Tejashwi again threatens poll boycott over voter list row

Patna: Amid raging controversy over the special intensive revision (SIR) of electoral rolls in Bihar, leader of opposition in the state assembly, Tejashwi Prasad Yadav, on Wednesday reiterated that the INDIA bloc could boycott the upcoming assembly elections.
He said it was a matter of grave concern that the names of lakhs of poor voters were deleted from the electoral rolls, while BJP leaders allegedly managed to "procure" two voter ID cards—a lapse the
Election Commission
(EC) failed to detect during the SIR drive.
Talking to reporters here on Wednesday, Tejashwi said they would go to the masses in the course of the "Vote Adhikar Yatra" and assess the prevailing situation in the countryside before deciding whether they should join the poll process.
"After the yatra, we will seriously consider whether to participate in the assembly elections or not. When the EC has already decided everything, it can also be considered that we do not participate," Tejashwi said, adding it was strange that the EC is yet to reply to the issues flagged by them.
"The overall situation in the country is very strange. Neither PM Narendra Modi and CM Nitish Kumar nor the chief election commissioner comes before the media to address the issues.

This is a very dangerous situation for democracy in the country," he said, wondering if they should repeatedly rush to the court for every single issue. "The EC is behaving like Mauni Baba (a silent spectator)," he alleged.
Alleging the EC is "robbing votes" at the behest of the BJP, the RJD leader issued documents to highlight how senior BJP leader-cum-Muzaffarpur mayor Nirmala Devi also possesses two separate EPICs, quite like her two brothers-in-law.
"She has two EPIC numbers with different ages and her name figures in the electoral rolls at two different booths in the same assembly constituency in Muzaffarpur district. The EC is clearly working to help the BJP.
How did this happen? What kind of SIR is this?" Tejashwi asked.
Meanwhile, the electoral registration officer of the Muzaffarpur assembly constituency on Wednesday issued notices to Nirmala Devi and her two brothers-in-law, Manoj Kumar and Dilip Kumar, asking them to send their responses by Aug 16 before further action could be taken against them.
Tejashwi also rejected the "charisma" of the PM, alleging the BJP has clung to power by "stealing votes" of the people. "Earlier, the BJP used agencies like the ED, CBI, and IT to get votes, but now when these agencies have failed in their mission, the BJP has now indulged in 'dacoity of votes' with the help of the BJP," he alleged.

The Supreme Court on Thursday asked the Election Commission of India (ECI) to inform about the documents considered during the 2003 intensive electoral roll revision in Bihar. A bench of Justices Surya Kant and Joymalya Bagchi, which resumed the hearing on a pleas challenging the June 24 ECI decision to conduct the special intensive revision (SIR) in the state said, "We would like ECI to state what documents were taken in 2003 exercise". The remarks came after advocate Nizam Pasha, appearing for one of the parties, said referred to the court reportedly saying "if the date of January 1, 2003 (the date of earlier SIR) goes then everything goes". "I must submit that nothing was there to show why this date is there The impression sought to be conveyed is that it is the earlier date when the intensive exercise for revision of the electoral roll was held. It is stated that the EPIC (voter) card issued then is more reliable than issued during summary exercises conducted from time to time, is incorrect," Pasha said. Pasha asked if the process of enrolling under intensive and summary revisions was the same then how could EPIC cards issued under summary exercises be discarded. The lawyer, therefore, said the date of 2003 was invalid and not based on intelligible differentia (basis of distinguishing the two situations). "No receipt of my enumeration form is being given or any documents acknowledging the receipt is given and therefore the booth level officers have an upper hand and these lower level officers have too much discretion on whether the form has to be taken or not," he said. Senior advocate Shoeb Alam, appearing for another petitioner, pointed out insufficient reasons in the ECI notification saying the process invented was neither "summary" nor "intensive" but just a creation of the notification. "This is a process of voter registration and cannot be a process of disqualification. This is a process to welcome and not turn this into a process to unwelcome," he said. The top court on August 13 observed electoral rolls cannot remain "static" and there is bound to be a revision, the top court said the expanded list of acceptable documents of identity from seven to 11 for Bihar's Special Intensive Revision (SIR) of voters' list was in fact "voter-friendly and not exclusionary." As the row over the SIR escalated, the bench said the EC had the residual power to conduct such an exercise as it deemed fit. The bench also disagreed with a submission by a petitioner that the SIR of electoral rolls in poll-bound Bihar had no basis in law and ought to be quashed. Leaders of opposition parties including the Rashtriya Janata Dal (RJD) and the Congress and the NGO Association of Democratic Reforms (ADR) have challenged the electoral roll revision drive in Bihar.

The Election Commission on Thursday served notices to LJP (Ram Vilas) MP from Bihar's Vaishali Veena Devi and her husband Dinesh Singh, a JD(U) MLC, for allegedly possessing two voter ID cards each, an official said. The EC's action came hours after RJD leader Tejashwi Yadav alleged that the couple possessed two voter ID cards each. "The Electoral Registration Officer (ERO) for Muzaffarpur assembly constituency has sent notices to the MP and her husband asking them to submit their replies to the EC over the issue of possessing two voter ID cards by August 16," the official said. Yadav, the leader of opposition in the assembly, shared purported screenshots of draft electoral rolls published following the Special Intensive Revision (SIR), claiming that the NDA MP and the MLC have two voter cards each. "Is it not a case of fraud, manipulation, and collusion by the Election Commission to ensure a victory for BJP-NDA?" he asked. Speaking to reporters, Veena Devi claimed, "I don't know how my name has appeared in the electoral rolls of the Muzaffarpur assembly seat. I am a registered voter of the Sahebganj assembly seat only. I came to know about it through the press." Alleging that the anomaly has happened due to irregularities committed by election officials, she said she has submitted a form for deletion of her name from the rolls in Muzaffarpur. "Let Tejashwi Yadav say whatever he wants... Since he is in the opposition, he will say all such things against the leaders of the ruling parties," she said.

New Delhi: While the police were yet to arrest anyone in connection with the vandalism of a mausoleum in Fatehpur's Abu Nagar locality, a one-kilometre radius has been cordoned off with barricades around the site to prevent any further communal flare-up. On Tuesday (August 13), police booked more than 150 people, 10 of them named, for damaging public property and disturbing the peace, according to news agency PTI. The 10 named in the FIR are Dharmendra Singh (Bajrang Dal), Abhishek Shukla (BJP), Ajay Singh (district panchayat member), Devnath Dhakad (BJP), Vinay Tiwari (municipal councillor), Pushpraj Patel, Rithik Pal (BJP), Prasoon Tiwari (BJP), Ashish Trivedi and Pappu Chauhan (Samajwadi Party). Meanwhile, locals have been barred from talking to outsiders and media entry has been banned. Police in plainclothes are roaming areas near the mausoleum, interacting with locals and monitoring the activities. On August 11, a violent confrontation erupted in Fatehpur, after a mob from various Hindutva bodies stormed a centuries-old mausoleum in Abu Nagar, hoisted saffron flags on it, performed Hindu rituals inside and vandalised graves in the presence of security forces. It was followed by stone-pelting and clashes with members of the Muslim community, triggering a political outcry and raising questions about law enforcement in Bharatiya Janata Party-ruled Uttar Pradesh. According to the PTI report, while the vandals are yet to be arrested, police have arrested the Congress city president, Arif alias Gudda, and his several supporters, for holding a protest demanding the arrest of the vandals. Meanwhile, the party's district president, Mahesh Dwivedi was placed under house arrest when a party delegation comprising two former MLAs planned to visit the site. Dwivedi called the police action 'dictatorial' and accused the administration of acting as a 'silent spectator' while the vandalism had happened. Samajwadi Party MP Naresh Uttam Patel said he had sent a letter to Union home minister Amit Shah, demanding an investigation by an independent agency into the matter.
