Providers Named After Failing To Meet HDC Recommendations
Decisions 22HDC03019 and 23HDC01424 The Health and Disability Commissioner (HDC) has taken the unusual step of naming two providers who have not complied with recommendations made in decisions issued by the HDC. HDC promotes and protects the rights of people using health and disability services, as set out in the Code of Health and Disability Services Consumers' Rights (the Code). Two consumers (Mr A and Mrs B) complained to HDC about services they had received from Nicholas Stoneman and the New Zealand Disability Trust (NZDAT). Mr Stoneman was chairman of the NZDAT at the time. Mr A and Mrs B' complaints raised concerns about poor organizational processes, a lack of policies and procedures, Mr Stoneman and the NZDAT's exploitation and treatment of vulnerable consumers, and their poor engagement with the complaints process. HDC undertook an investigation. In October 2024, Mr Stoneman and NZDAT were found to have breached the Code and not provided Mr A and Mrs B with an appropriate standard of service. In her decision, HDC Deputy Commissioner, Rose Wall, recommended Mr Stoneman provide both complainants with a written apology and comply with a number of other recommendations. Despite repeated follow up from HDC, Mr Stoneman and NZDAT have not complied with any of the recommendations. "In failing to meet any of my recommendations, Mr Stoneman and NZDAT have failed to comply with their legal obligations under the Health and Disability Commissioner Act 1994. They have demonstrated a lack of commitment towards improving their practice. "In the circumstances, I consider Mr Stoneman and NZDAT pose a risk to other vulnerable consumers. I have therefore decided to re-issue the decision and name them." Ms Wall said anyone who had received substandard treatment from a practitioner should contact HDC if they wished to submit a complaint.

Seeing as I'm a serial over packer, I wanted to see what you could really get inside, and if it was a good as everyone else has been saying – especially with two bank holidays on the way. Usually, I'm that girl that packs a million pairs of pants for a short trip, so knew that was the first thing I'd have to cut down – along with an obscene amount of beauty products… Hypothetically, when you go away for the weekend, you need at least a light jacket, two pairs of jeans (but one will be packed, and one worn, along with the jacket), jumper (also worn), top for the evening, few pairs of pants, pyjamas (unless you enjoy sleeping in the nude), beauty bits, toothbrush… So that's what I did. Into my £14.90 gingham printed Round Mini Shoulder Bag, I shoved as much as I could inside. Missing would be my skincare, swimwear (should that be required), and another pair of shoes/boots. Whist I would agree the bag is spacious for sure, for me, I'm just not buying the fact you could use it for a short break – unless the weather was going to be consistent. At most, an overnight stay at a mate's house and you need to transport the essentials to and from the pub back to theirs, but it's not one for longer than that – soz Uniqlo. What I would love to see though is a slightly larger version – just a few inches more and I think it could be on to something. Another five-star reviewer called JChem said: 'Fantastic bag to have. Even though by looking the size seems to be quite petite, but the volume and the amount of stuff that it can take in, INCREDIBLE!. Love the design too and it is waterproof, definitely the best fit for London's weather.' So if you can pack really light, then I would say this could just about fit in all the essentials you'd need for a weekend, but if like me you also need to pack more – then opt for splitting a cabin bag – but at least take this as your day bag because you really can pack quite a bit inside. Mum given £3.5k pay-out over Wirral Council education plan failure
A mother and daughter have received a £3,500 pay-out after a council apologised for the "distress" caused by failings that meant her teenage daughter dropped out of Local Government and Social Care Ombudsman (LGO) investigated a complaint by the mother, referred to as Mrs B, about delays in assessments, poor communication and a lack of support from Wirral Council. It was over the education, health and care plan (EHCP) for her daughter, referred to as C, who has special education needs and disabilities (SEND).Wirral Council said the authority "wholeheartedly accept the Ombudsman's findings" and publicly apologised. C went into year 11 in 2023 and hoped to move into further education in 2024, the Local Democracy Reporting Service had received support to help her complete her GCSEs and her mother asked the council to assess whether an EHCP - a special extra plan of support - was needed. 'Distressing impact' The council agreed to the request but no plan was in place by the time C had started at her new school in mid September C was "experiencing symptoms associated with her special educational needs that had a distressing impact on her", the LGO ombudsman then got involved who found the family had not had any contact from their caseworker since July 2024. By mid October C was no longer in college. Finding the council at fault, the LGO said: "Part of the fault clearly lies in the service failure resulting from the council having too few education psychologists last year to meet demand." During the process, the council said it was facing a shortage of education the LGO said, while there was a nationwide shortage, Wirral Council had "systemic problems" meeting timescales for completing EHC assessments which had been noted in an Ofsted inspection more than three years ago so "pre-date" spikes in demand last year. The council said it would be outlining the next steps on how it is improving services following a recent Ofsted inspection.
