SC allows Delhi BJP govt to withdraw cases against Centre, L-G filed under AAP regime
The Supreme Court on Friday permitted the Rekha Gupta-led Delhi government to withdraw cases filed by the former AAP administration against the Centre and the Lieutenant Governor.
A bench of Chief Justice of India B R Gavai and Justice Augustine George Masih allowed this after Additional Solicitor General Aishwarya Bhati, appearing for the BJP-led government, said that 'these matters should not trouble this court anymore'.
The law officer pointed out that the seven cases filed by the then Arvind Kejriwal government included one on the control of services in Delhi, the authority of L-G in committees, including solid waste management and Yamuna River cleaning, and against the validity of some Acts and ordinances issued by the Centre.
The battle for control over services had resulted in a judgment by a five-judge constitution bench of the court on May 11, 2023. Giving control over services — excluding police, public order and land — to the Delhi government, the SC said the National Capital Territory administration is unlike other Union Territories and has been accorded a 'sui generis' (unique) status by the Constitution and that an elected government needs to have control over bureaucrats, failing which the principle of collective responsibility will be adversely affected.
In an apparent bid to overcome this, the Centre on May 19, 2023, promulgated the Government of National Capital Territory of Delhi (Amendment) Ordinance, 2023, to set up a National Capital Civil Service Authority for the transfer and posting of Group-A officers in Delhi.
The then AAP government challenged this before the SC, and the matter has been pending since.
Another such dispute between the Delhi government and the L-G was over the January 19, 2023, National Green Tribunal order, which said the L-G would head a high-level committee for Yamuna rejuvenation. On a challenge by the AAP government, the SC had stayed the order.
The two sides were also caught in litigation over the alleged non-release of funds for the Delhi Jal Board for 2023-2025 and the appointment of the Delhi Electricity Regulatory Commission (DERC) chairperson.
Earlier, cases filed by the AAP government against officers were also withdrawn from the Delhi High Court.
The AAP-led Delhi government had protested against the Ordinance and said it was behind the emboldening of bureaucrats who, it alleged, stopped following ministers' orders and attending meetings called by them.
AAP ministers and then Chief Minister Arvind Kejriwal had said the amended Act was a way to challenge the SC's verdict and had led officers to defy directions from the elected government, thereby stalling work in Delhi.
Some examples given by party leaders was the stalled work on water and sewer pipelines and repair of broken roads. Many ministers had also written to the L-G seeking action against officers and claimed the officers were only following the L-G's directions.
The allegations were denied by the L-G office.

Multi-party delegation meets Jaishankar after 4-nation tour on Operation Sindoor
External Affairs Minister S Jaishankar on Tuesday met members of a multi-party delegation and received feedback from them on how they exposed Pakistan in various countries over its support to terrorism. The delegation led by BJP leader Baijayant Panda met Jaishankar at his office here after the key diplomatic tour and presented their report. The delegation returned home Tuesday morning after visiting Saudi Arabia, Kuwait, Bahrain and Algeria. In these countries, the delegation members met foreign dignitaries and Indian diaspora during a series of meetings and exposed Pakistan's support to terrorism in the wake of Pahalgam terror attack and subsequent Operation Sindoor. Asked what the minister told them, he said, "He (Jaishankar) told us that our objectives were fulfilled and congratulated the delegation and its leader". Panda told reporters that their visit abroad was successful where they could explain India's "new normal" against Pakistan over terrorism. He said the delegation members were united and gave a very strong message to the countries they travelled. "A successful four-nation tour — Bahrain, Kuwait, Saudi Arabia and Algeria. All four countries have taken clear steps against terrorism and understand India's principled stand...," he said in a post on X. Panda said the countries they visited understand India and its history has been such that "we don't need to give any justification". "We are a country of non-violence and have provided shelter to people from several countries. We had wanted to give the message of India and the new normal that we will retaliate terrorist violence. We ave also imposed economic sanctions and our goal is that Pakistan should stop its policy of supporting terrorism," he told reporters. Panda also said that the countries they visited are supporting India, not just in economic growth but also against terrorism. Other delegation members who met the external affairs minister included former Jammu and Kashmir chief minister Ghulam Nabi Azad, Phangnon Konyak, Rekha Sharma and Satnam Singh Sandhu. Other members of the eight-member delegation included Nishikant Dubey and Asaduddin Owaisi.

Earlier, the cousins used to visit Gopinathgad separately each year, avoiding interaction due to their political differences. 'One Nation, one Husband?' Mann's dig at 'Sindoor' draws flak
Chandigarh, June 3 (UNI) "One nation, one husband?", Punjab Chief Minister Bhagwant Singh Mann's dig at BJP's "Ghar-Ghar Sindoor abhiyan" drew flak on Tuesday, especially from BJP leaders who alleged that Mann had mocked Operation Sindoor. Mann, in a press conference, was asked by a journalist about Sindoor being sent to Ludhiana. He quipped, "What is this scheme? One nation, one husband??" He termed the BJP's so-called scheme a joke.
