Royal AM plunges further deep into trouble with the courts and PSL

IOL News08-07-2025
IT doesn't rain but it pours for beleaguered Durban business woman Shauwn Mkhize and her football club Royal AM, with the Pretoria High Court on Tuesday delivering another 'scathing judgement' against the two parties.
The judgement details are staggering and show that the National Soccer League (NSL)was misled on a number of occasions and that it (the league) had enough reason to expel the Pietermaritzburg-based club even prior to them (the club) going into administration.
Backing this judgement, the court cited that:
-Contravention of Article 14.6: Royal AM changed its shareholding and directorship in June 2023 without PSL's prior written approval.
-Contravention of Article 10.14: The club misrepresented its directorship in its membership renewal application in July 2024.
-Contravention of Article 10.16: Royal AM was unable to fulfil its obligations, including failing to play fixtures and honour financial commitments.
All this happened before the club was put under curatorship by the South African Revenue Services (SARS) months ago due to Mkhize's troubles with the taxman.
That came with the freezing of club accounts and therefore unable to honour their fixtures and resulting in the Board of Governors (BoG) of the NSL expelling them (the club) from the Premier Soccer League (PSL) during the 2024/2025 season.
All this comes as Royal AM are still at loggerheads with the PSL with attempts to oppose the league's decision to expel them.
When Royal AM was confirmed to have purchased the status of Bloemfontein Celtic, reports were that it was purchased by Mkhize's close family member by the name of Nosipho Ngubo.
That was due to Mkhize having another matter with the PSL at that time.
In the judgement, many shareholders are cited to have obtained stakes in the club as off June 2023, after Shauwn Mkhize and Andile Mpisane resigned appointing a Mr Shamish Sadab as sole director.
Last week, Royal AM were stripped of the R27 million sponsorship by the Msunduzi Municipality.
Reasons given by the municipality were that the sponsorship deal was that it would be in place on condition of the club staying in the PSL.

Malalane attorney's fraud case: Failure to secure legal counsel results in another delay

The fraud trial of suspended attorney Zietta Janse van Rensburg was postponed again today (July 23) after she appeared in court without legal representation. The case has faced numerous delays since July last year, several of them due to her failure to secure legal counsel. ALSO READ: Trial postponed again: Zietta Janse van Rensburg returns to court in June Magistrate postpones attorney's fraud case to September Magistrate Jacob Mamabolo asked about her legal representation and who Janse van Rensburg had indicated as her attorney during her previous appearance. She replied that Johannesburg-based attorney Marco Lamberti had been appointed and that his contact details had been shared with the state. 'He has another matter in Randburg but was due to be here today,' Janse van Rensburg explained. Mamabolo's response was to postpone the matter to September 1 – and he instructed Janse van Rensburg to appear with a legal representative. 'Are you aware that at the present moment, you are by yourself?' he asked. Prosecutor says Onderberg attorney sent him WhatsApp messages, emails Before she could respond, state prosecutor Tobie Steyn intervened, questioning the accuracy of her claims. 'Ms Janse van Rensburg is placing certain information on record as if it is the truth,' said Steyn. He went on to say that he had been contacted by Adv Hennie van Rensburg, who had read in a newspaper article that he had supposedly been reinstated as her legal representative. Steyn said the accused then started sending him WhatsApp messages and emails on the matter. He told the court that he had never spoken to Lamberti but confirmed that he was copied on an email. 'But it is not my responsibility to confirm with her lawyer,' he added. He requested that the court reiterate the need for the attorney to appear personally to be placed on record. Complainants will be unhappy about accused talking to state, warns magistrate Mamabolo further instructed Janse van Rensburg not to have direct contact with the prosecutor. 'Only a witness may contact a prosecutor. You are absolutely not allowed to, and it is uncalled for. Should the complainants hear of this, they will not be happy,' he said. In response, Janse van Rensburg told the court she had taken it upon herself to make arrangements to save costs, since Lamberti would otherwise have to appoint a corresponding attorney to attend in his absence. Janse van Rensburg said she was in a difficult position and requested permission to step outside and call Lamberti. Janse van Rensburg returned with confirmation that Lamberti would be available on September 1 and said she had already instructed him to represent her. Mackenzie slams BT Academy owner as stranded kids are all set to return home

Several parents were forced to scramble for funds to bring their children back, as safety concerns mounted. The team was scheduled to return to South Africa on July 16, but chaos erupted when it was discovered that they had no tickets to get home. A group of young players from the Kraaifontein-based academy in Cape Town had travelled to Spain to participate in the Donostia Cup International Tournament. Each child's trip reportedly cost close to R50,000 to cover all the costs. Western Cape MEC for Sports, Arts and Culture Ricardo Mackenzie says the remaining BT Football Academy players stranded overseas are expected to arrive back in South Africa by Thursday afternoon. Mackenzie, speaking amid nationwide outrage over the situation, confirmed that the provincial government has begun reviewing the legal standing and operational compliance of the academy. He also revealed that he has been in direct contact with the owner of BT Academy, Brandon Timmy, and believes Timmy has not been honest throughout the ordeal. 'The kids should be back home by 3pm tomorrow. We are now going through all the documentation and communication,' Mackenzie told eNCA. 'I myself have been speaking to the owner since Monday morning and I have since gone through to have a consultation with the premier because he has not given us truthful information since then. 'Every hour he says that he is waiting for a loan, and by the time I left for Portugal nothing was done by him. 'He keeps on giving people the runaround, and I spoke to the coaches on the ground who gave me firsthand information that helped inform my decision to go there.' Popular local media personality Tracey Lange, through her initiative Tracey Lange Cares, has played a key role in rallying community support and raising funds to assist in bringing the remaining players home. Mackenzie acknowledged that Lange's intervention has been critical. 'Even on Tuesday he told me he had paid for the accommodation, but even that was not true because it was paid for by the Tracey Lange people,' Mackenzie added. The MEC further revealed this was not the first time such a situation had occurred with the BT Academy. A similar incident reportedly took place during a previous trip to Dubai, raising further concerns about the academy's operations. 'Speaking to the coaches, they informed me that this is not the first time this has happened — they were once stuck in Dubai with the very same company. We will be sure to take action and ensure accountability, but right now it's just about ensuring that the kids get home safe.' Mackenzie said this incident has exposed significant gaps in oversight and that the government will tighten regulations around such tours moving forward, particularly when they involve minors traveling abroad. 'This was not a sanctioned tour by anybody. 'Going forward as a country we need to decide how we deal with these things. What is the country's policy on dealing with unsanctioned tours? We want kids to gain international experience, but they cannot go overseas without formal federation commitment.' In other reports, South African Football Association (Safa) Cape Town president, Bennet Bailey was quoted saying a full investigation will be launched against BET Academy, which is said to be not registered with Safa.
