SC dismisses KAL, Maran pleas against Delhi HC order in SpiceJet case

The Supreme Court on Wednesday dismissed special leave petitions filed by KAL Airways and Kalanithi Maran seeking damages of over ₹1,300 crore from SpiceJet in a long-standing share transfer dispute.
A Bench of Justices PS Narasimha and AS Chandurkar upheld the Delhi High Court's order of May 23.
The High Court refused to condone their delay in filing appeals under Section 37 of the Arbitration and Conciliation Act, 1996 after concluding that they had been 'fence-sitting and were also guilty of deliberate and wilful concealment of facts from the court.'
'We find that on the basis of the material on record, the inference drawn by the Division Bench while refusing to condone the delay cannot be brushed away or that the conclusions drawn were without any basis. Hence, we are not inclined to interfere in exercise of jurisdiction under Article 136 of the Constitution. The special leave petitions are accordingly dismissed,' the order said.
Mr. Maran and KAL Airways were former promoters of SpiceJet. The High Court had, in its May 23 order, criticised the former promoter of taking a 'calculated gamble' by delaying the filing and re-filing of their appeals.
On May 17 last year, the Delhi High Court had quashed a Single Judge order of July 31, 2023 upholding an arbitral award asking SpiceJet and its promoter Ajay Singh to refund ₹579 crore plus interest to Mr. Maran.
The dispute between SpiceJet and Mr. Maran dates back to January 2015 when KAL Airways offered a 58.46% stake in SpiceJet to Mr. Singh, the principal shareholder, chairman, and managing director of the airline, at a meagre price of ₹2 per share due to the airline's financial troubles.

Shimla: Himachal Pradesh govt's admission that Rs 15.16 lakh payment to a contractor has been withheld since 2022 due to paucity of funds has prompted the high court to ask why an order pertaining to financial emergency in the state should not be passed. A bench, headed by Justice Ajay Mohan Goel, made the observations on Wednesday during the hearing of a petition filed by Shashi Thakur, a contractor of the public works department (PWD), Dharampur tehsil, Mandi district. Thakur approached the high court seeking directions to the department officials to release his pending payment of Rs 13.88 lakh along with interest at 18% per annum from the date of submission of the bill in 2022 until the date of actual payment. The high court initially issued a notice to the state govt on April 30 to file its reply, but it kept seeking more time. It was only when the court granted a last opportunity to the state govt that the department's Dharampur division executive engineer submitted his reply. "Due to paucity of funds with the state of HP exchequer, the payment of Rs 15.16 lakh cannot be disbursed to the petitioner to date," reads the executive engineer's reply. The official explained that during the financial year 2022-23, under the head of repair and maintenance, "tender amounting to Rs 2,376 lakh was awarded to various contractors against a budget provision amounting to Rs 357.96 lakh." He added that the petitioner contractor executed one work against this head of account. Taken aback by the reasoning, Justice Goel observed, "Taking into consideration the instructions that have been imparted to the court by the office of the advocate general, the deputy advocate general is directed to have instructions as to why the appropriate observations should not be made by the court in light of the provisions of Article 360 of the Constitution on the next date." The public works department's contractors' unions have been protesting from time-to-time since last year against the cash-strapped Himachal govt over the non-clearance of their payments running into crores. The Delhi High Court on Thursday (July 31, 2025) dismissed a plea by Turkish-based company Celebi Ground Handling India Private Limited against the Centre's decision to revoke its security clearance. Also Read | New ground handling firm to be hired at Chennai airport as replacement for Turkish firm Çelebi Justice Tejas Karia noted that similar pleas had been quashed earlier. A different Bench of the high court had on July 7 dismissed pleas by Turkey-based firms — Celebi Airport Services India Pvt Ltd and Celebi Delhi Cargo Terminal Management India Pvt Ltd — challenging the revocation of their security clearance by aviation watchdog Bureau of Civil Aviation Safety (BCAS) on May 15. BCAS revoked the security clearance of the companies days after Turkey backed Pakistan and condemned India's strikes on terror camps in the neighbouring country. The company's counsel had told the court that this petition was filed on July 4 after a coordinate Bench reserved its judgment in a similar case involving associated companies. The court on July 7 underlined the necessity to eliminate the possibility of espionage or dual use of logistics capabilities, which would be highly detrimental to the security of the country, especially in the event of an external conflict.
