The driver, Utsav Shekhar, was arrested at the scene but was swiftly granted bail. This has sparked outrage and raised serious questions about road safety, drunk driving, and the leniency of India's judicial system under the current provisions of the Motor Vehicles Act. According to Delhi Police, a PCR call was received at 1:45 am on July 9 in front of the Indian Oil petrol pump near Shiva Camp in Vasant Vihar. The call reported that a white Audi car had crushed people sleeping on the sidewalk. Police arrived at the scene and the injured were quickly taken to the hospital. The victims were identified as Ladhi (40), Bimla (8), Sabami (45), Narayani (35), and Ramchander (45). Initial investigations and eyewitness accounts revealed that Utsav Shekhar, who was returning from Noida to Dwarka, was drunk. His medical report also confirmed this. After the accident, he stopped the car for a moment, saw the injured, and then tried to flee, but his car collided with a truck, leading to his arrest by the police. Legal Action And Bail Delhi Police registered a case against Utsav Shekhar under Sections 281 (negligent driving) and 125(a) (intentionally dangerous driving) of the Bharatiya Nyaya Sanhita, as well as Section 185 (drunk driving) of the Motor Vehicles Act. The vehicle was seized and sent for forensic examination. However, in a surprising turn of events, Utsav Shekhar was granted bail immediately from the local police station. It stipulates that a person can be punished if the alcohol level in their blood exceeds 30 milligrams per 100 millilitres, or if they drive under the influence of intoxicants. The first offence can result in imprisonment of up to six months and/or a fine of up to Rs 10,000. For a second offence, the punishment can extend to imprisonment of up to two years and a fine of up to Rs 15,000. Despite this, the section is classified as a bailable offence, allowing the police or magistrate to grant bail. In Utsav Shekhar's case, although his medical report confirmed he was drunk, the fact that it was his first offence made the decision to grant bail legally possible. Nonetheless, this incident raises the question of whether the process of granting swift bail in such serious accidents needs to be more stringent. This incident also highlights significant social and legal implications regarding road safety, drunk driving, and socio-economic inequalities. Most of the victims were migrant labourers from Rajasthan, forced to sleep on the footpath. Conversely, the carelessness and drunk driving of a luxury car driver led to this tragedy. Days after Audi injures 5 sleeping on a footpath in Vasant Vihar in South Delhi, driver granted bail
'I was sleeping when I heard the sound of a car engine. Within a minute, it drove in our direction, ran over us… and then halted. Moments later, it sped away,' recalled Sabami (45), who works as a labourer. His wife and stepdaughter, and two friends, apart from him, were injured when a white Audi allegedly crashed into a footpath in South Delhi's Vasant Vihar in the early hours on July 9. Allegedly drunk while driving the car, the accused, Utsav Shekhar (40), was arrested soon after the incident. He has been granted bail, police said on Sunday. When the hit-and-run happened, a pedestrian came to their help, said Sabami, and noted down the vehicle's number to report to the police. While Sabami was discharged from the hospital last week, his wife, Ladhi (40), is still admitted to the AIIMS Trauma Centre. Ladhi's daughter from a previous marriage, Bimla (11), and the couple's friends — Narayani (35), and her husband Ram Chander (45) — were among the others injured in the incident. All three have been discharged from the hospital. All of them hail from Ajmer in Rajasthan and came to Delhi 10 years ago, said officers. It would still take Ladhi at least a week to recover, said the family. 'My wife suffered injuries in the neck and back, among other parts of the body. I just turned out to be lucky. If I too had suffered such grave injuries, who would have earned for the family?' he asked. Ratan Lal, 35, Ladhi's brother, who works as a labourer in Gurgaon, said that he got to know about the accident on July 10 and has been at AIIMS since then. 'Ladhi's treatment is still on. I hope that we will get some help with the hospital bill. We don't have much to pay,' he said. The accident took place near a petrol pump in front of Shiva Camp in Vasant Vihar. Around 1.45 am on July 9, a police control room call was made to report a crash in which five people were hit by an Audi car while they were sleeping on the footpath. 'Statements of eyewitnesses were recorded, wherein they stated that a white Audi Car ran over them while they were sleeping on the footpath,' DCP (South West) Amit Goel said. According to the police, Utsav then allegedly went on to hit another truck, about 200 metres from the accident spot, before he was finally arrested by the Delhi Police. The accused, police said, is a property dealer based in Noida and was going towards his home in Dwarka.

New Delhi [India], July 13 (ANI): The driver of a speeding car which ran over five persons sleeping on a footpath in Vasant Vihar area of the national capital earlier this week, allegedly under the influence of liqour, has been arrested, Delhi Police said. The incident took place on Wednesday, at around 01:45 am when an Audi car on its way from Noida crushed people sleeping on the footpath near the Indian Oil Petrol Pump, in front of Shiva Camp, Vasant Vihar. The injured persons were rushed to hospital and the driver of the car, the main accused in the case, has been arrested by the police. Delhi Police said, 'On dated 09.07.2025 at 01:45 AM, a PCR call vide DD No.3A regarding accident near Indian Petrol Pump, infront of Shiva Camp, Vasant Vihar was received at PS Vasant Vihar. On reaching the spot, it came to notice that injured persons have been shifted to hospitals. All were sleeping on footpath.' The victims have been identified as Ladhi (age 40 years), Bimla (age 8 years), Sabami (age 45 years), Narayani (age 35 years), and Ramchander (age 45 years), all of whom are from Rajasthan. Police said that the driver of the Audi vehicle, named Utsav Shekhar, age 40, is a resident of Dwarka and deals in property-related work. He was returning home from Noida when the accident happened near the Indian Oil Petrol Pump, Vasant Vihar. Police said, 'Statements of eyewitnesses were recorded, wherein they stated that a white colour Audi Car ran over the above-mentioned persons while they were sleeping on the footpath. The driver of the offending vehicle, namely Utsav Shekhar resident of Dwarka, age 40 yrs, was apprehended and legal action taken.' The driver was allegedly drunk and had also hit a truck after the accident when the police caught him. Legal action against him has been taken, said Delhi police. (ANI)
