Court allows MACC to amend asset freeze notice for Daim's widow

KUALA LUMPUR: The High Court has permitted the Malaysian Anti-Corruption Commission (MACC) to amend its notice of motion concerning the freezing of assets worth GBP132 million in London, allegedly owned by the late Tun Daim Zainuddin's widow, Toh Puan Na'imah Abdul Khalid, and her family. The assets include two commercial properties at St Mary Axe and One Crown Court, three luxury residences at Bryanston Square, Bryanston Mews, and Lancaster Gate, two residential units at Gloucester Place, and a CAF Bank Limited (UK) account held by The Ilham Foundation. Judge Datuk Azhar Abdul Hamid granted the application after deputy public prosecutor Maziah Mohaide explained that the amendments involved adding details to the notice of motion dated May 30, 2025. These changes included updating property addresses, title numbers, and purchase values to comply with UK enforcement standards. Meanwhile, lawyer Syed Afiq Syed Albakri, representing Na'imah, disclosed that six companies, including The Ilham Foundation, had sought to intervene in the MACC's asset freeze application. However, Maziah objected to their involvement. Judge Azhar directed the prosecution to file an affidavit in response to the intervention request by July 25, with the six companies required to submit their replies by August 6. Case management was scheduled for August 8. On May 22, MACC Chief Commissioner Tan Sri Azam Baki confirmed that eight investigation papers were initiated based on new information from external agencies regarding undisclosed assets linked to Daim, his family, and proxies. Azam stated that the latest findings revealed assets not declared during the 2023 probe.

Prosecution Seeks Court Order To Restrain Tun Daim's Widow From Handling Assets In Jersey

KUALA LUMPUR, June 25 (Bernama) -- The prosecution today filed an ex-parte application in the High Court here seeking to restrain Toh Puan Na'imah Abdul Khalid, the widow of the late Tun Daim Zainuddin, or her associates, from dealing with offshore assets amounting to USD157.5 million (approximately RM667 million) and GBP85 million located in Jersey, a British Crown dependency. Deputy Public Prosecutor Maziah Mohaide filed the application before High Court Judge Datuk Muhammad Jamil Hussin under Section 53 of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activity Act 2001 (AMLATFPUAA 2001). Maziah said the application was based on investigations under Section 113 of the Income Tax Act and Section 4(1) of AMLATFPUAA. The prosecutor alleged that the assets were acquired by Na'imah or individuals linked to her in Malaysia and were not declared to the Inland Revenue Board (IRB). This was the third application by the prosecution, following earlier efforts involving assets located in the United Kingdom and Singapore. Meanwhile, Na'imah's counsel, Syed Afiq Syed Albakri, applied to intervene in the proceedings and requested that the cause papers be served on her. The court then allowed the lawyer's application to file an intervener application and fixed Aug 22 to hear the intervener application, which will take precedence before the court hears the prosecution's bid. On May 22, MACC Chief Commissioner Tan Sri Azam Baki disclosed that eight investigation papers had been opened based on new information from external agencies regarding assets owned by Tun Daim, his family and proxies. Azam said the latest information indicated that the assets were not declared during the MACC's 2023 investigation.

[UPDATED] MACC freezes RM758mil in London assets linked to Daim's wife [WATCH]

KUALA LUMPUR: The Malaysian Anti-Corruption Commission (MACC) has obtained a court order to freeze assets worth more than £132 million (about RM758.2 million) belonging to Toh Puan Na'imah Abdul Khalid in London. The ex-parte order was granted by High Court Judge Datuk Azahar Abdul Hamid after the court was satisfied that the assets were potentially linked to offences under Section 4(1) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001. Among the assets are two commercial buildings totalling £55,200,000; five luxury residences totalling £77,115,000 and a bank account owned by Ilham Foundation. Deputy public prosecutor Mahadi Abdul Jumaat confirmed this when contacted. "We will investigate, and if there is sufficient evidence, we will apply to forfeit all the properties to the government," he said via WhatsApp today. The New Straits Times has reached out to Na'imah's lawyer, Rajesh Nagarajan, for comment. MACC Chief Commissioner Tan Sri Azam Baki reportedly said that eight new investigation papers related to Tun Daim Zainuddin's family have been opened as part of the probe into properties valued at over RM2 billion. He said the commission had been conducting a probe into Daim since February 2023 and had opened several investigation papers, including the latest ones initiated recently. Daim died on Nov 12, last year, at the age of 86. Following his passing, the Kuala Lumpur Sessions Court discharged and acquitted him of charges related to failing to comply with a notice under Section 254 of the Criminal Procedure Code (CPC).
