Five new Allahabad High Court judges to take oath today
Prayagraj: The five newly appointed judges of Allahabad High Court will take oath in the Chief Justice's court room on Thursday. The newly appointed judges are Pramod Kumar Srivastava-II, Abdul Shahid, Santosh Rai, Tej Pratap Tiwari and Zafeer Ahmad. The Union Ministry of Law and Justice had on Aug 4 issued a notification in connection with the appointment of the judges. In exercise of its power assigned by the Constitution, the President had appointed the five judges belonging to higher judicial services (HJS). At present, there are 78 judges in the Allahabad High Court and its Lucknow bench against the sanctioned strength of 160. With these new appointments, the number will reach 83.

Medical certificate enough for disabled to get family pension: Madurai bench of Madras HC
MADURAI: The Madurai Bench of Madras High Court has observed that pensioners' children, who suffer intellectual disability, should be given family pension on submission of medical certificate evidencing his or her incapacity to earn livelihood on their own, without insisting on certificate denoting income from all sources. A bench of justices GR Swaminathan and K Rajasekar made the observation recently while hearing an appeal filed by the principal accountant general of Tamil Nadu against an order passed by the court directing payment of family pension to the intellectually challenged son of a forester. While hearing the appeal, the judges said though the order had been complied with in this case, the daughter of a late judge with similar difficulties was not lucky and expressed anguish over the delay. The judges recalled that the widow of former acting Chief Justice of Madras High Court TS Arunachalam received pension since 2020. After her death in June 2024, their younger daughter filed an application seeking family pension for her sister, who has physical and intellectual disability. After submission of all documents, the accountant general's (AG's) office forwarded it to the Union Ministry of Law and Justice to obtain sanction from the President of India. Later, the AG's office forwarded a letter from the Government of India seeking the very same set of documents and the matter is pending at this stage, the judges noted. Expressing anguish over her struggle in getting pension, the judges called upon the Registrar General of Madras High Court to liaison with the authorities concerned and ensure that she gets family pension at the earliest. They pointed out that both the Central Civil Services (Pension) Rules and the Tamil Nadu Pension Rules make it clear that the son or daughter suffering from disorder or disability of mind, which prevents him or her from earning livelihood, will be entitled to family pension for life after the demise of the parents, upon production of a medical certificate proving the disability. When the statutory rule doesn't mention requirement of any other document, the authority cannot ask for anything more, the judges added. This issue was settled by the Supreme Court three decades ago and the said decision has been consistently followed.

Nagaland CM calls for balanced, inclusive legal system
Kohima, Nagaland Chief Minister Neiphiu Rio on Saturday called for a balanced and inclusive legal system that serves all sections of society, particularly rural and marginalised communities. He also advocated the establishment of a separate high court for the state. Speaking at a tree plantation programme, organised by the High Court Bar Association at the new high court complex in Meriema in Kohima district, Rio emphasised the importance of preserving customary law. "Just as the wisdom of our forefathers has guided our communities, so too can it coexist with the formal legal system," Rio said, underscoring the value of traditional village and district-level justice mechanisms that are "quick, cost-effective, and rooted in community harmony". He said that customary law, protected under Article 371 of the Constitution, continues to play a vital role in Nagaland's legal framework and should be respected alongside modern jurisprudence. "If we look only at the courts, many of our farmers and villagers in rural areas will not be able to afford legal processes. They might give up their rights altogether," Rio said. He said justice must be "done in spirit, not just in letter". "When justice is delivered, peace and harmony follow. Injustice breeds division,' he said. The chief minister also highlighted the state's ongoing struggle to receive central funding and recognition for a separate high court in Nagaland. Despite multiple appeals to the Union Ministry of Law and Justice and the Chief Justice of India, Rio said that the state was yet to receive any financial support from the Centre for the establishment of a separate high court for Nagaland. Nagaland now has the Kohima bench of the Gauhati High Court. "So far, we have spent over ₹214 crore from the limited state's own resources. To complete the furnishing and staffing, we need an additional ₹300 crore,' Rio revealed. Despite all the efforts, including personal appeals and visits to national leaders, the state has received no grant from the Centre, he said. Rio stressed that the infrastructure for a separate high court has already been developed, including courtrooms, judges' residences, and support facilities. 'We will continue to press our demand for a separate,' he stated, urging the legal fraternity to uphold high standards of justice delivery within the state.

Gujarat High Court gets seven new judges as Union ministry notifies appointment of judicial officers
The Union Ministry of Law and Justice on Thursday notified the appointment of seven judicial officers as judges of the Gujarat High Court on Thursday, coinciding with the 65th Foundation Day celebrations in the state. The notification stated that the President of India has appointed Judicial Officers Liyakathussain Shamsuddin Pirzad, Ramchandra Thakurdas Vachhani, Jayesh Lakhanshibhai Odedra, Pranav Raval, Mool Chand Tyagi, Dipak Mansukhlal Vyas, and Utkarsh Thakorbhai Desai to be judges of the Gujarat HC, 'in that order of seniority, with effect from the date they assume charge of their respective offices.' The appointments are part of the ongoing measures to improve the disposal rate of pending cases and increase the capacity of the Gujarat HC.

BR Gavai to be next CJI, will assume office on May 14
Bhushan Ramkrishna Gavai was on Tuesday appointed the next chief justice of India, the Union Ministry of Law and Justice said. Gavai, the second-most senior judge of the Supreme Court, will assume office on May 14, succeeding Chief Justice Sanjiv Khanna. Khanna will retire on May 13. The Constitution grants the president the power to appoint judges in the Supreme Court. Earlier this month, Khanna wrote to the ministry proposing Gavai as his successor. The letter is part of the convention on the appointment of the top court's chief justices. Gavai, who will become the 52nd chief justice of the Supreme Court, will have a tenure of six months before he retires on November 23. Gavai practiced at the Bombay High Court between 1987 and 1990, and mainly before the Nagpur bench of the High Court. He served as government pleader and public prosecutor for the Nagpur bench since 2000 and was made an additional judge in 2003. He became a permanent judge in 2005.
