There was an urgent need for regulation in the digital space, due to the constant surveillance by social media, rising cybercrime, and the evolving threat landscape, the Centre told the Karnataka High Court during a hearing on the X Corp (formerly Twitter) case over content takedown directives.Solicitor General Tushar Mehta, appearing for the Union Government, argued that internet intermediaries like 'X' must act responsibly and cannot claim the same constitutional rights as individuals.The hearing, before Justice N Nagaprasanna, pertained to X Corp's challenge to the applicability of Section 79(3)(b) of the Information Technology Act. It had earlier contended that Section 79(3)(b) of the IT Act, often used to justify takedown directives, cannot serve as an independent source of executive power to block content.It said that blocking orders can only be issued through due process under Section 69A read with the IT Rules and not via direct instructions under Section 79.Highlighting the extent of digital surveillance , Mehta told the court: "Today, even a smart TV with a camera is a potential surveillance tool. Many public figures ask visitors to leave their phones outside because these devices have effectively become recorders. We are being continuously monitored by social media," he said.The Solicitor General also touched upon the growing influence of Artificial Intelligence, calling it a developmental boon but also a potential hazard.He noted that legal frameworks must evolve to address the threats posed by technological advances.Dismissing X Corp's claim that it enjoys rights under Article 19 ( Freedom of Speech and Expression), Mehta asserted that such protections are reserved for individuals, not platforms."X is simply a notice board. Only those who post content can claim Article 19 protections," he said, adding that the Supreme Court in Shreya Singhal v Union of India had clarified that content on public platforms can be regulated in public interest.Addressing the issue of intermediary liability , Mehta referred to Rule 3(1)(d) of the IT Rules 2021, which requires intermediaries to remove unlawful content upon government or court notification. Failure to comply results in the loss of "safe harbour", a legal immunity provided under Section 79 of the IT Act.He clarified that Section 79 is not a penal provision, but a protective exception that intermediaries lose if they ignore legal notices. "Section 79 is an exception to the rule. You can't claim exemption without accountability," Mehta argued.Backing the government's push for regulation, Mehta said cybercrime complaints in the country rose from around 26,000 in 2019 to over 22.6 lakh in 2024--a staggering 401 per cent increase."This massive surge shows the internet is facing threats that endanger individuals, communities, and the nation. A coordinated response involving law enforcement, platforms, and regulators is essential," he said.Referring to a recent Supreme Court observation in the Ranveer Allahbadia case, Mehta stressed the need to regulate vulgar and harmful content while protecting free speech."The platform itself amplifies content through algorithmic sequencing. If you watch something repeatedly on YouTube, it appears on top--this is curated amplification," he said.The bench acknowledged that digital platforms are designed to boost user engagement through algorithmic preference and noted that such mechanisms raise questions about the neutrality of intermediaries.The case will be heard again on July 18.

Remove Ads The CAG has flagged concerns over corporate governance issues among the central public sector enterprises (CPSEs), saying that out of the 71 listed CPSEs, 26 had inadequate board composition, 55 lacked the required number of independent directors and 20 did not have a woman director on their CAG submitted a report on the financial performance of CPSEs in Parliament on Monday, reviewing the finance and corporate governance of government entities for 2021-22. The report also said that many CPSEs failed to meet corporate social responsibility (CSR) spending targets, with 14 CPSEs allocating less than 2% of their net profit towards CSR activities. A total 121 central public sector enterprises and corporations declared a dividend of ₹1.11 lakh crore for 2021-22, out of which the Centre received Rs₹54,381 crore, according to the losses incurred by government companies and corporations decreased to Rs 31,347 crore in 2021-22.

Jammu and Kashmir Chief Minister Omar Abdullah has urged the Centre to clear two long-pending water infrastructure projects—the Tulbul Navigation Barrage in north Kashmir and a Chenab River water-lifting scheme for Jammu—after New Delhi suspended the 1960 Indus Waters Treaty (IWT) in response to Pakistan-aided terrorism. The Centre's move came in the wake of the April 22 Pahalgam terror attack, which killed 26 people, mostly tourists. As part of a broader retaliatory package, the government placed the IWT in abeyance, freeing India to explore new water management projects on rivers otherwise reserved for Pakistan. India is entitled to full use of waters from the eastern rivers—Sutlej, Beas, and Ravi—totalling about 33 million acre-feet (MAF), while Pakistan has rights over the Indus, Jhelum, and Chenab, which together carry 135 MAF annually. In an interview to PTI, Abdullah reiterated his long-standing opposition to the IWT, calling it 'the most unfair document ever imposed on the people of Jammu and Kashmir'. He said the state is now focused on 'medium-term projects that can begin immediately,' starting with the revival of the Tulbul Navigation Barrage—also known as the Wullar Barrage—at Sopore in north Kashmir. The proposed installation of drop gates at the barrage would regulate water levels in the Jhelum River, aiding both navigation and winter power generation at downstream hydroelectric stations like Lower Jhelum and Uri. 'This project will not only facilitate navigation but also enable us to generate more electricity in winter,' the chief minister said. Originally approved in 1986, the Tulbul project was halted in 1987 after Pakistani objections. India revived work after the 2016 Uri attack, but efforts to negotiate its status failed as Pakistan refused to engage during five rounds of Permanent Indus Commission talks between 2017 and 2022. India maintains that the project complies with the IWT, as it does not store water for consumptive use and qualifies as a non-consumptive regulating structure. The second proposal—the Chenab Water Supply Scheme—aims to address mounting water stress in Jammu city. Abdullah said the Chenab River, which runs near Akhnoor, could serve as a long-term source for Jammu's drinking water. 'This project could feed Jammu for the next two to three decades,' he said, adding that 'we have already had the conversation' with the Centre and that a senior advisor to the Prime Minister had recently visited the Union territory to review both the Tulbul and Chenab proposals. The Jammu and Kashmir government has also sought permission to engage international funding agencies for the Chenab project, which would lift water from the river and distribute it across the district to meet growing demand. Jammu, the region's winter capital, currently depends on the Tawi River—a tributary that eventually joins the Chenab in Pakistan—for its drinking water. With the Tawi's capacity falling short, the administration sees the Chenab lift scheme as a vital alternative. New Delhi, Jul 21 (UNI) The Supreme Court today issued notice on a public interest litigation (PIL) seeking enforcement of consumers' 'Right to Know' the identity and details of sellers and intermediaries involved in goods and services. A bench comprising Justice Vikram Nath and Justice Sandeep Mehta sought responses from the Centre and all States within four weeks. The petition highlights that consumers must be informed not only about the quality, quantity, potency, purity, standards, and certification of products, but also the full details of the distributor, dealer, trader, seller, and shop owner to enable effective redressal against unfair trade practices. It invokes Sections 2(6) and 2(9) of the Consumer Protection Act, 2019, read with Article 19 of the Constitution. It seeks directions to the Centre and States to ensure that all sellers display their registration or license details, including name, address, contact number, and employee strength, prominently at the entry gate on a board visible to any ordinary consumer. The petition emphasises that transparency about sellers' identities will deter fraud and misrepresentation, empower consumers to make informed decisions, and ensure accountability. It states, 'Right to Know helps consumers avoid falling prey to fraudulent or deceptive sellers who might misrepresent products or disappear after transactions.' Highlighting the importance of operationalising this right in both offline and online retail environments, the petitioner contends that lack of such information hampers consumers from filing complaints or seeking redressal for poor quality, adulteration, overpricing, or other exploitative practices. The PIL also refers to online marketplace rules mandating disclosure of details of high-volume sellers to ensure consumer safety and market transparency. It submits that consumer rights under Articles 19 and 21 include the right to be informed about the authenticity of sellers and the safety standards of products to protect health, safety, and fair market practices.
