'This is despite the fact that he is very much alive and continues to perform his duties regularly,' the order noted, highlighting the department's failure to update records on the portal of Haryana Kaushal Rojgar Nigam (HKRN), the agency streamlining the recruitment process for employees in various government departments.
'The Commission is reminded of the well-known sentiment from Shakespeare's play namely Julius Caesar, wherein it is suggested that the dead may, at times, wield greater influence than the living. The present matter, however, reflects a grim inversion of that idea—a person who is unquestionably alive and faithfully performing his duties has, for official purposes, been treated as deceased,' noted the order by the panel comprising Chairperson Justice Lalit Batra and Judicial Member Kuldip Jain.
This erroneous classification, the order stated, not only deprived Kumar of lawful remuneration but also caused 'undue financial strain and emotional distress' to him and his family.
The panel flagged it as a violation of human rights, particularly the right to livelihood and dignity under Article 21 of the Indian Constitution, and Article 7 of the United Nations's International Covenant on Economic, Social and Cultural Rights (ICESCR), which ensures 'just and favourable conditions of work, including remuneration that ensures a decent living'.
Finding prima facie evidence of 'administrative negligence,' the panel observed a 'striking contradiction': the department's records declare Kumar 'deceased,' yet his 'daily presence at the workplace and faithful discharge of duties bear living testimony to the contrary'. Such inaction, it added, undermines a person's 'right to work with dignity and creates avoidable hardship and uncertainty'.
The HHRC directed immediate action, calling for reports from the additional deputy commissioner, Rohtak, and the commissioner and secretary of the Citizen Resources Information Department (CRID), on updates to Kumar's Aadhaar card.
It also instructed executive engineer Sandeep Kumar, engineer-in-chief, Public Health Engineering Department, Panchkula; and superintending engineer, Rohtak, to submit a detailed report within four weeks on correcting records, disbursing pending salaries, and ensuring departmental accountability.
The case is listed for next hearing on September 23.

'The teams are scrutinising lapses in KYC compliance, procedural violations in account opening, the role of bank employees, and any sign of negligence,' the statement said. As part of the drive, raids were conducted in Karnal and Yamunanagar districts on Tuesday, during which bank records were thoroughly checked and suspicious accounts examined. In Yamunanagar, teams of the Cyber Crime Wing traced a current account of a firm that was officially shut down in March, yet transactions worth Rs 43 lakh were carried out afterwards. Nationwide, eight complaints have been registered against this account, the statement further said. Another current account was found to have been opened on a false address, and transactions worth Rs 2 crore were made in just three months. This account has 33 complaints filed against it across the country. 'The role of account holders and the bank staff concerned are under scanner… This operation will not remain confined to just two districts. Similar raids will be extended to other suspicious bank branches in the coming days,' the statement said. 'In such situations, citizens must never share their OTP, ATM PIN, UPI PIN, passwords, or personal documents like Aadhaar and PAN, nor scan any unknown link or QR code,' he said. Kabiraj said banks and government agencies never ask for money transfers or sensitive information over the phone. Without an official identity, families face constant harassment, repeated rejection at government offices, and a life of invisibility, despite court rulings that essential services cannot be denied for want of Aadhaar. Aadhaar is a 12-digit individual identification number issued by the Unique Identification Authority of India on behalf of the Government of India. The number serves as a proof of identity and address in India. The Aadhaar number remains valid for life. Many services, including banking, phone, and government departments ask for it. Rajashri Yewale, a supervisor with Pune-based Swadhar Institute for Development of Women & Children, a non-profit organisation working in slums and settlements, received a call from an Aadhaar Seva Kendra official. 'The Aadhaar card officer enquired about the children who do not go to school. He reached out to me after reading the newspaper report in The Hindu. He assured me that he will look into the matter,' Ms. Yewale said. In November 2024, the NGO prepared a list of 136 children without Aadhaar cards in various settlements and submitted it to the various government departments in the State. By August 2025, 16 children migrated with their parents. Ms. Yewale said for over one year, they had tried to address the issue by reaching out to various government departments but nothing happened. Later in the evening, the same day, NGO coordinator Kalyani Jagtap also received a call from the same officer, who sought details of the affected families and children. 'He shared his Email id and asked me to submit the list of children who require an Aadhaar card along with other government documents such as birth certificates. I have submitted a list of 120 children to him. The officer has given assurance to address it at the earliest,' she said. For every child On Monday (August 18, 2025), the NGO also received calls from the Education Department. 'The officials asked us what we needed. We told them we want not just enrolment, but also government documents created — birth certificates, Aadhaar, voter ID, and bank accounts — for every parent and child. They assured us that the children would be registered on the Maharashtra Education Department's Systematic Administrative Reforms for Achieving Learning (SARAL) portal and will be benefited by the direct beneficiary transfers that will allow them to receive uniforms, stationery, notebooks and allowances under the Right to Education Act,' Ms. Jagtap added. SARAL portal asks for every student's Aadhaar, as it helps link students to government schemes such as scholarships, free uniforms and textbooks.

The Indian Council of Social Science Research (ICSSR) on Tuesday said it will issue a show cause notice to the Centre for the Study of Developing Societies over an erroneous claim made by Sanjay Kumar — professor and co-director of Lokniti, a research programme at the CSDS — in a social media post that two constituencies in Maharashtra had shown a significant fall in the numbers of voters between the Lok Sabha and Assembly polls last year. The ICSSR, which operates under the aegis of the Ministry of Education, is the government's apex body for research in social and human sciences. The CSDS is supported by the ICSSR. On August 17, Kumar had posted on X that Ramtek and Devlali in Maharashtra had shown 36-38% decrease in number of voters between the Lok Sabha and Assembly polls in Maharashtra. On Tuesday, he apologised for the post. 'I sincerely apologize for the tweets posted regarding Maharashtra elections. Error occurred while comparing data of 2024 LS and 2024 AS. The data in row was misread by our Data team. The tweet has since been removed. I had no intention of dispersing any form of misinformation,' Kumar said in a post on X. The ICSSR accused CSDS of 'data manipulation' to create a 'narrative with the intention of undermining the sanctity of the Election Commission of India'. 'It has come to the notice of ICSSR that an individual holding responsible position at CSDS, an ICSSR-funded research institute, has made media statements that had to be retracted subsequently citing glitches in data analysis regarding elections in Maharashtra. Further, the institute has published media stories based on biased interpretation of the SIR exercise by the Election Commission of India. ICSSR holds the Indian Constitution in highest esteem. Election Commision of India is a high constitutional body which has been holding free and fair elections in the largest democracy of world for decades together. ICSSR takes serious cognizance of the data manipulation by CSDS and its attempt to create a narrative with the intention of undermining the sanctity of the Election Commision of India. This is a gross violation of the grant-in-aid rules of ICSSR, and ICSSR shall issue a show cause notice to the institute,' it said in a post on X. Earlier in the day, the Bihar Chief Electoral Officer also weighed in on the issue. 'CSDS Sanjay Kumar apologized for the tweet posted regarding Maharashtra Assembly elections. He said that error occurred while comparing data of 2024 LS and 2024 AS. His tweet is deleted now but a screenshot is attached. His data was quoted by many INC & Opposition leaders for questioning EC,' the CEO said on X. Addressing a press conference, the BJP alleged that Kumar's post on X was used as propaganda by the Congress to discredit the electoral process. BJP spokesperson Gaurav Bhatia said Kumar deleted the post after 40 hours, during which the wrong data was used as 'propaganda' by Congress leaders Pawan Khera and Rahul Gandhi. 'Congress leader Pawan Khera tweets on this and then deletes. Rahul Gandhi's baseless allegations are also based on CSDS data,' Bhatia said. He said 34,000 people viewed Kumar's post before it was deleted. 'They call themselves a survey agency but are puppets in the hands of leaders like Rahul Gandhi. They (Congress) want an agency to publicise fake data. This is a factory, a machine of dishing out lies,' he said. The BJP accused Leader of Opposition in Lok Sabha Rahul Gandhi of making 'false and baseless allegations of vote chori' against the Election Commission, in collusion with the CSDS. Reacting to this, Khera said: 'This is called clutching at straws. The BJP ecosystem knows pretty well that they have been caught red-handed indulging in vote chori.'
