'In breach of natural justice': Bombay HC sets aside student's rustication from Pune college; she criticized govt over Operation Sindoor
Bombay high court (File photo) NEW DELHI: The Bombay high court on Monday set aside the rustication of a student from a Pune-based engineering college over her post on Operation Sindoor . The division bench of justices Makarand S Karnik and Nitin R Borkar noted that the expulsion letter by Sinhgad Academy of Engineering was "in breach of natural justice" as the student was rusticated without being heard, news agency PTI reported. However, the bench granted the institute liberty to take an appropriate decision after hearing her and complying with the principles of natural justice. This comes after the court, on May 27, suspended Sinhgad Academy's order to expel her. It also allowed the girl to appear for her second-year semester examinations. The controversy began on May 7 when the student, pursuing a Bachelor of Engineering (Information Technology) degree, shared a post on Instagram from an account named "Reformistan." She criticised the government for Operation Sindoor, which was launched earlier that day, and targeted terror sites in Pakistan and Pakistan-occupied Kashmir. She was later sent to judicial custody and lodged at Yerwada prison. The college also rusticated her immediately. Challenging her rustication and seeking quashing of the FIR, the student approached the Bombay high court.

"Breach Of Principles...": Bombay High Court On Pune Student's Explusion Over Instagram Post On Op Sindoor
Mumbai: The Bombay High Court on Monday set aside the expulsion of a 19-year-old second-year engineering student from Sinhgad Academy of Engineering, Pune, who was arrested for an Instagram post related to Operation Sindoor. The Court observed that the expulsion was issued in violation of the principles of natural justice. The bench comprising Justices Makarand S Karnik and Nitin R Borkar ordered that the student was not issued a show-cause notice nor allowed to be heard before the disciplinary action was taken. The court remarked, "Admittedly, the letter of rustication was issued in breach of the principles of natural justice. She was not heard before the letter was issued. Given the matter, the impugned order is set aside." The court held that the expulsion letter was arbitrary and unlawful, and granted liberty to the college authorities to issue an appropriate order only after giving the petitioner an opportunity to be heard and following due process. The student was arrested by the Pune Police on May 9 for allegedly sharing an Instagram story which criticised the Centre over Operation Sindoor. She was later booked under Sections 121, 153, and 505 of the Indian Penal Code. The post was deleted within two hours, and she issued a public apology. Her petition before the High Court sought bail, quashing of the expulsion order, and permission to appear for semester exams scheduled between May 24 and June 3. A vacation bench of the High Court earlier granted her interim bail on May 27 and allowed her to appear for the remaining exams. Regarding the theory and practical exams she missed during custody, the Court on Monday noted that she had made a representation to the college, which was forwarded to the Director of the Board of Examinations and Evaluation, Savitribai Phule Pune University. The court has directed the university to decide the same on merits in an expeditious manner.

Bombay HC seeks BMC's reply to plea against ‘unhygienic' Tardeo fish market
The Bombay High Court recently sought an affidavit from the Brihanmumbai Municipal Corporation (BMC) in reply to a PIL by residents of housing societies in south Mumbai's Tardeo area, alleging that a new fish market run within the residential area was affecting their health and religious sentiments. The court asked the BMC to ensure hygiene conditions are maintained in the fish market. A bench of Chief Justice Alok Aradhe and Justice Makarand S Karnik on May 8 was hearing a PIL by Megha Agarwal, Vikram Jogani, Laxmichand Gala, and Mahendra Jain from Tulsiwadi area in Tardeo. The petitioners, through advocate Deepa Pohuja, claimed that the fish market, which opened in March this year on the ground floor of the municipal building in the area, did not maintain any hygiene norms and the water with foul odour would come in the basement and compound of the petitioners' housing societies and on the Tulsiwadi Main road. The petitioners also claimed that the runoff water filled the road with 'maggots', and while there were three to four stalls in the market at present, there would be 50-50 more stalls in the future. The petitioners argued that the said fish market was in a residential area having over 19 buildings and four temples. The PIL claimed that the market had been 'gravely affecting the lives of those living in the locality' and the residents' religious sentiments. The petitioners claimed that the same caused health problems to children, senior citizens and other residents. Moreover, the PIL alleged that inconvenience was caused to devotees who visit temples, including a Jain temple in the nearby area. The residents also claimed that there were no fixed timings for transporting goods from the fish market, and the said vehicles parked in the narrow lane cause traffic congestion in the vicinity. Advocate Chaitalee Deshpande for the BMC submitted that the civic body would ensure that the fish market was run following the guidelines applicable to BMC-run fish markets. The high court issued notices to the respondents, the state government and the BMC authorities, including its assistant commissioner, markets, and directed them to file affidavits in reply within four weeks, after which it will hear the matter.

Phasing out petrol, diesel vehicles from Mumbai will have cascading effect on economy: Govt to HC
The Maharashtra government on Monday told the Bombay High Court that phasing out petrol and diesel vehicles from the city would have a 'cascading effect' on a large number of people and the country's economy. The government said that an expert panel formed will require more time to submit a report on whether it will be feasible to phase out diesel and petrol-based vehicles from the roads of Mumbai and permit only those that run on CNG and electronic charge. The government informed a division bench of Chief Justice Alok Aradhe and Makarand S Karnik that the five meetings of the committee, formed on January 21, have already been conducted and it is in process to gather requisite information from stakeholders and other affected parties. The government filed an affidavit filed through the Joint Transport Commissioner in response to suo motu Public Interest Litigation (PIL) raising concerns over 'alarming' air pollution levels in Mumbai and surrounding areas, 'This policy will have a cascading effect on huge section of population and also economy of the country and hence, a detailed, in depth, exhaustive and extensive study will be required to be done which is time consuming and hence the said committee will require a longer time frame for arriving at its conclusive study,' the affidavit stated. On January 9, the HC had directed the formation of the committee consisting of experts, civil administrators, and those associated with the administration of traffic management to conduct the study within three months and submit a report to the court. The affidavit said that at present, the committee cannot give an outer limit for completion of the study but the same will be done in an expeditious manner. Meanwhile, Samadhan Pawar, Deputy Commissioner of Police, Traffic, Mumbai in an affidavit in reply stated that a panel headed by Deputy Commissioner of Police (West) has studied the traffic congestion on Western Express Highway (WEH) and identified congestion sites and suggested temporary and permanent measures to deal with the same. The affidavit stated that on WEH and Eastern Express Highway, total 93 places with traffic congestion have been identified and officer of senior police inspector/police inspector has been appointed as nodal officer at each such place to ensure there is no traffic congestion and to take required measures to control pollution with the help of Maharashtra Pollution Control Board (MPCB) officials. The HC will hear the matter next on April 29.
