HC allows to close criminal case against Mungantiwar, others

MUMBAI: The Bombay high court last week allowed the state government to close a criminal case against BJP leader Sudhir Mungantiwar and 21 others for rioting and causing damage to public property while protesting against Western Coalfields Limited in Nagpur, way back in June 2012. According to the police, on June 26, 2012, an agitation was organised in front of the Western Coalfields Limited headquarters in Nagpur, to protest the alleged pollution and environmental damage on account of the mining operations of the public sector undertaking. It was further alleged that on the pretext of submitting representation, the accused barged into the office of the company and damaged property worth around ₹1.50 lakh. The state government had filed an application in the high court, seeking permission to withdraw the prosecution, stating that a proposal to that effect was recently put up before the state-appointed committee. The proposal was backed by a report from the public prosecutor, stating that the incident arose out of social agitation and, in his opinion, prosecution deserved to be withdrawn. Based on this report, the committee had decided to withdraw the prosecution. A division bench of chief justice Alok Aradhe and justice NJ Jamadar accepted the reasoning given by the public prosecutor and the committee's decision to withdraw the prosecution, and allowed the criminal case against the former minister and others to be dropped. 'Prima facie, it appears that the genesis of the alleged offences is in an agitation over the ill effects of mining and the resultant environmental damage,' said the bench. 'The Committee has noted that there is no loss of life and damage to public property in excess of ₹5 lakh - the parameters stipulated under the Government Resolution for withdrawal of prosecution in cases arising out of social and political issues,' it added. The judges observed that the decision of the committee to withdraw the prosecution appeared to be guided by considerations for withdrawal of prosecutions arising out of social and political agitations. 'It does not appear that the prosecution is being withdrawn for an extraneous consideration,' the court said.

Chandrapur district hottest on Earth again, schools shorten hours due to heatwave

1 2 Nagpur: Chandrapur district was again the hottest place on Earth, prompting the education department to curtail school timings. Within a span of two days, Chandrapur district has recorded the highest maximum temperature in the world. The mercury in Brahmapuri tehsil and Chandrapur city weather stations reached 45.6 and 45.5 degrees Celsius respectively on Wednesday. A heatwave swept through the district for the third consecutive day, the IMD said. Private forecaster El Dorado showed Jharsuguda in Odisha with 45.4 degrees Celsius at the top as per updates till 9.30pm (IST). Taking cognisance of the soaring temperatures and the growing risk of heatstroke among students, the education department issued directives to all schools across Chandrapur district to restrict operational hours till 10am. While a heatwave was also experienced in Akola (45), other districts of Vidarbha, including Nagpur (44.4), Wardha (44.7), Amravati (44.6), and Gadchiroli (44.6), faced heatwave-like conditions. Seven weather stations were among the top 15 places in India recording maximum temperatures above 43 degrees Celsius. An orange alert was issued for Nagpur, Wardha, Amravati, and Chandrapur for Thursday, as the ongoing heat spell was likely to stretch into the fifth day. Later, some respite was expected in the region, with thunderstorms and gusty winds likely to bring down the temperature towards the weekend. In Nagpur, Rohini Kumbhar, district education officer, said, "No new notification has been issued for Nagpur regarding early closure of schools. As per the last circular, schools are closing early." by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Discover the best investment opportunity. سالك Learn More Undo The swift administrative move in Chandrapur came after BJP MLA Sudhir Mungantiwar wrote to the district collector, urging for immediate measures to protect schoolchildren from the intensifying heat. Citing consistent temperatures above 45°C in the district and the increasing instances of heat-related ailments among students, Mungantiwar pressed for either temporary school closures or reduced academic hours during the afternoon. In its advisory, Chandrapur Zilla Parishad's primary education department highlighted that a natural disaster alert was declared in the district due to extreme heat, with daytime temperatures exceeding 45°C. "All govt and private schools and colleges should operate only till 10am during the prevailing heatwave period," the directive reads. Nagpur district collector Vipin Itankar, who is chairman of the District Disaster Management Authority, urged citizens to take necessary precautions and implement measures to cope with the heatwave. The temperature in Nagpur district significantly increased, posing potential health risks to vulnerable groups such as workers, farmers, beggars, street vendors, the elderly, children, and women. It is essential for these groups, particularly construction workers, exercise extra caution. Employers and organisations should provide ample drinking water and shade for workers and plan for necessary breaks during the afternoon. Offices should arrange drinking water and shaded areas for visitors.
