A tiny pooch was fatally struck by an e-bike in a sidewalk hit-run on the Upper East Side on Memorial Day weekend – but the dog's grieving owner says she can't get justice for the pup because of a loophole in state law. Local resident Sarah Grant's 18-month-old shih tzu-poodle mix Fennel – who Grant rescued in December – was out with a dog walker when she was struck on the sidewalk by an e-bike rider on East 96th Street near Third Avenue in Manhattan just before 6 p.m. that Sunday, her owner said. 'She was not very responsive,' Grant told The Post, recalling the moment her dog walker rushed Fennel back to her nearby apartment building. 'Her eyes rolled back into her head, and she was barely moving. It was just heartbreaking.' Fennel sustained a traumatic brain injury and severe skull fracture and was euthanized hours later. Grant said when she attempted to report the incident as a crime with the NYPD, she was told she couldn't, as the incident wasn't a criminal matter — because dogs are only considered property under the law. 'I pushed back. If dogs are property, then this is a property crime,' Grant said. 'And they [still] said, 'No, you cannot submit a report.'' She said she was told only her dog walker — who was also injured in the incident — could file a report. A rep for the NYPD told The Post that Grant can still file a police accident report and a complaint report for the e-bike driver leaving the scene of the accident. 'This is a wake-up call for me,' Grant said. 'I've always had pets, and it's an oversight that there is no legal recourse. 'Setting a car on fire is considered to be a worse felony than setting a dog on fire.' The legal loophole is already the subject of a state bill introduced in January by Assemblywoman Linda Rosenthal (D-Manhattan). The bill seeks to swap the 'property' classification of such animals to 'sentient beings' and establish that they can be a victim of a crime. The bill has remained in committee since its introduction. A 'sentient being is one who perceives or responds to sensations of whatever kind—sight, hearing, touch, taste, or smell,' according to Merriam-Webster's dictionary. The Mayor's Office of Animal Welfare told The Post it is looking into the matter in conjunction with other city agencies. 'We are heartbroken to hear about Fennel and are in touch with her family,' a rep for the office told The Post. In addition to championing Rosenthal's bill to reclassify animals as 'sentient beings' under the law, Grant is calling for more enforcement for pedestrians safety on Gotham's sidewalks, where any form of biking is illegal for riders over the age of 12. 'Whether that's for humans or pets, it needs to be a bigger priority,' Grant said of the issue. 'An e-bike at that speed is deadly. I think people need to have a license and prove they have an understanding of traffic law in order to drive them.' 'This incident is exactly why Police Commissioner Tisch issued new enforcement and guidance on 14 high-traffic, high-volume e-bike corridors throughout the city to protect all New Yorkers from reckless e-bikes,' a rep for the NYPD said. Janet Schroeder, director and co-founder of the NYC E-Vehicle Safety Alliance, which has called for the registration and licensing of e-bikes, told The Post that Fennel's passing is 'incredibly sad' and 'infuriating' — but not surprising. 'The fact that the e-biker fled is also expected,' she said. 'The rider flees the crash scene the majority of the time and therefore the rider can't be held accountable because they can't be identified.' Schroeder said Fennel's untimely death is yet another reason city legislators must pass the proposed Priscilla's Law, a 'common-sense solution' requiring license plates on e-vehicles 'so that egregious riding can be identified by enforcement cameras and riders held accountable to following the basic rules of the road which will change egregious riding behavior.' In 104 e-bike-related crashes that Schroeder's group recorded, only four riders remained at the scene, according to the coalition — and in only six cases were crashes logged by the NYPD. 'This is a public-health crisis, and there is blood on the hands of any legislator who continues to do nothing but talk,' Schroeder added. Fennel's tragic passing comes just weeks after the mauling of chihuahua pup Penny on the Upper West Side by a pair of pitbulls sparked public outcry over how the city and state handle animal-related crimes. As dogs are considered property under state law, police often don't get involved unless a human is attacked or a human owner participates in crimes against dogs — and justice for Penny has yet to be served as well, animal advocates say. '[From] East Harlem to Brooklyn, there are people who … have the same concern: Somebody has dogs who attack other dogs, and nobody does anything about it,' city Council Member Gale Brewer told The Post this month. 'The agencies try, but they operate in a silo. We need to have everyone working together.' Grant said, 'I think if people knew and understood the ramifications of [the law], it would help galvanize action. 'I don't want any money out of this — I just want accountability, I want the laws to change,' she said. 'I don't want any other people to have to go through what I'm going through.'

Here, I'm using pork neck fillet instead of the more commonly known tenderloin. Neck fillet is a highly prized cut in Spain. It's beautifully marbled and, while not as tender as the tenderloin, packed with flavour. I highly recommend asking your butcher for neck fillet – it's a cut well worth seeking out. Ingredients 4x 1in-thick pork neck fillet steaks (150-180g each) 1 tsp crushed fennel seeds vegetable or corn oil 120g frozen peas 120ml vegetable stock 2 sprigs of mint 2 good knobs of butter ½ tbsp red wine vinegar 2 tbsp rapeseed oil 4 handfuls of salad leaves preferably with some pea shoots 150g sugar snap peas and mange tout, trimmed and halved into lozenges Method Step Season 4 x 1in thick pork neck fillet steaks with 1 tsp crushed fennel seeds and some salt and pepper. Step Heat and oil a ribbed griddle pan (or heavy duty pan) and cook the pork over a medium heat for about 5-7 minutes on each side. Cook the pork for a few more minutes if you prefer it a little more well done. Remove from the griddle and set aside to rest for a few minutes. Step Meanwhile, in a saucepan cook 120g frozen peas with 120ml vegetable stock for about 2 minutes. Add a couple sprigs of mint and cook for 1-2 minutes more. Drain, reserving 1-3 tbsp of the stock. Step Add the drained peas with a couple of knobs of butter to a processor and pulse briefly to crush the peas and create a rough puree – adding a little stock if necessary. Season to taste and transfer to a pan to warm back up. Step Mix ½ tbsp red wine vinegar and 2 tbsp rapeseed oil with some seasoning. Step In a large bowl, add 4 handfuls of salad leaves with 150g sugar snap peas and mangetout and toss through the dressing to coat.

A selection of starters and pastas at Opto in New York's Flatiron District. When celebrated Venice, California restaurant Gjelina arrived in New York late in 2022, it was one of the biggest openings of the year with lines out the door onto Bond Street. The closing came quickly, however: a month later due to a fire and 10,000 gallons of water from the Fire Department to put it out. Two years and massive rebuilding later, though, it officially reopened in December serving vibrant dishes to a lively (especially on expansive restaurant's second floor) crowd. A selection of dishes at Gjelina. The focus, as ever, is local produce which as various critics have pointed out gives the Venice version an advantage during the winter. But New York's head chef Jake Epstein doesn't agree. 'We remain committed to creativity, regardless of the season's bounty,' he explains. 'In New York, the winter months often mean working with farms that rely on longer-storing vegetables like celery root, storage beets and carrots, cabbages, and cultivated mushrooms. Working with farms as true partners means standing by them through the more scarce months, just as much as we enjoy the abundance of spring, which we can currently say is a breath of fresh air. And yes, when the moment felt right, we couldn't resist bringing in a bit of California citrus to brighten things up.' A selection of pizzas at Gjelina. That means diners who go in now will find vivid dishes such as with Sugar Snap Peas with Kalamata Olive, Fennel and Mint; Asparagus with Romesco, Pecorino and Lemon and Brussel Sprouts with Chili Lime Vinaigrette, Walnut and Cilantro in the sizeable vegetable portion of the menu. Elsewhere on the menu are spirited dishes such as Kampachi with Pomegranate Aguachile, Crispy Garlic, Fresno Chili and Scallion from the Raw Bar; pizza variations such as Lamb Sausage, Asiago, Confit Tomato, Rapini, Pecorino Romano, Mint and Mixed Mushroom, Rosemary, Confit Garlic and Olive Oil. Even a dish that sounds less surprising such as Bangs Island Mussels with Countneck Clams, Tomatillo, Chili Oil and Grilled Bread is so delicious that more grilled bread must be ordered to sop up every last bit of the oil. It is, simply, a very addictive dish. King Salmon Crudo at Opto. Over in the Flatiron District. in the location that housed the longtime Greek favorite Periyali, co-owner Nicola Kotsoni has now transformed it into the wider ranging Mediterranean spot Opto; there chef Alex Tubero's passion for zesty preparations and high level imported ingredients is on full display. Starters such as King Salmon Crudo get an extra kick from the North African red chile pasta harissa, lime and sesame; Grilled Spanish Octopus from mint and aged Sherry; the popular Gem Lettuce Salad from Dill, Scallion, Cucumber and Sesame-Anchovy Vinaigrette. One holdover from Periyali that regulars from that restaurant always order: the handmade stuffed grape leaves Dolmades that literally do melt in one's mouth. Rocky Mountain Lamb Chops with the Moroccan spice mix Ras el Hanout and Mint Chermoula, Pastas roam around the region from the Spanish Fideuà de Catalana with Red Shrimp, Monkfish, Clams and Saffron, similar to paella but with short pasta instead of rice, and Tagliolini al Amalfi Limone with Cultured Butter and Parmigiano Reggiano blending in with the lemon to elicit the feeling of a sunny afternoon on the Amalfi Coast. Main courses from land include Filet Mignon Shish with the spicy cilantro sauce Zhoug, Spring Onion and Blistered Tomato and Rocky Mountain Lamb Chops with the Moroccan spice mix Ras el Hanout and Mint Chermoula, the North African herb sauce. The Canary Islands Branzino at Opto. Even with a range of other options, though, the star of the menu is likely the Branzino flown in three times a week from the Canary Islands that adds a very crisp skin to the moist, deeply flavorful fish without drying it out. Tubero claims it's the fish's quality not his preparation since this branzino has an added layer of fat under the skin. Another branzino elsewhere will undoubtedly taste pretty ordinary after this one. Opto's Chocolate Mousse. At the end of the menu, the Lemon Torte Caprese is a pretty luscious, appropriate finish. But if you look around the tables (and photos on social media), the incredibly rich chocolate mousse under a cloud of whipped cream is being shared by other diners on friends' dinners out. Selfishly, though, you'll want to keep it all to yourself.
