
Tribunal rejects Singaporean's tax refund claim due to jurisdiction issue
A SINGAPOREAN had his claim against an electrical appliances outlet dismissed by the Johor Consumer Claims Tribunal.
Claimant SB Koo had demanded the respondent refund customs tax paid by him, claiming the respondent had cheated him.
Respondent Izonic Electrical Sdn Bhd director Lim Chee Khoon said the company was willing to meet with Koo.
'We are willing to meet him to resolve the matter, but he refused,' Lim said outside the Johor Consumer Claims Tribunal at Menara Ansar, Johor Baru.
Lim said the claimant wrote a negative review of the company and this was picked up by a digital media portal on the island republic.
The respondent said the portal ran the story with the heading 'Singaporean man allegedly asked to pay S$268 for 'customs tax' after buying RM1,400 water filter in JB'.
Lim said the portal published the story on Feb 2 after the claimant made the purchase of the electrical items on Jan 17.
Lim, 37, said Koo, 61, went to the mall in Taman Abad, Johor Baru, with his wife.
The couple decided to buy home electrical appliances on display at the outlet.
The items were a water filter, Thermos pot, induction cooker, stainless-steel wok and a set of four ceramic bowls, totalling RM4,588.
'They were given a RM50 voucher which brought the bill down to RM4,538,' Lim said, adding that the claimant paid using a debit card.
Lim then sent the couple home to their Housing Development Board flat by car on Jan 17.
Lim claimed that he paid S$268 (RM888) in taxes on Koo's behalf at the Causeway and was later reimbursed.
Lim also made an appointment to instal the water filter on Jan 18, which the claimant agreed to.
'The claimant called our Singaporean representative on Jan 18 to inform him that he was busy and not at home,' said the respondent.
Lim said the representative called Koo many times to fix another appointment date but his calls went unanswered.
During the hearing, Tribunal president Hafez Zalkapli reminded both parties any decision made by the Tribunal could not be challenged.
Hafez dismissed Koo's claim, explaining that it was not the jurisdiction of the Tribunal to hear cases related to tax disputes as the case should be filed with the small claims court.
A small claims court is a specialised court handling civil disputes involving relatively small amounts of money, offering a faster and more affordable alternative to traditional litigation.

Titijaya inks deal for RM554mil transit-oriented development project in Cheras
KUALA LUMPUR: Titijaya Land Bhd's unit, Titijaya Development (Pulau Pinang) Sdn Bhd, has partnered with Mines Heights Development Sdn Bhd to develop a mixed-use, transit-oriented project in Taman Connaught, Cheras. The project, with a projected gross development value (GDV) of RM554.3 million, will be built on a 1.21-hectare plot owned by Mines Heights, based on approved plans and any subsequent authority-cleared variations. Under the agreement, Titijaya will pay Mines Heights an entitlement equivalent to 16.5 per cent of the project's net GDV, or not less than RM90 million. The payment will be settled 80 per cent in cash and 20 per cent in property lots. The entitlement value was determined on a willing-buyer, willing-seller basis after reviewing development returns, land suitability and accessibility, its transit-oriented development (ToD) potential and recent nearby land transactions. Titijaya Group Managing Director Datuk Lim Poh Yit noted that the project's proximity to the Taman Connaught MRT station will boost its appeal to residents and businesses by offering seamless connectivity across Kuala Lumpur. He added that demand for strategically located ToD projects is rising across the Klang Valley, especially among city workers and young graduates. "Besides playing to our strengths in urban lifestyle development, TOD projects also typically deliver higher productivity and lower carbon footprints, aligning with our commitment to environmental, social and governance in real estate development," he said in a statement. Lim said the new project builds on Titijaya's track record with its flagship integrated ToD in KL Sentral, Riveria City. The first phase, The Riv, was completed last year and fully sold. Express Powerr aims to raise RM36 million from IPO
KUALA LUMPUR: Express Powerr Solutions (M) Bhd, a standby power generator rental specialist, is set to debut on the ACE Market of Bursa Malaysia Securities on Sept 24, following the launch of its its initial public offering (IPO) prospectus today. The group aims to raise RM36 million from the IPO, with funds earmarked to expand its generator fleet and strengthen its market presence across Malaysia. The IPO comprises a public issue of 180 million new shares, representing 19.3% of the enlarged share capital and an offer for sale of 65.4 million existing shares or 7%. At the issue price of 20 sen per share, Express Powerr will have a market capitalisation of RM186.9 million upon listing. Of the proceeds from the IPO, RM20.5 million will be allocated for the purchase of new standby generators, RM7.5 million for working capital, RM5 million for repayment of bank borrowings and RM3 million to cover listing expenses. Managing director Lim Cheng Ten said the listing marks a new chapter for the group, positioning it to meet rising demand for standby power solutions driven by rapid industrial and commercial development. He added their goal is to continuously invest in technology and expand their generator fleet so that they can support industries that require reliable and efficient standby power solutions.
