The State Bank's role in regulating emerging technology

The State Bank of Pakistan, traditionally known as regulator of the country's credit ecosystem and implementer of its monetary policy, has now found itself operating in unchartered waters, beyond its statutory obligations documented in the SBP Act, 1956 and the Banking Companies Ordinance, 1962.
With rapid digitalization of the financial sector and increasing adoption of cross-border payment solutions, Pakistanis facing rising concerns with cybersecurity and protection of sensitive consumer data. The country is witnessing an unprecedented technological revolution, whilst being regulated by outdated consumer data protection laws.
The State Bank has taken significant steps to encourage adoption of innovative financial technology in Banks and DFIs, whilst ensuring protection of sensitive consumer data through well-structured frameworks.
However, the central banks recent initiative to foster innovation in SECP-regulated and non-regulated entities, goes beyond the scope of its frameworks and is grounded by the outdated Payment Systems & Electronic Fund Transfer (PS&EFT) Act, 2007, a statute brought to law before the advent of modern technology such as Generative AI, Cloud Computing and Big Data.
With the absence of modern data protection laws,and the rapid adoption of third-party digital solutions in the financial sector, the State Bank is forced to navigate these statutory gaps on its own.
In May 2025, the State Bank issued guidelines for inviting applicants to its newly-launched Regulatory Sandbox.
The sandbox is a controlled environment where tech innovators can test novel digital solutions using real consumer data, without being suppressed by regulatory red tape.
The sandbox is open to 1) SBP regulated entities such as banks and DFIs, 2) Entities licensed by other regulators such as SECP and 3) Non-licensed entities. This initiative hits the jackpot for fintech solution providers, start-up founders and digital innovators, however, being legally backed by the PS&EFT Act, this leads to concerns for protection of sensitive consumer information.
With underdeveloped data protection laws, the State Bank is compelled to serve a dual role: upholder of economic stability, as per its statutory obligations, and now as a de-facto technology regulator.
In response to this added responsibility SBP released the Enterprise Technology Governance & Risk Management (ETGRM) Framework in 2017. The framework covers areas such as cybersecurity, third party risk and consumer data protection obligations for licensed banks and DFIs.
The regulatory sandbox, however, is legally confined by the PS&EFT Act 2007, a federal statute primarily designed to govern electronic transfers and digital payments, with outdated provisions related to consumer data protection.
It fails to address data privacy concerns arising from the technology being developed in the modern digital age. The State Bank is now in a position where its own security standards, developed for SBP regulated entities, have surpassed federal legal obligations, in terms of data protection and cybersecurity provisions.
In the EU, UK and other developed countries, regulatory sandboxes have played a pivotal role in successfully launching full-scale neobanks, AI-based financing tools and cross border payment systems.
The central banks in these developed countries are not expected to work in regulatory silos and are supported by robust legislation, such as the European Union's AI Act 2024, General Data Protection Regulation (GDRP) and the recently enacted Digital Operational Resilience Act (DORA). In Pakistan, policy failure at federal legislative level, has placed the burden of regulating digital innovation in the financial sector entirely on the central bank.
In developed countries, a regulatory sandbox serves as a launchpad, an innovation enabler where fintech products undergo detailed scrutiny to de-risk any shortcomings in their business model before full-scale launch in the market. The central banks, with robust consumer protection laws, are then able to focus on innovation rather than regulation.
On the surface, the State Bank of Pakistan's decision to enable fintech experimentation under its supervisory guidance seems to be a significant step towards enhancing digitalization and financial inclusion in the country.
However, it is evident the regulator ishaving to use the regulatory sandbox to help identify operational grey areas in the emerging tech landscape. With the absence of historical data and regularity clarity – particularly around consumer data protection and fintech – SBPs sandbox, instead of being a proactive driver of innovation, is a learning tool for assessing new technology in a controlled environment, to understand its scope, enabling its governance after full-scale launch.
The Asian Development Bank, in its 2025 diagnostic report on Pakistan's Digital Ecosytem, recommends formalization of an inclusive data governance framework, with clearly defined procedures for data security, privacy and data sharing.
Policymakers must recognize the importance of a coherent and future-ready regulatory environment to enable timely adoption of emerging technology whilst safeguarding sensitive consumer information through adoption of a comprehensive digital governance and cybersecurity legislation.
The future of financial digitalization in the country depends on the proactive formalization and implementation of an all-encompassing legal framework. With the absence of such reforms, the State Banks non-traditional role in enabling fintech reform risks becoming a bottleneck rather than a pathway to a digitalized economy.

ISLAMABAD: The Power Division and the State Bank of Pakistan (SBP) are reportedly at odds over the repatriation of Rs 431 billion owed to Chinese power sector projects—an amount meant to be repatriated through commercial banks, well-informed sources told Business Recorder. This issue came to light during a meeting of the Sub-Committee on Reforms, chaired by Minister for Petroleum and Natural Resources Ali Pervaiz Malik. The meeting was also attended by Special Assistant to the Prime Minister on Industries and Production, Haroon Akhtar. Chinese coal-fired power projects, such as Port Qasim and Sahiwal, have been persistently writing to the Ministry of Finance, seeking clearance of these outstanding payments. Chinese IPPs face Rs500bn in unpaid dues The matter surfaced during discussions on proposed measures to mitigate currency risks for foreign investors in Pakistan. The SBP stated that no loan repayments—whether principal or interest—nor profit repatriation payments are pending with the SBP or any commercial bank. The central bank acknowledged that only a profit payment of $26.5 million is pending with one commercial bank, which it expects will be cleared soon. SBP further clarified that no verbal or written directives had been issued to commercial banks to delay LC payments or other financial transactions. However, the Power Division reported that while the power payment cycle typically spans 90 days, Rs 431 billion in payments remain stuck with commercial banks—primarily for non-energy components. A detailed ageing report presented during the meeting indicated that while no energy payments have been overdue for more than three months, non-energy payments have been pending for years. The depreciation of the rupee has further reduced the dollar value of these payments. No representatives from NEPRA attended the meeting, and no information was shared regarding eight pending cases. The SBP reiterated that no Chinese company payments are currently pending for profit repatriation or debt servicing, and it has issued no instructions—verbal or written—to banks in this context. However, the SBP was asked to provide a written report detailing all payments to Chinese companies pending with commercial banks, including ageing data. The Power Division maintained its stance that Rs 431 billion in payments are pending with various banks and remain un-repatriated by the concerned Chinese companies. NEPRA was directed to provide an update on the potential claw back of the eight cases under adjudication. No conclusive way forward was proposed during the session. The committee noted a divergence in views between the SBP and the Power Division, making it difficult to issue a clear recommendation due to the lack of clarity. The chair emphasized several core principles as essential for attracting investment: (i) adherence to due process of law ;(ii) sanctity and enforceability of contracts;(iii) provision of adequate security measures ;(iv) a competitive and transparent process, and (v) policy consistency and predictability in the medium term. Regarding the development of physical infrastructure and utility services at Special Economic Zones (SEZs) and Export Processing Zones (EPZs), the Board of Investment (BoI) informed the sub-committee that six SEZs will be marketed to Chinese investors. BoI said that 40 companies have been identified to showcase as success stories, which will be narrowed down to 5–10 for targeted promotion. The committee supported promoting six SEZs—AIIC, BQIP, KIP, Rashakai, Dhabeji, and PSM—to Chinese investors. Of these, 3,000 acres are available for development at PSM and 700 acres at AIIC, with additional land parcels available at other developed SEZs, all equipped with basic amenities. The committee recommended establishing Service Level Agreements (SLAs) to define timelines. On easing regulatory hurdles and creating a one-stop-shop mechanism integrating federal and provincial authorities, the BoI presented updates on its Business Facilitation Center (BFC) initiative. BoI highlighted the 'regulatory guillotine' efforts and modernization of the Companies Act. The Cabinet Committee on Regulatory Reforms (CCoRR) has been notified, and BoI claims that two reform packages will reduce the cost of doing business by Rs 250 billion. Three additional reform packages are in the pipeline for CCoRR approval. BoI also shared its role in integrating 20 departments with SECP, harmonizing food standards across federal and provincial jurisdictions, and reducing DRAP's medical device registration timeline from two years to 45 days. The committee recommended that BoI implement a hub-and-spoke model for BFCs linked to regional offices in the six priority SEZs. SLAs will also be developed for these centers to provide transparency and predictability for investors. On reducing port clearance times and enhancing cold chain logistics, the Secretary of the Ministry of Maritime Affairs (MoMA), along with the Chairman of Port Qasim Authority (PQA) and the General Manager (Operations) of Karachi Port Trust (KPT), briefed the committee. They reported that recent reforms have reduced consignment clearance time by 24–48 hours. However, no precise data was available on reefer (refrigerated container) occupancy or costs. It was also noted that 35–40% of consignments are routed through yellow or red channels, and various departments at ports impact both import and export processes. The chair inquired whether consignments of vetted and established investors could be moved to the green channel. The committee recommended developing a comprehensive port governance model that ensures one-window operations and standard procedures for cold chain storage, aligned with international best practices. SLAs should also be signed with investors to guarantee faster clearance of their consignments. Pre-clearance mechanisms and a grievance redressal help desk for reputable importers were also advised. Lastly, the chair took serious notice of the long-vacant post of Chairman KPT and directed the Secretary of MoMA to resolve the matter urgently. ISLAMABAD: The Securities and Exchange Commission of Pakistan (SECP) and the State Bank of Pakistan (SBP) held the 33rd Coordination Committee Meeting at the SECP Head Office in Islamabad. The SBP-SECP Coordination Committee serves as a high-level platform for strategic dialogue and regulatory coordination between Pakistan's two key financial regulators. It aims to strengthen collaboration, ensure policy alignment, and drive joint initiatives for the development and stability of Pakistan's financial system. Governor Jameel Ahmad underscored the importance of leveraging capital markets as an alternative and sustainable source of funding for the government. He noted that this approach would enable banks to focus more on financing the private sector and driving economic growth. He appreciated SECP's efforts in advancing market infrastructure and reaffirmed SBP's commitment to collaborative reform. SECP Chairperson, Akif Saeed, highlighted the pivotal role of banks in strengthening Pakistan's capital markets. He emphasized that closer linkages with capital market institutions and active collaboration could enable banks to fully leverage permissible opportunities, driving market growth and broader economic development. Key discussion areas included digital payment integration within the capital market, streamlined access to credit information for regulatory purposes, and potential solutions to address legacy credit data challenges. The Committee also reviewed progress on initiatives related to financial product innovation, shared digital infrastructure, and regulatory alignment in emerging sectors. ISLAMABAD: The Competition Commission of Pakistan (CCP) will strictly monitor the fertilizer sector as the fertilizer industry is prone to cartelization and behavior of the fertilizer manufacturers may attract certain provisions of the Competition Act, 2010. The CCP has released a draft report titled 'Competition Assessment of the Fertilizer Industry in Pakistan', exposing the probability of cartel formation is higher for products that are homogenous like various types of fertilizers. This possibility increases even more when the number of players is low and the market is concentrated. Therefore, as per Section 4 of the Competition Act, 2010, the CCP needs to monitor closely the possibility of a cartel to fix prices and production. This is even more crucial when the industry depicts a pattern of price parallelism for urea and high profit margins, CCP added. In the downstream fertilizer market, to guarantee sale of fertilizer stock, the fertilizer manufacturers obligate the fertilizer dealers to buy DAP with urea or vice versa. Similarly, to buy slow moving micronutrients with Urea/DAP. To stay in the business, the dealer is obligated under the dealership agreement. This is an abuse of dominant position by the fertilizer manufacturers, and therefore a violation of Section 3 (2)(e) of the Competition Act. Therefore, this Report suggests the CCP to monitor the conduct of the fertilizer manufacturers under Section 3(2)(e) of the Act. CCP fines fertilizer firms, FMPAC Rs375mn for price fixing The fertilizer industry is prone to cartelization having oligopolistic market structure and homogenous inputs required for production. Therefore, a brand-wise competition review reveals 'price parallelism' in the industry, even when applicable gas prices are different thus raising competition concerns. The behavior of the fertilizer manufacturers may attract certain provisions of the Competition Act, 2010, Section 3 and 4 in particular. It is therefore recommended that the CCP may strengthen its regulatory oversight of the industry. Furthermore, the SECP under its current regime may seek cost audit of the fertilizer industry to gauge any irregularities. This eventually will help CCP determine a patterns indicative of anticompetitive behaviour. The CCP, vide its Policy Note 'Reinstatement of Requirement for Cost Audit under Companies Act, 2017' dated 8th May, 2020, has recommended the SECP to reinstate the requirement of cost audit for Fertilizer industry, among others to facilitate policy interventions in a fair, transparent, and independent manner, CCP report added. The fertilizer producers make contracts with the dealers downstream and negotiate certain terms for granting distributorships. At times, these terms and conditions are alleged to be anticompetitive due to the oligopolistic market structure. Therefore, the terms of these contracts need to be reviewed such that the manufacturers do not abuse their dominant position. Under Section 5 of the Competition Act, the CCP grants exemption to parties involved in the agreement. Earlier, two fertilizer manufacturers; two companies have taken exemption from the CCP on their agreements with their distributors. However, the exemption of FFC has expired and currently only EFERT holds a valid exemption on their agreements with their distributors. The remaining manufacturers, however, have not sought exemption from the CCP for their distributorship agreements. The binding agreements are against the spirit of competition. Therefore, the CCP needs to review the agreements to grant exemption. This Report recommends the CCP to evaluate the agreements of all fertilizer manufacturers with their distributors for any violation of the Competition Act, 2010. Copyright Business Recorder, 2025
