Prosecution claims Porsche crash accused using delaying tactics in court
Currently, the court is hearing arguments for framing of charges against 10 accused involved in the swapping of blood samples of the 17-year-old juvenile, who fatally knocked down two IT professionals while driving a Porsche car allegedly under the influence of alcohol in May last year. The prosecution on Friday concluded its arguments seeking that charges be framed against all accused citing it has conclusive DNA evidence to prove the minor boy's blood samples were swapped with those of his mother at the state-run Sassoon General Hospital.
All 10 accused, of whom nine are currently in jail, were equally involved in the conspiracy, it told the court. Defence lawyers representing the 10 accused, including the boy's father, were supposed to begin their arguments in the case on Wednesday. "A couple of accused have moved applications seeking a copy of the chargesheet. In my argument over their plea, I told the court the prosecution has already provided them a chargesheet copy. However, the defence told the court the prosecution has given them only a part (of the document) which is regarding the charges against them. But we told the court that a full chargesheet has been provided to all accused," said Special Public Prosecutor in the case Shishir Hiray. Such applications are "frivolous" in nature and the accused are deliberately using delaying tactics, he contended. Meanwhile, Sudhir Shah, a defence counsel representing Dr Ajay Taware, one of the 10 accused, while opening his argument on framing of charges, noted IPC sections 467 and 464 (dealing with forgery and making false documents) have been invoked against his client. These two sections were not applicable to Taware as he did not indulge in any forgery, Shah maintained.
"Our client was not present at the Sassoon General Hospital when the blood samples were allegedly swapped and the report was tampered with. The section (related to forgery) is applicable to only those who have done forgery and not against the one who has instructed that person to do so," he argued. In the early hours of May 19, 2024, a Porsche allegedly driven by a 17-year-old boy, son of a well-known realtor, in an inebriated condition knocked down and killed two IT professionals, Anish Awadhiya and his friend Ashwini Costa, who were riding a two-wheeler in Kalyani Nagar. Currently, the juvenile's father, Sassoon Hospital doctors Ajay Taware and Shrihari Halnor, hospital staffer Atul Ghatkamble, two middlemen Bashpak Makandar and Amar Gaikwad, and three others are lodged in jail in connection with the alleged swapping of the juvenile's blood samples to conceal his intoxication at the time of the crash. The minor boy is facing separate proceedings before the Juvenile Justice Board.

Rape and punishment: On the life sentencing of Prajwal Revanna
Powerful perpetrators are rarely made accountable for their actions, and in that backdrop, the conviction and life sentencing of Prajwal Revanna, former Janata Dal (Secular) Member of Parliament and grandson of former Prime Minister H.D. Deve Gowda, for a heinous crime comes as a relief. This is the first of the four cases of rape and sexual harassment against the 34-year-old Gowda scion. The former Member of Parliament had raped a 48-year-old domestic worker twice at the family's homes in Hassan and Bengaluru in 2021, and recorded it on his mobile phone. In April 2024, ahead of the general election, explicit clips of his sexual misdemeanours were leaked through pen drives strewn across public places in Hassan, the Gowda home town. In the videos, Revanna's face is not visible, only the women's, a gross violation of their safety and privacy. The former help and other women came forward with their complaints but their agony was far from over. Using political muscle, and aided by his parents, former Minister H.D. Revanna and Bhavani Revanna, he did his best to arm twist the system, threatening a survivor, trying to stop her from testifying. But a Special Investigation Team (SIT) worked with alacrity and he was finally arrested in May 2024. The SIT filed the first charge sheet in August 2024. The video, where the domestic worker is seen pleading with Prajwal Revanna to spare her, DNA analysis and her testimony formed key evidence in the trial which began in May this year. The Special Court of Sessions to hear criminal cases against former and present Members of Parliament and MLAs pronounced the verdict on August 1. The speedy trial and conviction will give hope to other survivors battling for justice in sexual assault cases. The court convicted Revanna on all charges framed against him, including under Sections 376(2)(n) (repeated rape on the same woman), 506 (criminal intimidation), 201 (disappearance of evidence) of the Indian Penal Code (IPC) and 66E (violation of privacy) of the Information Technology Act, 2000. Section 376(2) of the IPC states that a person convicted under it 'shall be punished with rigorous imprisonment for a term which shall not be less than 10 years, but which may extend to imprisonment for life....' Often, even when multiple complaints are raised, leaders with political clout get away. The laws are in place. All that the government machinery needs to do is act swiftly and sensitively, and create a safe space so that survivors of sexual abuse can come forward without fear.

6 ‘associates' of Bishnoi acquitted in attempt to murder case
The Chandigarh District Court has acquitted six persons, reportedly associates of gangster Lawrence Bishnoi, due to lack of evidence in an attempt to murder case. Those acquitted are Monty Shah of Burail, Parvinder Wadhwa, Deepak Wadhwa, and Virendra Soni from Hanumangarh (Rajasthan), and Vinay Kalyan and Mohit Kumar from Kalka (Haryana). A seventh accused, Kuldeep Singh Ghosal, passed away during the trial, and thus proceedings against him were stopped. All of them were booked five years ago under IPC Sections 307 (attempt to murder), 120B (criminal conspiracy), and various sections of the Arms Act by the Sector-34 police station. The case was filed based on a complaint by Tirath Singh, who had alleged that the accused had tried to kill him and the brother of slain cable operator Sonu Shah, Parveen. However, during the trial, the complainant turned hostile and refused to identify the accused in court. Advocate Palwinder Singh Lucky, who represented Vinay, Parvinder, and Deepak, argued that the police had falsely implicated his clients and that they were not even present at the crime scene. He accused the police of fabricating a story to frame them. As per allegations, Tirath Singh, a resident of Burail and business associate of Sonu Shah and his brother Praveen, was targeted shortly after Sonu's murder on September 28, 2020. Tirath had alleged that Monty Shah, holding a pistol, tried to kill him and Praveen, owing to personal enmity. He recounted that around 11.30 pm, while he was on a call outside his office, Monty approached him with a pistol. Tirath managed to escape into his office as shots were fired. Monty and his accomplices then fled in a car. Based on Tirath's statement, the police had arrested Monty and the other accused. But with the complainant retracting his testimony in court, all accused have now been acquitted.
