Delhi HC Temporarily Stays Release Of ‘Udaipur Files' Amid Legal Challenge To CBFC Certification
Scheduled for a global release on Friday, the film is based on the gruesome murder of Kanhaiya Lal, a tailor from Udaipur, Rajasthan, who was killed in June 2022 by Mohammad Riyaz Attari and Ghaus Mohammad through throat slitting.
A bench comprising Chief Justice D.K. Upadhyaya and Justice Anish Dayal was hearing several petitions, including one by Maulana Arshad Madani, President of the Islamic cleric body Jamiat Ulema-i-Hind, seeking to annul the CBFC certification given to the film.
As per the petition filed by Maulana Arshad Madani, the CBFC certification was granted in violation of Section 5B of the Cinematograph Act, 1952 and the Guidelines for Certification of Films for Public Exhibition, since the release of the film 'Udaipur Files' has the potential to inflame communal tensions and disrupt public order, severely undermining the fabric of religious harmony in the country.
In its order, the Chief Justice Upadhyaya-led Bench allowed the petitioners as well as the general public to file within two days revision plea before the Union government under Section 6 of the Cinematograph Act. Section 6 vests the Centre with adequate powers to declare a film to be uncertified or pass orders providing for interim measures, including suspension of the film from public exhibition.
The Delhi HC asked the Centre to decide the revision pleas within a week after giving an opportunity of hearing to the producer. Further, it ordered that the prayer for interim relief, if made, will also be considered and decided.
In a hearing held on Wednesday, the Delhi High Court recorded Additional Solicitor General (ASG) Chetan Sharma's statement that before the film was certified, the CBFC proposed certain cuts, and the producer of the film had implemented them.
It had asked the film's producer to arrange for a private screening of the movie and the trailer on Wednesday itself for the counsels appearing in the matter, and posted the batch of pleas for further hearing on Thursday (July 10).

HC asks NIA to file chargesheet in Jiribam case within 30 days
Imphal: Manipur high court directed the NIA to file within one month the charge sheet in the killing of three women and three children in Jiribam in Nov last year. A division bench comprising Chief Justice K Somasekhar and Justice Ahanthem Bimol Singh gave the direction while hearing a PIL on Thursday. "Subsequent to recording of the FIR, law was set into motion but till today, no specific report has been submitted for filing of charge sheet against culprits/accused," the HC said. It noted that the counsel for the Centre has informed "that investigation has been carried out by the investigating agency and even it is in the process of completion of the investigation and filing of charge sheet against the culprits/accused." The Centre's counsel placed before the court two sets of sealed covered envelopes, containing a detailed progress report on the investigation, the order noted, "The two sealed covered envelopes said to contain the detailed progress report are taken on record. " "Keeping in view the status in this matter, one month's time is granted for submitting the detailed report in terms of charge sheet under Section 173 of CrPC and corresponding provision of BNSS Act, 2023," the HC said. Probe into allegations of students bring forced to wear hijab
Kalaburagi: An assistant professor at the Central University of Karnataka in Kalaburagi was accused of coercing female students to don the hijab during a field trip. This led the university to launch an internal investigation into the issue. The Legal Rights Protection Forum, an organisation based in Hyderabad, submitted a formal complaint to the university's vice-chancellor, professor Battu Satyanarayana. In their memorandum, the forum called on the university to implement suitable disciplinary measures against assistant professor Abdul Majid. University's registrar RR Biradar confirmed that the complaint was received on July 26. He noted that the field trips were primarily centred around locations linked to Islamic culture in Kalaburagi and Bidar. Abdul Majid, assistant professor in the history and archaeology department, reportedly insisted that female students wear the hijab while attending these outings. The registrar stated that the university has established an internal committee to examine the allegations.

Delhi HC upholds Medha Patkars conviction in defamation case by LG Saxena
New Delhi, Jul 29 (PTI) The Delhi High Court on Tuesday upheld the conviction and punishment awarded to activist Medha Patkar in a defamation case filed by Delhi LG V K Saxena in 2000. Justice Shalinder Kaur said the trial court order, against which Patkar had approached the high court, did not require any interference. 'Upon perusal this court finds no illegality in the order (by trial court) and requires no interference, and (appeal) accordingly dismissed," Justice Kaur said. Saxena filed the case 23 years ago when he was heading an NGO in Gujarat. The high court said there was illegality or material irregularity in the findings of the trial court and added that the order of conviction was passed after due consideration of evidence and the applicable law. It said that Patkar failed to demonstrate any defects in the procedure which was followed or any error in the law which resulted in the miscarriage of justice. The judge also upheld the order on sentence, where Patkar was released on 'probation of good conduct", and said it did not require any interference. Probation is a method of non-institutional treatment of offenders and a conditional suspension of sentence in which the offender, after conviction, is released on bond of good behaviour instead of being sent to prison. The high court, however, modified the condition of probation imposed by the trial court, requiring Patkar to appear before the trial court once in every three months, and allowed her to either appear physically or through VC or be represented through the lawyer during the appearances. The court also dismissed Patkar's plea against dismissal of her application to introduce and examine an additional witness to prove her defamation case lodged against Saxena. While 70-year-old Patkar was represented by senior advocate Sanjay Parikh, advocate Gajinder Kumar argued on behalf of Saxena. The Narmada Bachao Andolan leader challenged the April 2 sessions court order upholding her conviction handed out by a magisterial court in the case. The sessions court, which upheld Patkar's conviction in the case, released her on 'probation of good conduct"on furnishing a probation bond of Rs 25,000 on April 8 and imposed a precondition on her of depositing Rs 1 lakh as fine. The magisterial court on July 1, 2024 sentenced Patkar to five months of simple imprisonment and slapped a Rs 10 lakh fine after finding her guilty under Section 500 (defamation) of the IPC. Saxena filed the case as president of the National Council of Civil Liberties against Patkar for her defamatory press release against Saxena issued on November 24, 2000. On May 24, 2024, the magisterial court held that that Patkar's statements were not only per se defamatory but also 'crafted to incite negative perceptions" about him. The accusation that the complainant was 'mortgaging" the people of Gujarat and their resources to foreign interests was a direct attack on his integrity and public service, it had said. On April 2, the sessions court had dismissed a challenge to the order and held Patkar was 'rightly convicted" and there was 'no substance" in the appeal against the verdict of her conviction in the defamation case.
