off to the present petitions. Therefore, the subject petitions are not entertainable," the judge said. The court also recorded an earlier submission from Advocate General Shashi Kiran Shetty that the state would not compel the petitioners to install smart meters in their residences since these were not new connections. During earlier hearings, the bench had remarked on the stark price difference between Karnataka and other states, observing, 'Everywhere else it is Rs 900 for the same smart meter, here you are charging Rs 8,900 — where will poor people go? You have outsourced the work; this is dangerous. You are squeezing the poor." An interim order had been issued then, preventing the state from making smart meters compulsory in situations not covered by the Karnataka Electricity Regulatory Commission (Pre-paid Smart Metering) Regulations, 2024. Representing one of the petitioners, Senior Advocate Lakshmy Iyengar argued that the policy would eventually affect all consumers, questioning the tender process and highlighting the financial burden when other states offer the same meters at a fraction of the cost. Advocate General Shetty, however, maintained that the requirement applies only to new households, not to existing electricity consumers.
