Paywave costs should be passed on to customers

The Finance Minister says when a ban on contactless card payment surcharges comes into effect, businesses should pass on the cost to customers as they would any other business cost, if they can't absorb the bill.
The government plans to ban surcharges on contactless card payments no later than May 2026.
Commerce and Consumer Affairs Minister Scott Simpson announced the change on Monday afternoon, declaring: "That pesky note or sticker on the payment machine will become a thing of the past."
"Shoppers will no longer be penalised for their choice of payment method, whether that's tapping, swiping or using their phone's digital wallet."
The ban builds on the Commerce Commission's recent decision to reduce the interchange fees imposed on businesses for accepting Visa and Mastercard payments.
Finance Minister Nicola Willis told RNZ that change has led to an average reduction in costs for a typical retailer - a small business - of about $500 each week.
"So our concern has been, now that reduction has happened, how do we make sure that gets passed through to you, when you're at the shop. What's to stop the retailer just charging you the same fee even though their costs has dropped."
Banning the paywave fee was the simplest and most transparent thing to do, Willis said.
Businesses need to treat the interchange fee like any other cost in their business "and just include it in the price tag on the shelf", she said.
"It'll make it easier for people to compare what they're really having to pay. Just think about how many times you've been at the counter and then suddenly you learn that it's a 2.5 or a 3.5 percent surcharge and that gets added to the price of whatever it is you're buying. That's not very transparent."
The sector is warning prices may need to rise at restaurants and cafes due the ban.
Asked if she thinks the ban will lead to inflationary prices, the minister said "I think that overall, people will charge the price that they think they can get away with".
The change doesn't include international credit card payments or online payments. Willis said these payments were usually much more expensive to process and people using these systems have to pay a bit more because they are protected from things like online scams and fraud.
Consumer NZ chief executive Jon Duffy told RNZ with a reduction in the interchange fee, businesses would be making a profit off the surcharges if they remained in place.
"Retailers still pay a small amount ot offer those services, we think that once... the decrease comes into effect it will be less than 1 percent of the total cost of the transaction," Duffy said.
Many businesses would absorb this into the prices though there may be some who need to increase prices to cover the cost, he said.
"But it would be just the same as if their... power bill or their rent went up."
Consumer NZ was a bit disappointed online transactions were not included but it was understandable for now, he said.

Rosso says the changes are essential to securing the country's future and safeguarding the rights of landowners. Prime Minister James Marape commended Rosso for spearheading the reforms. 'Land is our people's greatest inheritance-our playground, our home, our heritage. Every Papua New Guinean is connected to a piece of land somewhere in this country. We must protect it,' Marape told parliament. RNZ Pacific spoke with its PNG correspondent Scott Waide about the government's motivations for the changes. (This transcript has been edited for brevity and clarity.) Scott Waide: The Lands Department has been, for want of a better word, terminally ill, for many years. It has had legislation that dates back to the colonial era. Papua New Guinea has moved on [and] moved forward with a lot of things. But the [land] legislations have been a hindering mechanism for any form of large scale development, like farming [and] real estate development. Those laws have been a hindrance to much of that development, and also the mobilisation of customary land. Previously, with the old laws, customary landowners could not adequately mobilise and get loans to develop their land, because the laws [and banks] did not recognise customary land ownership, and the accompanying attempts to allow for that development of customary land. It has posed a lot of complications in terms of mining development, logging [and] farming. The changes that have been introduced allow for both protection of customary landowners and the possibility of them venturing into large scale businesses. Don Wiseman: It has being brought in by the Deputy Prime Minister John Rosso. What specifically is he going to do? You have outlined the issues that have existed over land for a long time, but are they going to be overcome with this new legislation? SW: Yes, many of the problems that have existed for many, many years – from a very, very old system, a manual system, when the rest of the world is operating digitally. We have had instances where they have been dual titles issued, issued titles over land that have gone missing, because people are reproducing those titles manually. There is an electronic system that has been introduced as well within the Lands Department, and that is meant to reduce the instances of corruption that have long existed. A lot of the reforms have happened very quietly within the Lands Department. The other reforms that complement the development of housing, which is a big need in Papua New Guinea, support the development of customary land as well. So customary land owners can partner with government or with private organisations and develop housing, cheap housing for other Papua New Guineans. DW: Prime Minister James Marape says this will save the land that is still held, but it is clearly not going to undo a lot of the mistakes from the past, and they have been so many of those, particularly to do with the forestry and so on. SW: Yes, that is a an issue that I have spoken to a few land experts as well around. And that is going to be a huge challenge to undo all of that. The other side to it is that there are customary landowners who also sell their own land for cash. The legislations that have been put in place, in the some of the policies have actually banned the sale of customary land to individual parties as well. So, it offers some level of protection for customary land owners. There needs to be a lot of awareness as well for customary landowners to understand how the law benefits them, and that is going to also take a while.

The brewery was founded by Matt and Gemma Smith, who started out selling their beer at farmers' markets in 2013, before shifting to permanent premises in Hastings CBD in 2020. So this has totally blown us away. 'We are a very regionally-focused brewery and Hawke's Bay consumes most of our beer. We are so incredibly grateful to the people of Hawke's Bay that have always supported us and cheered us on. They have helped us grow in so many ways.' It is the first time in 18 years that one brewery has collected three beer category trophies. Matt Smith said the team had been 'hyper-focused' on the 'little details' this year and had made 'incremental steps towards brewing the best possible beer'. 'So having this feedback from some of the best judging palates in the country and winning these awards has been so validating.' New Zealand's brewers are embracing new ingredients and styles, head judge Tina Panoutsos said. 'We've seen different ingredients used creatively and represented across a range of styles from fruit and flavoured, European ales and experimental classes. 'There's a trend toward using a range of fruits like the native Horopito and stone fruits to influence texture and complexity.' Wellington brewery Garage Project added to its trophy cabinet, collecting four prizes and the highest number of medals of any entrant – 10 gold, 11 silver and six bronze. Garage Project was also named Champion New Zealand Large Brewery and won two beer category trophies: British & European Ale and Wood & Barrel Aged. Matakana independent brewery Sawmill won the Brewing Sustainability Award for the sixth consecutive year. The New Zealand Medium Brewery winner is Altitude Brewing, from Queenstown. Altitude also took home two beer category trophies – New Zealand Lager & New Zealand Pilsner and the Juicy/Hazy IPA Trophy. Of all of the above, it's the ban that's going to give them ongoing headaches. On the face of it, it's great retail politics. Everyone hates being stung 2% for using the credit card at the sushi shop. But there will be consequences. The surcharge is there because it costs to use your credit card. Someone has to pay for it. Either you or the retailer. Currently, it's you in the form of the surcharge. After the ban, it'll be the retailer. And we're talking a lot of money. Interchange fees alone – the fees Visa and Mastercard charge – suck nearly $1 billion out of NZ businesses a year. Add what retail banks charge on top of that and we're talking several billion apparently. One retailer reckons they were paying $2500 a month just in merchant fees. That's $30,000 a year. They realised they were basically subsidising everyone's credit card loyalty schemes. So, they introduced the surcharge. No savvy small or medium-sized retailer will suck up a cost like that. If they can't get that back through a surcharge, they'll get it back by upping the price on products. So, while the Government can sell the story that they're saving consumers money through the ban, they're not. Pity the poor travel agents especially. Let's say they book flights to London for a family of four at the cost of $15,000. If the family put it on the credit card, which most of us would do, there is a $225 merchant fee. Once the ban kicks in, the travel agent will essentially be helping the family pay for their holiday. So, you can see why retailers are up in arms. They're so angry they've managed to mobilise the country's chambers of commerce into banding together in a statement criticising the ban. Their point is a fair one: the Government should really be dealing with the source of the problem, which is banks and credit card companies charging too much for a basic service. Ministers choosing to beat up on Kiwi retailers instead of sorting out big foreign bankers is bizarre. Even more so because SME owners are traditionally National Party and right-leaning voters. The Government is burning its own support base here. Which brings us to the weirdness of this. It should have been entirely predictable that this would blow back badly. So, why did they do it? Are they so desperate to get good coverage that they take any half-baked idea pitched at them by a minister at the weekend to announce the following Monday? Did they run out of time to interrogate the idea before announcing it? Or did they anticipate all the problems but ignore them in their desperation to get a cost-of-living announcement out? It also begs the question, why are they so panicked? The answer is probably that it's not just the Government's vibe that has shifted. It's the country's vibe too. It's the middle of this Government's term and the middle of winter and the tail end of a very long and hard recession. The goodwill towards the coalition Government is suddenly depleting. It's possibly recoverable. Summer and an economic recovery should improve things again. But even when we're warm and flush, it won't stop the Government stuffing things up itself if it keeps making weird announcements like this. Watch now for how they get out of this. And they'll have to. They can't be doing this to their own voter base just months out from next year's election.
