PNP: 81-year-old man jailed due to mistaken identity to receive compensation

GMA Network9 hours ago

The 81-year-old man who was wrongfully imprisoned in a case of mistaken identity will receive compensation, according to the Philippine National Police (PNP).
'Unfortunately, may napagkamalian but that person can invoke now yung compensation. Mayroon tayong batas na nagco-compensate sa mga taong wrongfully convicted,' PNP chief Police General Nicolas Torre III said at a press briefing Monday.
(Unfortunately, there was a mistake but that person can now invoke the compensation. We have a law that compensates those wrongfully convicted.)
The amount of compensation will depend on the decision of the concerned court, according to Torre.
Regarding the questions raised in connection with the old man's arrest, Torre said the PNP will check the details of the incident and will issue a statement on the matter.
'We will give you more details kapag nakuha namin. Pasensya na kayo hindi pa namin na-examine ang issue na yan. We'll do a close examination. Magbibigay kami ng statement regarding that matter,' Torre said.
(We will give you more details when we get them. I'm sorry we haven't examined that issue yet. We'll do a close examination. We will issue a statement regarding that matter.)
In a statement, the National Union of Peoples' Lawyers (NUPL) condemned the arrest and six-month detention of Prudencio Cebu 'Tatay Pruding' Calubid Jr. who was 'wrongfully and maliciously imprisoned' for insurgency.
'Police officials claimed they had apprehended Prudencio Calubid, an alleged high-ranking officer of the Communist Party of the Philippines–New People's Army (CPP-NPA),' the NUPL said.
'But the real Prudencio Calubid, a peace consultant of the National Democratic Front of the Philippines (NDFP), has been a desaparecido since June 26, 2006, when he, his wife Celina Palma, and companions Gloria Soco and Ariel Beloy were abducted by suspected military agents. Yesterday marked the 19th year since their enforced disappearance," the NUPL said.
A P7.8-million reward was offered for the real Prudencio Calubid's capture, the NUPL noted.
'In such a system, law enforcement agencies, including the PNP, CIDG, and entities under the NTF-ELCAC, are incentivized not to uphold justice, but to deliver 'results' that align with operational quotas and reward mechanisms,' the NUPL said.
'Innocent civilians, especially the poor, become expendable. Bounty-hunting has replaced due process, with public funds being used to underwrite such abuses,' it added.
In its 67-page ruling, the Court of Appeals in its 67-page ruling found that the police failed to exercise minimum diligence required to verify whether Calubid was the same person named in multiple criminal informations and arrest warrants. — RSJ, GMA Integrated News

Sandiganbayan finds ex-PTA execs guilty of graft over P3.7-M sports complex

The Sandiganbayan has found former general manager Robert Dean Barbers of the defunct Philippine Tourism Authority (PTA) and two other PTA officials guilty of graft over a P3.7-million sports complex in Intramuros, Manila in 2005. In a decision dated June 27, the anti-graft court said that while it did not find evidence of a corrupt or fraudulent intent on Barbers and his co-accused Edgar Bocar and Jose Diaz, the prosecution 'was able to present proof beyond reasonable doubt on the accused's brazen disregard of pertinent laws, rules, and regulations amounting to gross inexcusable negligence.' The Sandiganbayan said that Barbers, Bocar, and Diaz proceeded with the PTA sports complex project and paid I.A. Bosque Construction Corporation P3.7 million of public funds even if the said project was not approved by the Intramuros Administration (IA) as required under existing laws. The IA, the Sandiganbayan said, repeatedly issued notices of violation that were neither heeded nor even responded to by the accused PTA officials. 'As pointed out by the prosecution, the accused were given every chance to rectify their errors, but they remained adamant, resulting in the disbursement of funds for nothing. The acts of negligence of the accused clearly and collectively show that they are both gross and inexcusable, and amount to a tacit approval of a criminal design injurious to the government,' the Sandiganbayan said. The accused in the case argued that they were not informed of the IA's disapproval, but the Sandiganbayan junked their defense for lack of merit. 'This [defense of not knowing] does not inspire belief based on the evidence on record. To this court, it is a lame excuse for their disregard for the laws and duly constituted authorities,' the Sandiganbayan said. 'Their open defiance of the law did not merely result in the loss of government funds but also incurred the risk that the project would not comply with the minimum safety standards, as signified by the required permits and licenses. This is not simply overzealousness in the exercise of one's duties. This is breach of duty in a blatant and extremely careless manner,' the Sandiganbayan added. All three accused were sentenced to a jail term of six to eight years each, with perpetual disqualification from public office as an accessory penalty. Likewise, they are jointly and severally liable for the amount of P3.7 million representing the 15% mobilization fee paid to I.A. Bosque Construction Corporation, with 6% legal interest computed from the finality of the decision. GMA News Online is trying to reach out to the concerned individuals.—LDF, GMA Integrated News

PNP vows peaceful Marcos SONA amid VP Sara impeachment issue

A contingent from the Manila Police District is on standby along Commonwealth Avenue in Quezon City as several militant groups hold protest actions against President Ferdinand Marcos Jr's State of the Nation Address on Monday, July 22, 2024. VINCE ANGELO FERRERAS/GMA Integrated News The Philippines National Police (PNP) on Monday said it will take measures to ensure a peaceful conduct of the fourth State of the Nation Address (SONA) of President Ferdinand "Bongbong" Marcos Jr. next month. 'Hindi naman tayo makapagbigay ng exact numbers [ng police deployment] at saka classified yan. Kami na ang bahala basta siguraduhin namin that the SONA will be peaceful,' PNP chief Police General Nicolas Torre III said in a press briefing. (We cannot give exact numbers of the police deployment and it's classified. We'll take care of it and we will make sure that the SONA will be peaceful.) Asked if the PNP will make adjustments to its preparations considering there is an ongoing impeachment case of Vice President Sara Duterte, Torre said it depends on the estimate from the intelligence they receive. 'Well, depende sa intel estimate yan (Well, it depends on the intel estimate),' Torre said. 'Ang template naman natin taon-taon yan. Napakarami namang dumaan na mga SONA na puro marami ring mga issues, hindi lang naman sa administrasyon ngayon kundi previous administration maraming issues talaga yan. Hindi nauubusan yan, so sa atin we are going to prepare with the worst in mind but of course we hope for the best,' he added. (Our template is similar for every year. We had SONAs surrounded by so many issues, not only in the current administration but also in the previous administration, there are always so many issues. That never ends, so for us we are going to prepare with the worst in mind but of course we hope for the best.) Duterte will not be attending Marcos' fourth SONA on July 28, according to House Secretary General Reginald Velasco. The Vice President is accused of betrayal of public trust, culpable violation of the Constitution, graft and corruption, and other high crimes. She has denied the allegations. On June 10, the Senate sitting as an impeachment court voted to return to the House of Representatives the articles of impeachment against Duterte without dismissing or terminating them. The move came after one of the senator-judges, Ronald 'Bato' Dela Rosa, an ally of the Duterte family, even before the impeachment court convened, moved for the dismissal of the impeachment complaint against the Vice President. —RF, GMA Integrated News
