Delhi moves Supreme Court seeking review of ban on ‘end-of-life' vehicles
'The road-worthiness of a vehicle is a technical and scientific issue that must be linked to actual emissions as tested and recorded by mechanisms, as opposed to blanket ban on the basis of age,' the Delhi government argued in its petition, according to The Indian Express.
The Rekha Gupta-led government also said that age-based restrictions are no longer justified.
A bench led by Chief Justice of India BR Gavai will hear the matter on Monday.
Though well-intentioned, the ban had 'caused numerous practical hardships to the citizens of Delhi, which today, in light of the advancements in technology and enforcement now prima facie appear to outweigh the prudence and feasibility of continuance of the said ban', stated the government.
It added that advancements in vehicle technology, widespread implementation of Pollution Under Control norms and the rollout of Bharat Stage VI engines 'suitably address the concerns' that had prompted the top court to pass its judgement.
The government also requested that the Union Government or the Commission for Air Quality Management be directed to conduct a broad, scientific study to assess whether the age-based ban serves its intended purpose, Live Law reported.
It also pointed out that vehicular emissions are one of several factors contributing to Delhi's poor air quality. Other major sources include stubble burning, construction dust, industrial emissions and weather conditions.
On July 1, the Commission for Air Quality Management's directions to fuel stations to stop supplying petrol or diesel to 'end-of-life' vehicles came into effect. However, the order was deferred until November 1 over technological issues and concerns about cross-border fuelling.
The decision to delay the enforcement came after the Delhi government raised concerns about public inconvenience and implementation hurdles. Although the Delhi government had originally backed the measure, public backlash led to a reassessment.

SC fixes Aug 19-Sep 20 hearing schedule for Presidential Reference; will hear preliminary objection of TN & Kerala on its maintainability
Supreme Court NEW DELHI: A five-judge constitution bench of the SC led by CJI B R Gavai on Tuesday fixed a nine-day schedule to deliberate on a Presidential Reference that has questioned the SC's power to fix timelines for the President and Governors on granting, refusing and withholding assent to Bills passed by Assemblies. The bench of CJI Gavai, and Justices Surya Kant, Vikram Nath, P S Narasimha and A S Chandurkar said the hearing would commence from Aug 19, when it will first hear senior advocates K K Venugopal and A M Singhvi on behalf of Kerala and Tamil Nadu, respectively, on the states' preliminary objections to maintainability of the Reference. It said those opposing the reference, represented by Kapil Sibal, Rakesh Dwivedi, Gopal Subramaniam, would be given four days – Aug 19, 20, 21 and 26 - to complete their arguments. Those supporting the Reference – attorney general R Venkataramani and solicitor general Tushar Mehta – would place their response to maintainability plea as well as the constitutional issues warranting the Reference on Aug 28, Sep 2, 3 and 9. 'The nodal counsel in consultation with lawyers shall arrange the timetable for the arguing counsel so that the hearing could be completed on Sep 10. The timetable will be followed scrupulously,' the CJI-led bench forewarned. TOI was first to report on May 15 about the President sending a Reference to the SC for its opinion on the contentious issue of judiciary stepping into the domain of the executive, especially when the Constitution gave no power to the SC to grant deemed assent on behalf of the Governor to Bills. Critical of the SC's Apr 8 judgment and use of its Article 142 powers to rule that the 10 Bills pending with the TN governor to be deemed to have been assented to, the President had said, 'The concept of a deemed assent of the President and the Governor is alien to the constitutional scheme and fundamentally circumscribes the powers of the President and the Governor'. The Reference had said Articles 200 and 201, applicable to Governors and the President respectively, 'does not stipulate any time frame or procedure' to be followed by them while considering grant or refusal of assent to a Bill passed by an Assembly. Without any express provision in the Constitution, A bench of Justices J B Pardiwala and R Mahadevan on Apr 8 had set a three-month deadline for the Governor to either grant or return the Bill to the House. If the Bill is re-passed by the House and resent to him, then the governor must grant assent within a month, the SC had ruled. Delhi Announces 'Freedom From Garbage' Campaign For Cleanest Constituency
New Delhi: Delhi Chief Minister Rekha Gupta on Tuesday announced cash rewards ranging from Rs 10 lakh to Rs 1 crore for the cleanest RWA, ward, and assembly constituency, based on their performance in the 'Delhi Freedom from Garbage' cleanliness drive. During a preparatory meeting for the 'Delhi Freedom from Garbage' cleanliness drive aimed at transforming the capital into one of the cleanest and greenest cities in the country, Ms Gupta said the best-performing Resident Welfare Association (RWA) will be awarded Rs 25 lakh, while the second and third positions will receive Rs 15 lakh and Rs 10 lakh, respectively. The cleanest ward will get Rs 50 lakh, and the cleanest assembly constituency will receive Rs 1 crore in funding, she added. RWAs and organisations participating in the campaign are required to upload before-and-after photos on a dedicated portal, which will be used to evaluate performance and disburse the prize money, she added. Ms Gupta said Rs five crore has been allocated to the MCD for the campaign, assuring full government support to all those contributing to a cleaner Delhi. "We are writing a golden chapter in Delhi's history. For the first time, agencies like the MCD, Delhi government, PWD, Delhi Police, and others are working together in full coordination," Ms Gupta said, urging every citizen to take ownership under the campaign's motto "Meri Delhi, Meri Zimmedari" (My Delhi, My Responsibility). The drive will run from August 1 to 31, with the first two days focused on clearing backlogs in schools, hospitals, and offices. Every Saturday and Sunday, efforts will be concentrated on unauthorised colonies and JJ clusters. Special clean-up drives are also planned at Yamuna ghats on August 14, 21, and 28, while Ring Road will be cleaned on August 29 and 31. Meanwhile, taking a dig at the previous AAP government, CM Gupta said it had created a negative image of Delhi but under the leadership of the prime minister, a "positive and united front" is now working to address the city's long-standing issues starting with the problem of garbage.
