Indonesian gets 34 years' in jail, 14 strokes of rotan for sexually abusing brother's teen stepdaughter
The 25-year-old pleaded guilty before Sessions Court Judge Zaini Fisher @ Fisal, who also ordered him to be whipped 14 times for committing the offence between July 7 and 9 this year at an unnumbered house at an oil palm plantation quarters in Sandakan.
Zaini also handed down an additional four months' jail on the accused for staying in the state without a valid document, and ordered him to be referred to the Immigration Department for deportation to his country of origin after serving the sentences.
According to the facts of the case, the incident came to light on July 9 when the accused's brother noticed that his 14-year-old stepdaughter was experiencing unusually heavy bleeding.
He also found her clothes in the bathroom stained with a significant amount of blood.
When asked, the teenager said that she had been molested and raped by her uncle since July 7, which prompted the stepfather to take her to the Duchess of Kent Hospital for treatment before lodging a police report.
The medical examiner found tear marks in her private parts, and no external body injuries.
The accused was later arrested at the police station at Ulu Dusun, Jalan Labuk in Sandakan at about 12.30pm on July 11.
He was charged under Section 14 of the Sexual Offences Against Children Act 2017 for committing the crime, which carries a jail sentence of not more than 20 years, and liable to whipping.
Zaini handed down eight years jail on him for the offence.
The accused also admitted to raping his niece twice, the first at 11pm on July 8 and again at 3am on July 9 at the same unnumbered house.
For the second and third offences, he was charged under Section 376 (1) of the Penal Code, which carries a jail sentence of up to 20 years plus whipping.
The court handed down a sentence of 13 years jail and seven whippings for each charge.
Deputy Public Prosecutor Muhammad Azizi Hamil conducted the prosecution, while the accused was unrepresented.

JOHOR BARU: The Malaysian Immigration Department detained 27 foreign workers without valid permits in Op Selera at a food premises in Bandar Baru Permas Jaya here on Monday. Johor Immigration director Datuk Mohd Rusdi Mohd Darus said the integrated operation, involving 25 officers from the department's enforcement division, was conducted as a result of intelligence and public information regarding their activities at the premises. Mohd Rusdi said all the detainees were placed at the Setia Tropika Immigration Depot for investigation and further action, in addition to being issued three notices to appear at the Immigration Department to assist in the ongoing investigation. "At the same time, we would like to remind the public and employers not to harbour or employ illegal immigrants to work as legal action would be taken against them. KUALA LUMPUR, Aug 6 (Bernama) -- The Royal Malaysia Police (PDRM) is urging all parties to stop any action of uploading or sharing unverified information related to the death of Form One student Zara Qairina Mahathir. Inspector-General of Police Datuk Seri Mohd Khalid Ismail said police have detected the spread of information and a child's pictures linked to the Zara Qairina case by irresponsible parties on social media. He stated that the shared information is inaccurate and has the potential to confuse the public, besides potentially affecting the ongoing investigation and hindering the process of justice for all involved. "The entire investigation process for the case, including the post-mortem issue, is being conducted according to existing procedures and legal provisions, and all parties are advised to stop any action of uploading or sharing unverified information, including disclosing information related to the case investigation," he said in a statement tonight. Mohd Khalid said the act of disclosing information related to the case can be investigated under Section 15 of the Child Act 2001, which involves a prohibition on revealing the identity, address, school name, and pictures of the child involved, as well as Section 203A of the Penal Code for offenses related to the disclosure of information. "The individuals involved can also be investigated under Section 233 of the Communications and Multimedia Act 1998 for improper use of a network facility or network service. Adherence to the law is the basis of national peace and well-being. Any violation will be met with firm action in accordance with existing provisions," he said. Zara Qairina, 13, was confirmed to have died at Queen Elizabeth I Hospital in Kota Kinabalu, Sabah on July 17. The student was taken to the hospital after being found unconscious in a drain near the dormitory of a religious school in Papar at 4 am on July 16. The investigation into the case is currently being finalised by the police after being returned by the Attorney-General's Chambers yesterday.

Foreigner to be charged with murdering housemate in Klang
KUALA LUMPUR: A 34-year-old foreigner will be charged with murder tomorrow over the stabbing death of his housemate at a shoplot residence in Bandar Sentosa, Klang, last month. Klang Selatan deputy police chief Superintendent Kamalariffin Aman Shah said the man will be charged under Section 302 of the Penal Code which carries the death penalty or a jail term of up to 30 years upon conviction. He said the victim, a 28-year-old foreigner, was stabbed in the body and neck during a quarrel with the suspect while drinking alcohol at the premises on July 20. "At the time of the incident, there were seven men and two women, all foreigners, at the residence. "A misunderstanding between the suspect and the victim escalated into a verbal argument before the suspect stabbed the victim, causing his death. "Six men who were present later buried the victim's body in a landfill site about 1km from the house," he said in a statement. Police later arrested five men and two women, aged between 20 and 34, to assist investigations. "The body of the victim and the knife used in the killing were later recovered," he said. Kamalariffin added that five of the male suspects will also be charged under Section 201 of the Penal Code for concealing a body, which carries a maximum prison sentence of seven years. He added that all the suspects will face an additional charge under Section 6(1)(c) of the Immigration Act 1959/63 for not possessing valid travel documents. "All charges will be heard at the Klang Court tomorrow," he said.
