Justice Vikas Mahajan in a ruling delivered on Tuesday, criticised the school's failure to provide adequate support, observing that its actions amounted to a denial of the child's statutory right to inclusive education.

'No child can be deprived merely due to the institutional unwillingness to adapt. It needs no emphasis that 'inclusive education' is not merely about access to education; it is about belongingness. It is also about recognising that every child has a place in the classroom not because they are the same, but because they are different, and that difference enriches the learning environment for all,' the judge ruled.
The girl was initially admitted to GD Goenka School in 2021. After being diagnosed with mild autism in 2022, her mother requested a shadow teacher or special educator to assist her. The school, however, failed to provide the necessary support, pressuring the family until they withdrew her in January 2023.
In the 2024-25 session, she was again allotted a seat at GD Goenka under the children with special needs (CWSN) category, but the school refused admission. A subsequent allotment at Maxfort School, Pitampura, was also denied. Her parents then approached the Delhi High Court, seeking enforcement of her right to education.
The school, represented by advocate Kamal Gupta, opposed the petition, arguing there were no vacancies in the general or CWSN categories and that right to education must be weighed against seat limitations and institutional readiness.
He further argued that right to education in a neighbourhood or special school was contingent upon availability and suitability, and cannot override seat limitations or institutional readiness.
Rejecting the school's defence, the court held in its 28-page verdict that its conduct reflected a regressive approach. 'Her behaviour, flagged by the school, should have triggered support. Instead, the school's response was one of distancing,' the order noted. 'The actions of the school reveal an institutional approach that failed to evolve in consonance with the needs of the petitioner as a person with disabilities.'
Welcoming the decision, the girl's lawyer, Ashok Agarwal, called it a landmark judgment. 'This verdict fulfils the constitutional promise of inclusive education. Disabled children have been sidelined for far too long—this ruling is a vital corrective,' he said.

According to sources, the government will follow the established legal framework and initiate the next steps accordingly. Panel Report Calls for Resignation The in-house panel, comprising Punjab and Haryana High Court Chief Justice Sheel Nagu, Himachal Pradesh Chief Justice GS Sandhawalia, and Karnataka High Court's Justice Anu Sivaraman, submitted its findings to Chief Justice of India Sanjiv Khanna on May 4. The committee was formed on March 25, days after firefighters allegedly stumbled upon large sums of unaccounted cash while responding to a fire at Justice Varma's Delhi home. Sources cited in a Bar & Bench report said the findings of the committee were damning and recommended that Justice Varma be given the option to resign immediately. If he refuses, the report will be forwarded to the President of India, triggering the formal process for judicial removal. This development marks a rare and serious moment for the Indian judiciary, with the government now poised to initiate one of the most stringent constitutional processes available for judicial accountability. The Madhya Pradesh High Court on June 30 set aside a trial court order from over 25 years ago that had deemed Saif Ali Khan, his sisters and mother as the successors to the properties in appeals by heirs of the elder brother of the erstwhile Nawab of Bhopal. The heirs of erstwhile Nawab Hamidullah Khan of Bhopal, who passed away in 1960, as well as those of his elder brother, were seeking partition and succession of the private properties as per Muslim Personal Law (Shariat) Act, 1937, as was in force at the time of the then Nawab's death, and moved trial court in this regard in 1999. Begum Suraiya Rashid, heir of Obaidullah Khan, the elder brother of the erstwhile Nawab of Bhopal Hamidullah Khan, and Qamar Taj Rabia Sultan, the Nawab's heir, represented by Advocate Aadil Boparia, filed appeals challenging a trial court order in 2000. The court decreed two personal properties in favour of the heirs of Sajida Sultan, the second daughter of Nawab Hamidullah, and Saif's paternal grandmother. Sajida was declared Nawab following Hamidullah's death, and she died in 1995. The decision of the trial court had come in partition suits moved by the heirs of the Nawab's family in 1999. After 25 years of the appeals being heard before the Jabalpur bench of the Madhya Pradesh HC, Justice Sanjay Dwivedi, in an order on June 30, allowed them. The bench, however, remanded all the parties back to the trial court, and granted the liberty to move an appropriate application before the trial court. The appellant heirs contended that the trial court erroneously assumed that the private properties of the Nawab are part of the throne and will thus automatically pass on to the successor to the throne. They argued that the properties have nothing to do with succession, and the partition of the properties will be governed by the personal law of succession. Concurring with the appellants' submissions, the Madhya Pradesh High Court said, '…The matters need to be remanded back to the trial Court for deciding it afresh because these are the suits for partition. And if ultimately, the trial Court comes to the conclusion that suits have to be allowed, then the share of the parties can be determined only by the trial Court while passing the preliminary decree, and that can be further finalised by the trial Court itself after carrying out the necessary formalities of partition.' 'Thus, in my opinion, the impugned judgment and decree deserve to be and are hereby set aside….It is made clear that since the suits were initially filed in the year 1999, therefore, the trial Court shall make all possible efforts to conclude and decide it expeditiously, preferably within a period of one year,' added the court.

Crackdown in Haryana 50% revenue officials to face chargesheets

Over 100 tehsildars and naib tehsildars in Haryana are set to face chargesheets for executing land deals allegedly in violation of rules, with Chief Minister Nayab Singh Saini approving the action. Around 50 per cent of the total working strength of tehsildars and naib tehsildars in the state are accused of registering residential plots without mandatory clearances for the past few years. Currently, 58 tehsildars and 156 naib tehsildars are posted across Haryana's tehsils to oversee various types of land transactions. The sanctioned strength is higher — 96 for tehsildars and 219 for naib tehsildars. According to sources, the Haryana Revenue Department had initially proposed action against 45 tehsildars, 61 naib tehsildars, 14 district revenue officers (DROs), and nine Haryana Civil Services (HCS) officers — bringing the total to 129. However, chargesheets have now been approved against 118 of them, while no action has been deemed necessary against 11 officers. Officials who executed more than 50 land registrations will face charges under Rule-7 of the Haryana Civil Services (Punishment & Appeal) Rules, 2016. This rule allows for major penalties, including dismissal, removal, or compulsory retirement from service. Those who executed fewer than 50 registrations will be charged under Rule-8, which provides for minor penalties such as censure, withholding of promotion, or increment. As per existing regulations, revenue officers are required to register agricultural land—especially land falling within municipal committee jurisdictions—only after obtaining clearance from the Town and Country Planning Department and the respective municipalities. In such cases, a No Objection Certificate (NOC) under Section 7-A of the Haryana Development and Regulation of Urban Areas (Amendment) Act, 2017 is mandatory. 'But these officers executed the registration of land without due clearance. Final action following issuance of chargesheet will be taken after examining their replies,' a senior state government officer told The Indian Express. Sources revealed that agricultural land was sold for residential colonies or industrial use without obtaining CLUs (Change of Land Use), allegedly to evade heavy stamp duty and other charges. 'The same process was adopted for registration of residential plots,' said an official. However, a revenue official highlighted the practical challenges faced by tehsildars. 'Many of these cases of plots were those which already have all basic amenities including roads and streetlights. In several of the cases reached for registration and sale of the plots were those already having registration of the land concerned. What was the fault of a tehsildar if the land concerned had already a land registration document,' the official said. The latest decision to chargesheet revenue officers comes less than a month after the state government approved similar action against 80 officials from the Irrigation Department, following the failure of multiple construction material samples from ongoing irrigation projects in quality tests
