Indonesian Woman Jailed for Prostitution in Sandakan
KOTA KINABALU: A 50-year-old Indonesian woman was sentenced to three years in prison by the Sandakan Sessions Court on Tuesday for acting as a prostitution agent. Lely Fiter pleaded guilty before Judge Zaini Fisher @ Fisal to charges under Section 372 of the Penal Code, which criminalizes exploiting others for prostitution. Her sentence began on the date of her arrest, and she will be deported after serving her term. Police raided Lely's rented apartment at Taman Mawar Apartment at 3:30 p.m. on July 29 following a tip-off. An officer, posing as a customer, paid RM150 for sexual services with a 26-year-old local woman. Officers intervened before any act occurred, arresting both women and seizing RM150 in cash (the payment), condoms, tissues, and a mobile phone as evidence. The local woman, Zuraini Mohd Zaini, who admitted to offering sexual services, was fined RM1,800 or, in default, three months' jail under Section 372B of the Penal Code by Magistrate Nur Faezah Jafry. She confessed to engaging in prostitution due to financial difficulties, stating that she received RM100 per transaction while Lely kept RM50 as commission. Deputy Public Prosecutor Muhammad Azizi Hamil prosecuted Lely's case, while ASP Zamri Zakaria prosecuted the local woman's case.

Indonesian gets 34 years' in jail, 14 strokes of rotan for sexually abusing brother's teen stepdaughter
KOTA KINABALU: An Indonesian labourer has been sentenced to 34 years' in jail by the Sandakan Sessions Court for molesting and sexually abusing his elder brother's teenage stepdaughter on Friday (July 25). The 25-year-old pleaded guilty before Sessions Court Judge Zaini Fisher @ Fisal, who also ordered him to be whipped 14 times for committing the offence between July 7 and 9 this year at an unnumbered house at an oil palm plantation quarters in Sandakan. Zaini also handed down an additional four months' jail on the accused for staying in the state without a valid document, and ordered him to be referred to the Immigration Department for deportation to his country of origin after serving the sentences. According to the facts of the case, the incident came to light on July 9 when the accused's brother noticed that his 14-year-old stepdaughter was experiencing unusually heavy bleeding. He also found her clothes in the bathroom stained with a significant amount of blood. When asked, the teenager said that she had been molested and raped by her uncle since July 7, which prompted the stepfather to take her to the Duchess of Kent Hospital for treatment before lodging a police report. The medical examiner found tear marks in her private parts, and no external body injuries. The accused was later arrested at the police station at Ulu Dusun, Jalan Labuk in Sandakan at about 12.30pm on July 11. He was charged under Section 14 of the Sexual Offences Against Children Act 2017 for committing the crime, which carries a jail sentence of not more than 20 years, and liable to whipping. Zaini handed down eight years jail on him for the offence. The accused also admitted to raping his niece twice, the first at 11pm on July 8 and again at 3am on July 9 at the same unnumbered house. For the second and third offences, he was charged under Section 376 (1) of the Penal Code, which carries a jail sentence of up to 20 years plus whipping. The court handed down a sentence of 13 years jail and seven whippings for each charge. Deputy Public Prosecutor Muhammad Azizi Hamil conducted the prosecution, while the accused was unrepresented.

Repeat drug offender gets 5 years, 1 whip

Judge Zaini Fishir @ Fisal handed down the sentence after Mazlee tested positive for Amphetamine and Methamphetamine during a police narcotics operation. A pathology report from Duchess of Kent Hospital later confirmed the presence of both substances. Mazlee was charged under Section 15(1)(a) of the Dangerous Drugs Act 1952, punishable under Section 15 and read together with Section 39C(1)(b) of the same Act due to two prior convictions for similar offences in 2021 and 2023. Under Section 39C(1)(b), repeat offenders face a minimum of five years' imprisonment and up to three strokes of the cane, along with mandatory supervision under Section 38B(1) of the Act. Mazlee, who was unrepresented, was also ordered to be placed under police supervision for two years after completing his sentence. Labourer sentenced to 15 years' jail, 12 strokes of the cane for raping stepdaughter
KOTA KINABALU: A labourer was sentenced to 15 years' jail and 12 strokes of the cane for raping his 10-year-old stepdaughter several times over these past five months. The 44-year-old Indonesian was handed the sentence after pleading guilty to sexually assaulting the girl four times between January and May this year, before Sandakan Sessions Court judge Zaini Fishir @ Fisal on Thursday (May 29). The court heard that the man had committed the offences under Section 376(3) of the Penal Code and Section 16(1) of the Sexual Offences Against Children Act 2017 when they were both alone in their plantation quarters in Kinabatangan. The matter came to light when the girl's mother found out about the incident, and a police report was lodged at the Kinabatangan Police Station at 12.52am on May 20. The accused was nabbed just eight minutes later at 1am while the girl, who was just 10 years and 10-months of age, was sent to undergo a medical examination at the Duchess of Kent Hospital in Sandakan. Judge Zaini set an imprisonment sentence of 12 years and 10 strokes of the rotan for one charge, and three years' jail with two strokes of the cane for the other, ordering the prison terms to run consecutively. The accused will be referred to the Immigration Department for deportation after completing his punishment.
