Court granted Sharmistha Panoli protection after threats on social media: Lawyer

India Gazette06-06-2025
Kolkata (West Bengal) [India], June 6 (ANI): Following the interim bail granted to Law student Sharmistha Panoli by Calcutta High Court, her lawyer Kanchan Jaju said that the court has granted her protection after she received threats on social media.
Advocate Kanchan Jaju said that the bail procedure is in process, and after the signature of the Chief Judicial Magistrate (CJM), it would be sent to jail, and she would be released at 5 pm.
'The court has granted her protection. She has received threats, and after the court's order to take action against any threat, there should be a reduction in it. On social media, she is receiving a lot of threats. Her parents are happy she got bail,' she added.
MD Saimimuddin said, 'One of the conditions of bail was that the bond would be furnished to the satisfaction of the learned CJM at Alipur. Bond has been furnished. We have deposited an affidavit. We will send the release order from the court soon. There are some formalities of the correctional home. After that, she will be released. She will be released at 5 or 6 pm.'
Sharmistha Panoli, arrested for allegedly hurting religious sentiments through a social media post, was granted interim bail by Calcutta High Court on Thursday.
The court directed her to cooperate with the investigation, not leave the country, and furnished bail on a personal bond of Rs 10,000. The court also ordered appropriate police protection for her. Her father, Prithviraj Panoli, expressed relief, citing her health issues, including kidney problems and Attention-Deficit/Hyperactivity Disorder (ADHD).
Prithviraj Panoli said, 'I am very happy. No father would like his daughter to stay in jail. Her mother was crying for a long time, but she is very happy now. There were two concerns: her kidney problem and ADHD. She needs regular medicine, but since we didn't have a prescription, the medicine wasn't given in jail.'
'Also, when the video was posted, we found out after two days and told her to delete it. We hoped this would be a lesson for her, and that she would do better in the future,' Panoli said.
According to Sharmistha's lawyer, DP Singh, bail was granted on three conditions: Sharmistha must surrender her passport, cooperate with the investigation, and sign a bail bond.
Singh argued that Sharmistha is a victim of circumstances and that her social media post was a defence of her country based on videos she had seen. He questioned the severity of the response, suggesting that the community's reaction was disproportionate to her actions.
The 22-year-old law student from Pune, Sharmistha Panoli, was arrested by Kolkata Police in Gurugram on May 30, for allegedly hurting religious sentiments of a community with a video on Operation Sindoor. The Instagram clip was reportedly derogatory towards a particular religion. However, Panoli deleted the video and issued an apology on May 15. (ANI)

Rs 3,000 Crore Cyprus-Based Betting Fraud: ED Freezes Mule Accounts With Rs 110 Crore

MUMBAI: In a multi-city crackdown against a Cyprus-based illegal online betting platform, the ED has frozen Rs 110 crore parked in mule bank accounts as part of a Rs 3,000 crore fraud, an official said on Thursday. Cricket stars Sunil Narine and Nicholas Pooran, a Bollywood actress and an Indian rap star were among the brand ambassadors of the platform Parimatch. The ED initiated an investigation on the basis of an FIR registered by the Cyber Police Station, Mumbai, against on complaints that it defrauded investors by luring them with high returns, generating over Rs 3,000 crore in a year. The probe also uncovered that payment companies whose applications for Payment Aggregator licenses were rejected by the RBI, offered their services to Parimatch in the garb of technology service providers (TSPs) and offered their API (Application Programming Interface) to facilitate user fund collections, said an ED statement. During the multicity searches, the Directorate of Enforcement (ED), Mumbai Zonal Office, seized incriminating documents and digital devices on Tuesday under the Prevention of Money Laundering Act (PMLA), 2002 from 17 locations in Mumbai, Delhi, Noida, Jaipur, Surat, Madurai, Kanpur and Hyderabad. The probe against Parimatch revealed that the platform gained visibility through aggressive marketing, including sponsorship of sports tournaments and partnerships with well-known celebrities The ED said the platform also set up Indian entities to run surrogate advertisements under the names "Parimatch Sports" and "Parimatch News". Payments to these agencies were made via foreign inward remittances. Searches revealed that Parimatch routed users' funds through mule accounts using different strategies across the country. In one case, funds deposited by users into mule accounts were withdrawn in cash in a specific locality in Tamil Nadu. This cash was handed over to hawala operators, who used it to recharge virtual wallets of a UK-based company. These wallets were then used to buy USDT cryptocurrency in the name of mule crypto accounts, operated by Parimatch agents.

Sharing your credit card for rewards? It could trigger a tax headache

Do you let friends use your credit card for big purchases, or swipe it for others to earn cashback and reward points? It may sound like a harmless way to make some extra money, but tax experts caution that it can put you on the Income Tax Department's radar. That's exactly the situation a Reddit user claims to be in. Identifying himself as a student with no job or business, he revealed spending nearly Rs 24 lakh on a credit card in a single year, most of it by letting friends use the card in exchange for cashback and reward points. The massive spend now shows up in his Annual Information Statement (AIS) and Taxpayer Information Summary (TIS), leaving him worried about possible tax notices. Why this is a red flag for tax authorities Under the Income-Tax Act, banks must report credit card payments exceeding Rs 10 lakh a year as Specified Financial Transactions (SFT). 'In this case, the expenses are not commensurate with the student's declared income, which is nil. The department could treat the funds used to pay the bills as unexplained income under Section 69 and impose heavy penalties,' said Ritika Nayyar, partner, Singhania & Co. Nayyar added that while cashback on personal expenses is usually treated as a discount, if total annual cashback exceeds Rs 50,000, it may be taxed as a gift under 'Income from Other Sources'. For simple income sources, ITR-1 could apply, but the choice of form depends on the individual's income profile. Scrutiny triggers and legal exposure 'The transaction qualifies as high-value under Section 285BA read with Rule 114E,' said Saumya, associate, PSL Advocates & Solicitors. 'Tax officers look for mismatches between repayment sources and declared income, multiple cards splitting large spends, high foreign transactions, or signs of money rotation,' she added She warned that letting friends use a credit card violates bank terms and could lead to liability under the Prevention of Money Laundering Act (PMLA) or even cheating provisions under the Bharatiya Nyaya Sanhita. Safer routes for reward hunting According to Shefali Mundra, tax expert at ClearTax, 'Using a card for others' spending can breach agreements and invite money laundering suspicion. Instead, use cards for personal expenses, maintain transaction records, and report substantial cashback earnings in tax returns.' She cites the case of an Ahmedabad trader who lost Rs 32 lakh after allowing a friend to use 34 credit cards, a costly reminder that 'cashback chasing' can backfire. Bottom line: In the age of AIS and SFT reporting, spending far beyond your declared means, even in the name of reward points, risks drawing the taxman's attention, along with potential legal consequences.
