Plea to establish National Centre for Ageing in all districts in Tamil Nadu dismissed

The Madurai Bench of the Madras High Court has dismissed a petition that sought a direction to the Centre to establish National Centre for Ageing in all districts in Tamil Nadu.
A Division Bench of Justices S.M. Subramaniam and A.D. Maria Clete observed that welfare schemes were being implemented by the Central and the State governments for the benefit of senior citizens.
The court observed that the number of centres to be established cannot be gone into by the High Court in writ proceedings. It is for the government to implement welfare schemes for the benefit of citizens in a phased manner and such implementation is a matter of policy decision.
The court was hearing the petition filed by K.K. Ramesh of Madurai. The petitioner said parents were being ignored by their own children and the elderly were being disrespected. The number of old age homes had increased.
There were complaints that some old age homes charge high fees and do not take care of the elderly. This is causing difficulties to the elderly. Some old age homes do not provide basic facilities, food, medicine, etc, he said and sought a direction to the Centre to establish the National Centre for Ageing in all districts in the State.

"Public education in TN is in steady decline," he said. Students are merely passing with certificates, and without job opportunities, he said. Alleging that social and educational discrimination was on the rise, Ravi said dalits are physically assaulted and at times even killed for their attempt to share the common public space. "It is a matter of collective shame that even after 78 years of Independence, rampant humiliating social discrimination practices are prevalent in our state," he said. Ravi said according to national crime records bureau, about 20,000 suicides are reported from TN every year, more than double the national average. The suicides reflect the prevailing acute social, psychological, or economic distress in the society, he said. Ravi alleged that drug abuse, especially among youth, was sharply increasing, particularly synthetic drugs. He also alleged that there was a sharp increase in the incidents of sexual offences, especially Pocso cases. Rejecting Ravi's charges, municipal administration minister K N Nehru said data released by Union govt shows TN was ahead in social and economic parameters. He said TN govt has responded to these charges with data in the past. "The governor is lying, frustrated over the boycott of his Independence day tea party by DMK allies," he said. Nehru also dismissed the statement that Centre has been supporting the development of TN by providing 'substantial funding', which included 3lakh crore as grants-in-aid. "The last Union budget had no mention of TN," he said. School education minister Anbil Mahesh Poyyamozhi said if Ravi was concerned about education of children in TN, he should urge Union govt to release pending funds for school education department.

Madurai: After the state govt informed that the process for appointment to the post of director general police (DGP) was ongoing, Madras high court on Thursday reiterated that pre-appointment procedures contemplated by Supreme Court, and the consequential orders of the Centre and Union Public Service Commission (UPSC) are to be scrupulously followed to maintain independence and transparency in the matter. A division bench of Justice S M Subramaniam and Justice G Arul Murugan observed that empanelment of officers for appointment to the post is to be strictly done in consonance with the above directives. It was brought to the court's notice that a petition filed before the principal seat in Chennai seeking a similar prayer was dismissed as premature by the coordinate bench by an order dated Aug 4. "We concur with the said view taken by the coordinate bench at the principal seat in view of the fact that the appointment to the post of DGP is yet to be made," the judges observed. In view of the state's submission that the process for appointment to the post is ongoing, the judges said no further interference is required in the petition at this juncture, and disposed of the public interest litigation filed by advocate K Yasar Arafath of Ramanathapuram district. The petitioner stated that the present DGP, Shankar Jiwal, is set to retire on Aug 31. Hence, he moved court seeking a direction to the Centre and state govt to immediately initiate the empanelment process in accordance with the directions of Supreme Court in Prakash Singh v. Union of India judgment. The petitioner also sought a direction to restrain the home secretary from appointing any officer as in-charge or acting DGP or granting an extension to the present DGP without following due process.
