He has pleaded not guiltyThe captain of a boat that burst into flames off the coast of Hart Island in the Bronx has been charged with three counts of operating a vessel while under the influence of alcohol or drugs.
Nearly two dozen people were injured after the vessel caught fire on the evening of Saturday, June 7.
Officers observed Joshua Brito, 33, 'to have watery eyes and a strong odor of an alcoholic beverage emanating from his breath," according to a criminal complaint obtained by PEOPLE.
Brito admitted to driving the Carver 35 yacht and allegedly told a police captain that, 'I had one beer,' per the complaint.
He also allegedly told authorities that he 'picked up the group at World Fair.'
'I had an issue with the boat two days ago,' he allegedly said, according to the complaint. 'I disconnected the generator.'
Social media footage of the incident showed a large boat with massive pillars of black smoke billowing off of it as it floated in the Long Island Sound.

The NYPD's Harbor Unit, Aviation and Drone Team rushed to the scene, along with the New York Fire Department (FDNY) and EMS.
The yacht caught fire sometime after 8 p.m. local time.
Three people were pulled out of the water and nineteen others were able to swim to Hart Island, according to the FDNY, ABC 7 reported.
It is not immediately clear what caused the incident.
According to police, Brito's blood alcohol content was .05 when a chemical test analysis was administered at Jacobi Hospital around 10 p.m., per the complaint.
Brito was arraigned and released Monday, June 9. He entered a not guilty plea.
Another court date is scheduled for July 22.
His attorney could not be reached for comment.

QUEENS, N.Y. (PIX11) — A trio of alleged moped thieves has been terrorizing riders in Queens for the past few months, police said Tuesday. The suspects have allegedly threatened riders with a knife before taking their mopeds in a spate of incidents from June to August, according to the NYPD. The spree started when a 27-year-old man riding a moped was hit in the head with a chain and robbed at knifepoint on 107th Street at around 11:30 p.m. on June 30, police said. EMS staff treated the victim at the scene for minor injuries. The trio struck twice on Aug. 7 when they ambushed moped riders on Linden Boulevard and then again on 103rd Street and Rockway Boulevard. The suspects allegedly took the victims' keys and rode off on the stolen mopeds, police said. The men allegedly stole two more mopeds on July 20 near 101st Street and Drew Avenue and 122nd Street and Liberty Avenue, cops said. There were no injuries in the July and August incidents. Police are still searching for the suspects. Slain NYPD officer's wife gives birth to another son: 'Their father's legacy of service'
The wife of a slain New York City Police Department officer killed in a mass shooting at a Manhattan high-rise last month gave birth to the couple's third child this week, the agency announced. 'Out of tragedy, a new life has entered this world,' NYPD Police Commissioner Jessica Tisch wrote in a Monday, Aug. 18 post on X. 'Last night, Jamila Islam, the wife of Detective First Grade Didarul Islam, gave birth to their beautiful son, Arham.' A nearly four-year NYPD veteran, Islam was killed in a mass shooting on July 28, in a skyscraper where he was working a paid security detail. At the time of his death, in a statement on the precinct's social media, city leaders called Islam 'a husband, father, and dedicated public servant' and said he was survived by two young sons and his wife, who had been expecting the couple's third child. In the commissioner's birth announcement on Monday, she wrote the newborn boy joins two big brothers, Ahyan and Azhaan. 'Together, they will carry forward their father's legacy of service and courage − a legacy the NYPD will guard and uphold with the same devotion Didar gave to this city,' Tisch wrote. Widow of police officer killed in New York mass shooting gives birth to 3rd child
The widow of the off-duty police officer who was killed in a mass shooting last month in New York City's Midtown Manhattan gave birth to the couple's third child on Sunday. New York City Police Commissioner Jessica Tisch shared the news in an X post Monday, writing, "Out of tragedy, a new life has entered this world. Last night, Jamila Islam, the wife of Detective First Grade Didarul Islam, gave birth to their beautiful son, Arham." Didarul Islam, 36, was one of four people killed in the mass shooting that unfolded at 345 Park Avenue on July 28 in the office building's lobby and upper floors. The building is home to the headquarters of the NFL, the offices of private equity company Blackstone, real estate firm Rudin Management and other companies. Islam was off duty at the time and working a security job when he was fatally shot. Tisch included two family photos in her post, one of newborn Arham swaddled in a blanket and another of Ahyan and Azhaan smiling as one of the brothers holds his new sibling. "Arham joins his two big brothers, Ahyan and Azhaan," Tisch continued. NYPD investigators stated last month that they were working to determine a motive behind the shooting, but said Tamura left a note claiming he suffered from chronic traumatic encephalopathy, or CTE, a brain disease marked by repeated blows to the head and often linked to military veterans and athletes, like football players. In addition to Didarul Islam, three others -- Blackstone executive Wesley LePatner, security guard Aland Etienne, and Rudin Management employee Julia Hyman -- were killed in the mass shooting.
