Rajasthan Minister Jogaram Patel launched a scathing attack on the previous Ashok Gehlot-led Congress government over the murder of Udaipur-based tailor Kanhaiya Lal in 2022 and said that it was 'one of the biggest failures" of the former regime. His remarks came amid the continuing legal battle over the release of the film 'Udaipur Files – Kanhaiya Lal Tailor Murder", which is based on the high-profile killing. The film's release remains suspended and is awaiting the decision of the Centre-appointed panel to hear objections against the film. 'The Kanhaiya Lal murder case is one of the biggest failures of the previous Congress government. Just to stay in the headlines, former CM Ashok Gehlot recently claimed that the trial in this case is not taking place," he said. He further said that the trial of the culprits is underway and the government is pursuing the case effectively. "The chargesheet has already been filed and the trial is underway. As the matter is sub-judice, I cannot comment further. The government is pursuing the case effectively and we are fully confident that the trial will conclude soon and the culprits will be awarded capital punishment," he added. Speaking at the event, Patel also issued a veiled warning regarding the potential impact of the film. 'The matter related to the film is in the court. Since it is sub-judice, I cannot comment much. I can only say the day this film is released, it will shake the ground beneath many people." The film, Udaipur Files– Kanhaiya Lal Tailor Murder, remains under a judicial stay following an order by the Delhi High Court on July 10. The matter reached the Supreme Court on Wednesday and it deferred the case to July 21 and instructed all parties to await the decision of a central government-appointed panel. When the filmmakers argued that the Delhi High Court was wrong to block the film's release as it violated their right to free speech, the Supreme Court responded by saying that the right to life (Article 21) takes priority over the right to freedom of speech and expression (Article 19). The Court said it expects the Centre's committee to make a decision 'immediately, without loss of time," and has scheduled the next hearing for Monday, keeping in mind the urgency raised by the film's makers. The film depicts the 2022 murder of tailor Kanhaiya Lal in Udaipur, Rajasthan, who was killed by Mohammad Riyaz Attari and Ghaus Mohammad. The Supreme Court on Wednesday postponed the hearing on the controversial film 'Udaipur Files – Kanhaiya Lal Tailor Murder' to July 21 and asked the filmmakers to await the decision of the panel appointed by the Centre to assess objections against the movie, news agency PTI reported. The government panel is scheduled to meet at 2:30 pm on Wednesday. A bench comprising Justices Surya Kant and Joymalya Bagchi observed that if the film is released and later found to be problematic, no compensation would be available to the accused in the Kanhaiya Lal murder case in terms of restoring their reputation. In contrast, the filmmakers, if the release is delayed or blocked, can be compensated monetarily. Why did Delhi High Court stay film's release? The film's release, originally scheduled for July 11, was stayed by the Delhi High Court on July 10. The court directed the petitioners, who had filed pleas seeking a permanent ban on the movie, to approach the Centre within two days, stating that the film had the potential to "promote disharmony" in society. The high court bench noted that the petitioners had not first approached the Union government, as required, and asked the govt panel to grant the accused in the murder case an opportunity to be heard. Kanhaiya Lal's murder and controversy around the film 'Udaipur Files' is based on the killing of tailor Kanhaiya Lal in Udaipur, Rajasthan, in June 2022. Lal was allegedly murdered by Mohammad Riyaz and Mohammad Ghous, who later released a video claiming responsibility. In the video, they said the attack was in retaliation for an alleged social media post by Lal supporting former BJP spokesperson Nupur Sharma, who had made controversial remarks about Prophet Muhammad. The incident triggered nationwide outrage, and the National Investigation Agency (NIA) took over the probe. The accused were booked under the Unlawful Activities (Prevention) Act and various sections of the Indian Penal Code. Their trial is ongoing in a special NIA court in Jaipur. Petitioners flag trailer, allege risk of communal tension The legal challenge against the film was led by petitioners including Jamiat Ulama-i-Hind president and Darul Uloom Deoband principal Maulana Arshad Madani. Their petition cited the film's trailer, released on June 26, which they claim contains provocative dialogues and instances that led to communal disharmony in 2022. They argue that releasing the film could rekindle those tensions and disrupt public order. The petitioners have demanded that the release of 'Udaipur Files' be stayed to prevent the judicial process from being compromised and to avoid societal prejudice. The filmmakers had challenged the Delhi High Court order staying the release of the movie. The bench asked the Centre's committee to take a decision immediately without loss of time after hearing all the parties. It also directed the panel to accord hearing to the accused in the murder case. The film was scheduled to be released on July 11. On July 10, the Delhi High Court stayed the release till the Centre decides on pleas seeking a permanent ban over the film's potential to 'promote disharmony' in society. The petitions, including one filed by Jamiat Ulama-i-Hind president and Darul Uloom Deoband principal Maulana Arshad Madani before the high court, claims that a trailer of the movie released on June 26 was replete with dialogues and instances that had led to communal disharmony in 2022, and carries every potential to stoke the same sentiments again. Udaipur-based tailor Kanhaiya Lal was murdered in June 2022 allegedly by Mohammad Riyaz and Mohammad Ghous. The assailants later released a video claiming that the murder was in reaction to the tailor allegedly sharing a social media post in support of former BJP leader Nupur Sharma following her controversial comments on Prophet Mohammed. The case was probed by the National Investigation Agency (NIA) and the accused were booked under the stringent Unlawful Activities Prevention Act, besides provisions under the Indian Penal Code. The trial is pending before the special NIA court in Jaipur.
