
ChatGPT promised to forget user conversations. A federal court ended that.
Now, however, a federal court has overruled that policy.
In an ongoing copyright lawsuit brought by The New York Times, a federal judge last month ordered OpenAI to preserve all ChatGPT user logs, including 'temporary chats' and API requests, even if users opted out of training and data sharing. The court did not allow oral argument before issuing this decision.
Users may choose to delete chat logs that contain their sensitive information from their accounts, but all chats must now be retained to comply with the court order. And for business users connecting to OpenAI's models, the stakes may be even higher. Their logs could contain their companies' most confidential data, including trade secrets and privileged information.
To lawyers, this is unremarkable. Courts issue preservation orders all the time just to ensure that evidence isn't lost during litigation.
But to anyone who has been paying attention to the slow erosion of digital privacy, this is a seismic event. We now know that privacy policies are not self-enforcing. In many cases, they are evidently not even binding.
A privacy promise — such as 'we don't store your chats' — can be overwritten by a judge, a shareholder vote, an acquisition or a quiet update to the terms of service. In this case, it was overwritten by the demands of legal discovery. The court didn't ask whether the data should exist. It asked only whether, once it did, it could be preserved.
We have built a digital world on an illusion of control. Companies offer toggles, checkboxes, encryption and promises of deletion. But none of these are rights with legal force. They more closely resemble marketing copy: easily changed, largely unenforceable and meaningless when challenged by law or capital.
Google, Zoom, Slack and Adobe have each changed data practices in ways that retroactively altered users' privacy expectations.
And when companies get acquired, the results can be worse. Skiff was a private alternative to Gmail and Google Docs — an email and document suite built on end-to-end encryption. By design, the company behind it couldn't access user data. But then Notion, a rising Silicon Valley productivity company, acquired it. Skiff users were given a short window to export their data and transfer to Notion. But the encryption didn't survive, and the product's privacy protections disappeared.
This is the reality we live in: Our privacy depends not on what we're told, but on whether the company telling us survives long enough to honor it — and isn't bought, sued or restructured along the way.
Which brings us back to the courtroom. The issue isn't whether OpenAI is complying with the order, or that it might have limited the fallout by isolating the relevant logs earlier in the litigation. It is that no one — not the company, not its users and not its privacy policy — has the power to resist the fallout.
Our legal system was designed for physical documents and corporate servers. It has not yet reckoned with persistent data collection, behavioral advertising or AI tools that blend personal and public inputs. And in the absence of clear statutory limits, courts will default to over-preservation.
If OpenAI must preserve all user logs because of a copyright claim, what happens when law enforcement demands access to text messages in a domestic violence case? Or when a state attorney general issues a subpoena for location data from a reproductive health app? The preservation burden is contagious. The legal precedent being set here is that if data could be useful in a dispute, it should be saved — even if that undermines the privacy of millions of uninvolved users.
All this is a reminder that privacy, if not backed by law or hardened by design, is contingent. The court didn't just preserve evidence. It reshaped the architecture of trust around one of the most popular AI tools in the world.
If we want privacy, we need laws that require data minimization; legal firewalls that stop courts from turning temporary messages into permanent evidence; and tools that are designed from the start not to remember.
Because unless something changes, your private chats aren't really private. They're just waiting to be subpoenaed.

Anthropic Revokes OpenAI's Access to Claude

Anthropic revoked OpenAI's API access to its models on Tuesday, multiple sources familiar with the matter tell WIRED. OpenAI was informed that its access was cut off due to violating the terms of service. 'Claude Code has become the go-to choice for coders everywhere and so it was no surprise to learn OpenAI's own technical staff were also using our coding tools ahead of the launch of GPT-5,' Anthropic spokesperson Christopher Nulty said in a statement to WIRED. 'Unfortunately, this is a direct violation of our terms of service.' According to Anthropic's commercial terms of service, customers are barred from using the service to 'build a competing product or service, including to train competing AI models' or 'reverse engineer or duplicate' the services. This change in OpenAI's access to Claude comes as the ChatGPT-maker is reportedly preparing to release a new AI model, GPT-5, which is rumored to be better at coding. OpenAI was plugging Claude into its own internal tools using special developer access (APIs), instead of using the regular chat interface, according to sources. This allowed the company to run tests to evaluate Claude's capabilities in things like coding and creative writing against its own AI models, and check how Claude responded to safety-related prompts involving categories like CSAM, self-harm, and defamation, the sources say. The results help OpenAI compare its own models' behavior under similar conditions and make adjustments as needed. 'It's industry standard to evaluate other AI systems to benchmark progress and improve safety. While we respect Anthropic's decision to cut off our API access, it's disappointing considering our API remains available to them,' OpenAI's chief communications officer Hannah Wong said in a statement to WIRED. Nulty says that Anthropic will 'continue to ensure OpenAI has API access for the purposes of benchmarking and safety evaluations as is standard practice across the industry.' The company did not respond to WIRED's request for clarification on if and how OpenAI's current Claude API restriction would impact this work. Top tech companies yanking API access from competitors has been a tactic in the tech industry for years. Facebook did the same to Twitter-owned Vine (which led to allegations of anticompetitive behavior) and last month Salesforce restricted competitors from accessing certain data through the Slack API. This isn't even a first for Anthropic. Last month, the company restricted the AI coding startup Windsurf's direct access to its models after it was rumored OpenAI was set to acquire it. (That deal fell through). Anthropic's chief science officer Jared Kaplan spoke to TechCrunch at the time about revoking Windsurf's access to Claude, saying 'I think it would be odd for us to be selling Claude to OpenAI.' A day before cutting off OpenAI's access to the Claude API, Anthropic announced new rate limits on Claude Code, its AI-powered coding tool, citing explosive usage and, in some cases, violations of its terms of service.

Alphabet's Recent Numbers Were Strong, but This Metric Could be a Red Flag
Key Points Alphabet reported another quarter of double-digit growth last week. According to some metrics, Google is losing market share in search. A judge ruled that its search engine was an illegal monopoly. 10 stocks we like better than Alphabet › The launch of OpenAI's ChatGPT in late 2022 sparked a lot of changes in the industry and the market, including the start of some panic among investors and analysts about the future of Alphabet (NASDAQ: GOOG) (NASDAQ: GOOGL) and its cash cow, Google Search. As a result, the giant tech stock has still managed to do well in the last two years, but it has underperformed "Magnificent Seven" peers like Microsoft, Meta Platforms, and Amazon (see chart below). At least part of the reason for that underperformance seems to be related to potential AI-based challenges to Google Search. Despite those concerns, Alphabet continues to deliver steady growth, and that pattern was on display again in its second-quarter earnings report. Alphabet impresses again The tech giant reported 14% revenue growth year over year in the second quarter to $96.4 billion, easily beating the consensus at $94 billion and showing that advertising demand on its platform is alive and well. Growth was well distributed with Google Search revenue up 11.7% to $54.2 billion, and overall advertising revenue up 10.4% to $71.3 billion. The cloud business remained strong with revenue up 32% year over year to $13.6 billion. On the bottom line, operating income increased 14% to $31.3 billion and earnings per share improved from $1.89 to $2.31, ahead of estimates at $2.19. Alphabet doesn't give guidance, but the results showed that the business continues to execute despite fears about the sustainability of its business model. However, there is one metric outside of the earnings report that shows why investors may be right to worry about the company's long-term future. Is the search empire in trouble? According to some third-party measurements, Google's market share in search has declined slowly but steadily over the last two years as alternatives like ChatGPT and Perplexity AI have hit the market. StatCounter reports that Google's market share has fallen from 91.1% in June 2024 to 89.6% in June 2025. That might not seem alarming as it represents just 150 basis points, and Google still dominates. But viewed another way, market share for Google's competitors has risen about 15% over the last year, which is not inconsequential. There are other risks to Google not seen in the numbers. As alternatives emerge in the area, there are great challenges to its supremacy and the relationships that help it maintain its dominance in search. For example, Alphabet stock tumbled when Apple acknowledged in court that it is considering making AI search engines like ChatGPT, Perplexity, and Claude options in its Safari browser, potentially jeopardizing Google's status as the default search engine. Apple has also considered acquiring Perplexity, which could lead it to displace Google entirely as the default search engine. Google prizes its default status in Safari enough to pay Apple $20 billion a year, but that pay-to-play relationship could also be coming to an end after a judge ruled the company was operating an illegal monopoly, which could lead to the end of the payments to Apple. Overall, the risks to both Google's market share and Alphabet's status in the face of antitrust rulings shouldn't be ignored. Is Alphabet a buy? The good news for Alphabet investors is that those risks seem priced into the stock. It currently trades at a price-to-earnings ratio of 20.5, which is less than the S&P 500 at around 27.5. Alphabet has also responded to the threat from AI search engines with new features like AI Overview and AI Mode, which uses its Gemini large language model, to give users a similar experience to what they'd get from Perplexity or ChatGPT. At the current stock price, Alphabet looks like a buy. Investors shouldn't ignore the threats to its market share or on the regulatory front, but it seems capable of continuing to deliver double-digit growth. That should make the stock a winner over the coming years, despite the evolving competitive landscape in the AI era. Should you buy stock in Alphabet right now? Everything you need to know about iOS 26 beta release: How to download it on your iPhone, new Apple features like Liquid Glass and more
Liquid Glass is a huge new change coming to iOS 26. (Apple) Waiting until the fall can feel like ages when you're ready to upgrade your iPhone to iOS 26. But there's good news: you can test out all the features now by downloading and installing Apple's public beta, which CEO Tim Cook says is (with the other current beta operating systems) "by far the most popular developer betas we've had," 9to5Mac reports. We also previewed the iOS 26 public beta release, which shows off the fresh home and lock screen redesign we've been asking to see for years. Called Liquid Glass, the new translucent look will extend across all of Apple's upcoming operating systems. The overhaul is one of several big changes coming to iOS, macOS, iPadOS and the rest of Apple's software suite, all of which were showcased during the company's WWDC keynote on June 9. After overpromising on AI plans last year, Apple kept its iOS roadmap focused more on basic quality of life improvements this year. There are multiple useful additions coming to the Phone and Messages apps on your iPhone, for instance: Apple execs outlined the ability to weed out spam texts or other unknown senders and an option to hold your spot on a phone call when you've been waiting for a representative to pick up. Plus, a treasured feature that we took for granted is coming back (hint: it's in the Photos app). Siri, meanwhile, is in a holding pattern. Apple has previously specified that its smarter voice assistant — first promised at WWDC 2024 — is delayed until some point "in the coming year," so you shouldn't expect any major changes in the current betas. But there are reports that Apple is aiming to give Siri a bigger brain transplant by basing it on third-party artificial intelligence models like OpenAI's ChatGPT or Anthropic's Claude, which could make 2026 a pivotal year. With each beta, it seems like additional new improvements are popping up, like a newly discovered FaceTime feature that'll freeze your video if it detects nudity. Most newer iPhone models are eligible to download iOS 26 (both the betas and final version). Want to see the full list of new features coming this fall? Read on. The current iPhone operating system is iOS 18, and Apple is still actively updating it — version 18.6 was just recently released. But don't expect to see iOS 19. Instead, Apple is skipping the numbering ahead to iOS 26 later this year. The company has decided to line up its iOS version numbers with a year-based system, similar to car model years. So while iOS and its sibling operating systems will be released in late 2025, they're all designated "26" to reflect the year ahead. (Meanwhile, iOS 18 is still getting new versions this summer, too.) It's official, we're moving to iOS 26. (Apple) Let's be honest. Out of everything announced at WWDC this year, the new Liquid Glass design was the star of the show. The iPhone's home and lock screens have looked pretty much the same year after year — the last exciting thing (in my opinion) was the option to add your own aesthetic to your home screen by customizing your apps and widgets. So seeing the home and lock screens' new facelift is refreshing. So what exactly is Liquid Glass? Apple calls it a "new translucent material" since, well, the apps and widgets are clear. However, the screen can still adapt to dark and light modes, depending on surroundings. You'll also notice buttons with a new floating design in several apps, like Phone and Maps. They're designed to be less distracting than the current buttons, but are still easy to see. While the design overhaul has proven to be controversial since its announcement, some — including Engadget's own Devindra Hardawar — like the new direction, even if it's somewhat reminiscent of Microsoft's translucent Windows Vista Aero designs from nearly twenty years ago. That said, as of the release of the iOS 26 beta 2, Apple has already incorporated some user feedback into the design, dialing back the transparency in at least some places. And while it will continue to evolve, Apple users won't be able to escape it: Liquid Glass was designed to make all of Apple's OSes more cohesive. Here's a look at how the translucent aesthetic will look with the new macOS Tahoe 26 on your desktop. iOS 26 has a laundry list of new features. Among the most worthwhile: Phone app redesign: You'll finally be able to scroll through contacts, recent calls and voicemail messages all on one screen. It also comes with a new feature called Hold Assist that'll notify you when an agent comes to the phone so you can avoid the elevator music and continue on with other tasks. Live Translation in Phone, FaceTime and Messages: iOS 26 is bringing the ability to have a conversation via phone call or text message with someone who speaks another language. Live Translation will translate your conversation in real time, which results in some stop-and-go interactions in the examples Apple shared during its presentation. Polls in group chats: Tired of sorting through what seems like hundreds of messages in your group chat? You and your friends will soon be able to create polls in group messages for deciding things like which brunch spot you're eating at or whose car you're taking on a road trip. Filtering unknown senders in Messages: If you haven't received spam texts about unpaid tolls or other citations, you're lucky. For those of us who have, those annoying messages will soon be filtered away in a separate folder. Visual Intelligence: Similar to a reverse Google image search, this new feature will allow you to search for anything that's on your iPhone screen. For instance, if you spot a pair of shoes someone is wearing in an Instagram photo, you can screenshot it and use Visual Intelligence to find those shoes (or similar ones) online. Photos tabs are back: For anyone who's still frustrated with the Photos changes made last year, you'll be happy to know that your tabs are coming back. Library and Collections will have their own separate spaces so you don't have to scroll to infinity to find what you're looking for. FaceTime "Communication Safety" feature: A newer addition to iOS 26 appears to be the FaceTime "Communication Safety" feature that pauses communications if and when nudity is detected. The feature appears to be a child safety feature that uses on-device detection, thus obviating any cloud-based privacy issues. Apple's Hold Assist will be nifty for those pesky services that put you on hold for 10 or more minutes. (Apple) A few iPhone models that run the current version of iOS — iPhone XR, XS and XS Max — won't be compatible with the latest upgrade. The iOS 26 public beta is now available to download via the Apple Beta Software Program. If you're not already a member, you'll need to sign up to try out all the latest features. Just visit and sign up with your phone number or email address. It's free. Once you're in, you can install it by going to Settings > General > Software Update and selecting iOS 26 public beta. A word of caution: Don't sign up with your main iPhone unless you're OK with any risks that occur with using an OS that isn't finalized. iOS 26 will be released to the public this fall. It usually comes in September, within a week of the Apple iPhone event. Last year, it rolled out to iPhone users on September 16 — exactly one week after the iPhone 16 lineup was announced.
