Defence Ministry To Develop System To Monitor Contract Performance

KUALA LUMPUR, July 23 (Bernama) -- The Ministry of Defence will develop a contract monitoring system to enhance efficiency and transparency in the management of asset and project procurement, including earlier enforcement of actions against project delays.
Deputy Defence Minister Adly Zahari said the move followed findings in the Auditor-General's Report (LKAN) 2/2025, which highlighted weaknesses in the enforcement of contract terms, particularly concerning the issue of late penalties.
He said that under the ministry's current procurement system, penalties for delays were only imposed when extension of time (EOT) applications were considered, even though enforcement could have taken place earlier.
'An EOT should come with two scenarios — either with or without a late penalty. Sometimes EOT is granted without a penalty due to technical issues… but I believe if an EOT is to be granted, we can enforce it with a penalty.
'We acknowledge the weakness in enforcing contract terms, so we are in the process of developing a contract monitoring system to assist officers in tracking contracts,' he said when winding up the debate on LKAN 2/2025 for the ministry in the Dewan Rakyat today.
Commenting on the findings in the Auditor-General's Report (LKAN), Adly said the ministry had issued a late penalty notice amounting to RM162.75 million on Jan 15 to the supplier of 68 Gempita armoured vehicles and two type B vehicles (non-armoured), following delivery delays between 2020 and 2023.
He said the company had submitted a response letter and appealed for the penalty to be waived, citing force majeure due to the COVID-19 pandemic and the Russia-Ukraine conflict.
'The appeal was presented at the Contract Coordination Panel (CCP) meeting on May 6 and it was decided that the company would be subjected to the full late penalty of RM162.75 million.
'Secondly, the performance bond amounting to RM53.93 million and the remaining penalty will be recovered either by set-off from the current contract or collected separately from the company,' he said.

During the conversation, Anwar briefed the Vietnamese leader on Malaysia's initiatives as Asean Chair to address escalating tensions along the Cambodia-Thailand border. He emphasised Malaysia's commitment to promoting dialogue and ensuring solidarity and unity in handling the issue. Anwar called on Cambodia and Thailand to exercise restraint, refrain from the use of force, and resolve differences peacefully and satisfactorily in accordance with international law, the UN Charter, the Asean Charter, and the Treaty of Amity and Cooperation in South-East Asia. Chinh, for his part, expressed appreciation for the frequent exchanges between the two leaders on matters of mutual concern, stating they reflected the growing political trust between Vietnam and Malaysia, which exemplifies the spirit of their Comprehensive Strategic Partnership. He hailed the efforts by Anwar, as well as Malaysia, the Asean Chair this year, in promoting the settlement of the Cambodia-Thailand border tensions. He specifically highlighted the July 28 meeting organised between the Cambodian Prime Minister and the Acting Thai Prime Minister, which led to a ceasefire agreement-the first positive step towards controlling the escalation of conflict between the two countries. Vietnam always supports and stands ready to join Asean's efforts and work closely with Malaysia in addressing regional issues while upholding the bloc's solidarity, he said, highlighting that Vietnam is prepared to send representatives to Asean-led mechanisms to ensure the implementation of the ceasefire and to provide humanitarian assistance to affected people in both countries. Regarding bilateral cooperation, the two Prime Ministers agreed to continue exchanges aimed at strengthening trust and implementing measures to deepen their Comprehensive Strategic Partnership. Priority areas include enhanced collaboration in innovation, science and technology, and energy sectors, with particular focus on power transmission projects connecting Vietnam, Malaysia, and Singapore to form the Asean power grid. The leaders also discussed expediting the signing of a rice trade agreement, enabling Vietnam to support Malaysia in ensuring food security. Rafizi lauds Economy Ministry for retaining reforms in 13MP

KUALA LUMPUR: Former Economy Minister Rafizi Ramli has expressed his appreciation to the staff of the Economy Ministry for ensuring that the key reforms initiated during his tenure were retained in the 13th Malaysia Plan (13MP), which was tabled in the Dewan Rakyat today. In a statement today, Rafizi said that although he has not gone through the document in full, an initial reading of the executive summary shows that around 95 per cent of the reforms developed during his time in office have been preserved in the plan. "All the major reforms, spanning education system restructuring, economic structure reform, and focus on new agendas such as ageing populations and the development of the third sector, have been retained," he said. Rafizi also noted that many key economic initiatives launched during his tenure, including the National Energy Transition Roadmap (NETR), KL20, Johor-Singapore Special Economic Zone (JSSEZ), "Made by Malaysia" branding, and the shift towards a "consumption powerhouse" economic model, remain part of the plan. He added that new policies yet to be announced, such as the Special Tourism Investment Zones (STIZ) and efforts to advance carbon capture, utilisation and storage (CCUS), were also included. Rafizi highlighted that controversial measures like the proposed Government Efficiency Commitment Act and legislation to ban the 'Ali Baba' business practice had also been retained, despite earlier resistance. "God willing, I will comment on each aspect in the coming week, but let me first go through the document thoroughly," he said. Rafizi is expected to debate the plan in Parliament next Monday or Tuesday. He also plans to discuss it in detail on his "YBM" podcast on Aug 8, joined by economist Dr Muhammad Khalid. Throughout August, Rafizi intends to analyse the key sectors and chapters of the 13MP to help the public understand the policy directions outlined. "With this, one major responsibility that my colleagues and I at the Economy Ministry have carried since November 2022 is complete — drafting a long-term plan for a better future for all Malaysians," he said. He thanked the entire team at the ministry for their dedication over the past 20 months. "They worked under tremendous pressure, especially amid last-minute speculation of a Cabinet reshuffle. Thankfully, that proved to be just political noise. It means the ministry's leadership succeeded in defending the importance of keeping long-term national planning separate from day-to-day political turbulence." Rafizi concluded by stressing that while the planning phase is complete, the next big challenge is ensuring that the initiatives are implemented effectively, regardless of which party is in power. "My prayer is that the rakyat will be the ones who benefit most in the years to come."
